AGREEMENT RENEWING AN ALLIANCE
BETWEEN
OKLAHOMA CITY AREA OFFICE
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION

AND
MID CONTINENT EXPLORATION AND PRODUCTION SAFETY NETWORK
AND
OKLAHOMA DEPARTMENT OF LABOR/OSHA CONSULTATION DIVISION
The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Oklahoma City Area Office, Mid Continent Exploration and Production Safety Network (MCEPS), and Oklahoma Department of Labor/OSHA Consultation Division (OSHA Consultation) continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and MCEPS hereby renew the Alliance signed on September 9, 2007 and last renewed June 18, 2020 with a continued emphasis on promoting worker awareness of industry-related hazards and solutions in the exploration and production of oil and gas. Specifically, OSHA, MCEPS, and OSHA Consultation are committed to improving worksite operations and reducing work-related injuries, and fatalities by providing members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address work-related injuries, and fatalities.
This renewal agreement provides a framework and objectives for the Alliance's activities. Alliance participants will summarize specific activities and timeframes for completion in a written work plan.
Through the Alliance, the organizations will use relevