      The Occupational Safety and Health Administration (OSHA) and the Suncoast Utility Contractors Association, Inc. (SUCA) agreed to establish an Alliance to reduce and prevent exposure to hazards during trenching and excavation procedures, confined space entry and other imminent dangers in the underground utility construction industry. The goal will be achieved by developing and sharing information, guidance, and training resources.

The General Consulate of Mexico in Dallas, Texas (the Consulate) and the U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Dallas and Fort Worth Area Offices, hereinafter referred to collectively as "the Participants;"

RECOGNIZING the joint commitment to protect workers' rights for Mexican workers in the United States acknowledged in the Letter of Arrangement between the Ministry of Foreign Affairs of the United Mexican States and the Occupational Safety and Health Administration of the Department of Labor of the United States of America, concerning Workplace Safety and Health Protections Applicable to Mexican Workers in the United States, signed at Washington, D.C., on September 2, 2021; and

RECOGNIZING that OSHA's Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health to form an Alliance to achieve the following:

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican Nationals in the Texas counties where the Participants have jurisdiction area and others information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in the Texas counties where the Participants have jurisdiction regarding workplace safety and health.
  • To develop training and education programs for Mexican workers and Mexican employers in the Texas counties where the Participants have jurisdiction to promote understanding of workers' rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.
Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate's Web site) to Mexican Nationals working in the Texas counties where the Participants have jurisdiction and their employers.
  • To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events.
  • To participate in "Mobile Consulate" activities and events.
Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights under the OSH Act whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in the Texas counties where the Participants have jurisdiction to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers' rights and responsibilities of employers under the OSH Act.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

DE LOS ESTADOS UNIDOS DE AMÉRICA

Las Oficinas de Área de Dallas y Fort Worth de la Administración de Seguridad y Salud Ocupacional (OSHA) del Departamento de Trabajo de los Estados Unidos de América y el Consulado General de México en Dallas, Texas, en adelante denominados conjuntamente “los Participantes”;

RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores mexicanos en los Estados Unidos reconocidos en la Carta de Arreglo entre la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos y la Administración de Seguridad y Salud Ocupacional del Departamento de Trabajo de los Estados Unidos de América relativa a las Protecciones de Seguridad y Salud en el Lugar de Trabajo Aplicables a los Trabajadores Mexicanos en los Estados Unidos, firmada en Washington, D.C., el 2 de septiembre de 2021; y

RECONOCIENDO que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente:

Objetivo General

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos y a otros en los Condados de Texas donde los Participantes tengan jurisdicción información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de los Estados Unidos de América sobre los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en los Condados de Texas donde los Participantes tengan jurisdicción sobre la seguridad y la salud en el lugar de trabajo.
  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en los Condados de Texas donde los Participantes tengan jurisdicción a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act, incluyendo el uso del procedimiento de quejas de OSHA.
Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado), a los nacionales mexicanos que trabajan en los Condados de Texas donde los Participantes tengan jurisdicción y a sus empleadores.
  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del “Consulado Móvil”.
Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan en los Condados de Texas donde los Participantes tengan jurisdicción para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.

Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) and the North American Excavation Shoring Association (NAXSA), Association of Equipment Manufacturers (AEM), National Utility Contractors Association (NUCA), Associated General Contractors (AGC), Common Ground Alliance (CGA), International Union of Operating Engineers (IUOE), and Laborers’ International Union of North America (LIUNA) recognize the value of establishing a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA NAXSA, AEM, NUCA, AGC, CGA, IUOE, and LIUNA hereby form an Alliance to provide their members/associations and the public with information, guidance, and access to training resources that will help them protect workers by reducing and preventing exposure to trenching, excavation, shoring, and other “Focus Four” hazards and addressing equipment related issues, as well as understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

This agreement provides a framework and objectives for the Alliance’s activities. Alliance participants also agree to meet the requirements for program participation laid out in the “Fundamental Requirements for OSHA Alliance Program Participants” and the “Guidelines for OSHA’s Alliance Program Participants: Alliance Products and Other Alliance Projects.”

Through the Alliance, the organizations will use available injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In developing this Alliance, OSHA, NAXSA, AEM, NUCA, AGC, CGA, IUOE, and LIUNA recognize that OSHA’s State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives:

  • Share information on OSHA’s National Initiatives (Emphasis Programs, Regulatory Agenda, Outreach), and opportunities to participate in initiatives and the rulemaking process, including those relevant to trenching, excavation, equipment operators and construction related activities.

  • Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers through communications such as: OSHA and stakeholder websites, print, electronic (newsletters, membership network emails) and social media (blogs, Facebook, Twitter, etc., utilizing OSHA campaign #hashtags), and scheduled calls/meetings.

  • Develop information on the recognition and prevention of trenching hazards as well as other Focus Four hazards including falls, struck-by and other topics identified over the course of the Alliance, and communicate such information (e.g., electronic newsletters, electronic assistance tools, and OSHA and Alliance websites) to employers and workers in the industry. Ensure information developed encourages and reflects the diversity of the workforce and are accessible in multiple languages and formats.

  • Speak, exhibit and/or appear at OSHA forums and roundtable discussions, and Alliance and industry meetings, conferences (e.g., Annual ConExpo-Con/Agg (CECA), Annual Utility Expo, Trenching Safety Summit, etc.), and equipment/trade shows (e.g., World of Asphalt) to collaborate and forge innovative, creative, and effective ways to fill the gap in trench and shoring safety communication and education between industry, government, and small- to medium- sized contractors.

  • Share information among OSHA personnel and industry safety and health professionals regarding good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).

  • Encourage worker participation in workplace safety and health by engaging with labor representatives from Laborers’ International Union of North America and the International Union of Operating Engineers to ensure that worker perspectives are taken into account, and that resources and training materials/programs developed and offered through this alliance are made available in appropriate languages to equitably meet the needs of their target audiences.

  • Encourage stakeholders to build relationships with OSHA’s Regional and Area Offices to address health and safety issues, including trench safety and construction related activities.

Training and Education

The Participants intend to work together to achieve the following objectives:

  • Coordinate with other Alliance participants to focus on information sharing on improving controls in equipment for recognized hazards (i.e., noise, silica, etc.).

  • Develop effective training and education programs (e.g., Trench Safety Summit) and effective ways to fill the gap in trench and shoring safety communication and education between industry, government, and small- to medium- sized contractors.

  • Develop effective training and education programs (Above Ground Demo Day) for OSHA, including State Plans, OSHA On-Site Consultation Programs, and other Alliance stakeholders, as appropriate.

OSHA’s Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communication, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization’s products or services.

An implementation team made up of representatives of each organization will meet one to two times per year to discuss the responsibilities of the participants, to share information on activities, and to track results in achieving the goals of the Alliance. OSHA team members will include representatives of the Directorate of Cooperative and State Programs and Directorate of Construction Programs and any other appropriate offices. OSHA will encourage the participation of State Plans and OSHA On-Site Consultation programs on the team.

This agreement will remain in effect for two years. Any signatory may terminate their participation in the Alliance for any reason at any time, provided they give 30 days’ written notice. If OSHA chooses to terminate the Alliance, they will give all signatories 30 days’ written notice. This agreement may be modified at any time with the written concurrence of all signatories.

U.S. DEPARTMENT OF LABOR AND
THE INTERNATIONAL ALLIANCE OF THEATRICAL STAGE EMPLOYEES, MOVING PICTURE TECHNICIANS, ARTISTS, AND ALLIED CRAFTS OF THE UNITED STATES, ITS TERRITORIES, AND CANADA, AFL-CIO, CLC

Since entering into an Alliance on July 16, 2013, with subsequent renewal on February 15, 2018, the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA), the United States Institute for Theatre Technology (USITT), and the International Alliance of Theatrical Stage Employees, Moving Picture Technicians, Artists, and Allied Crafts of the United States, its Territories, and Canada, AFL-CIO, CLC (IATSE) recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. Specifically, OSHA, USITT, and IATSE have worked together to improve workplace health and safety by sharing information, guidance, and access to training resources that address occupational hazards, and promoting understanding of the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act.

OSHA, USITT, and IATSE continue to recognize the value of maintaining a collaborative relationship to improve safety and health practices and programs in American workplaces, and commit to continue their work together through an Alliance Program Ambassador relationship.

In recognition of this ongoing commitment, OSHA will continue to foster an active relationship with USITT and IATSE by:

  • Providing routine communications on enforcement, regulatory, and outreach initiatives.
  • Sharing invitations to and offering opportunities to speak at OSHA Alliance Program and other agency stakeholder meetings or events, such as outreach and training activities through the National, Regional, or Area Office, and the National Alliance Program Construction Roundtable and Forum.
  • Engaging in information sharing and technical discussions, as appropriate, including completing special projects of mutual interest that align with agency priorities and as resources allow.
  • Maintaining USITT’s and IATSE’s status as Alliance Program Ambassadors on the agency’s public webpage.

USITT and IATSE will continue to foster an active relationship with OSHA by:

  • Sharing information with members and stakeholders on OSHA’s National Initiatives (Enforcement, Regulatory, and Outreach), and encouraging their participation in OSHA’s outreach initiatives and rulemaking processes.

  • Encouraging USITT and IATSE to build relationships with OSHA’s National, Regional and Area Offices to address health and safety issues.
  • Sharing information with OSHA personnel and industry safety and health professionals regarding USITT’s and IATSE’s good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).
  • Offering OSHA opportunities to speak, exhibit, or appear at conferences, local meetings, or other events, including, where applicable, through coordination with sponsoring or host organizations.
  • Adhering to requirements laid out in the Alliance Program Directive regarding the prohibition on promoting or implying the agency’s endorsement of their policies, products, or services, including acknowledging that they will not receive any preferential treatment related to any statutory function of the agency.
  • Abiding by all terms and conditions for the use of the Alliance Program logo as specified in OSHA’s Guidelines for Use of the Alliance Logo.

OSHA’s cooperative programs provide organizations an opportunity to participate in a voluntary, collaborative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communication, training, and education. These programs have proven to be valuable tools for both OSHA and participants. By entering into this Ambassador relationship, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization’s products or services.

This Ambassador relationship will remain in effect for the duration of an ongoing cooperative association and a good faith effort by all parties to meet the intent of this document and its underlying policies. Any signatory may terminate it for any reason at any time, provided they give 30 days’ written notice. Termination by one signatory will not nullify the Ambassador relationship with all signatories, with the exception of OSHA; OSHA may terminate the Ambassador relationship as a whole, or its relationship with one or more individual signatories.

ESTABLISHING AN ALLIANCE PROGRAM AMBASSADOR RELATIONSHIP BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR AND
NATIONAL ASSOCIATION OF WOMEN IN CONSTRUCTION

Since entering into an Alliance on August 21, 2013, with a subsequent renewal on December 13, 2017, the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) and the National Association of Women in Construction (NAWIC) have worked together to improve workplace health and safety by sharing information, guidance, and access to training resources that address occupational hazards, and promoting understanding of the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act.

OSHA and NAWIC continue to recognize the value of maintaining a collaborative relationship to improve safety and health practices and programs in American workplaces, and commit to continue their work together through an Alliance Program Ambassador relationship.

In recognition of this ongoing commitment, OSHA will continue to foster an active relationship with NAWIC by:

  • Providing routine communications on enforcement, regulatory, and outreach initiatives.
  • Sharing invitations to and offering opportunities to speak at OSHA Alliance Program and other agency stakeholder meetings or events, such as outreach and training activities through the National, Regional, or Area Office, and the National Alliance Program Construction Roundtable and Forum.
  • Engaging in information sharing and technical discussions, as appropriate, including completing special projects of mutual interest that align with agency priorities and as resources allow.
  • Maintaining the organization’s status as Alliance Program Ambassador on the agency’s public webpage.

NAWIC will continue to foster an active relationship with OSHA by:

  • Sharing information with members and stakeholders on OSHA’s National Initiatives (Enforcement, Regulatory, and Outreach), and encouraging their participation in OSHA’s outreach initiatives and rulemaking processes.
  • Sharing information with members and stakeholders on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • Encouraging NAWIC to build relationships with OSHA’s National, Regional and Area Offices to address health and safety issues.
  • Sharing information with OSHA personnel and industry safety and health professionals regarding NAWIC’s good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).
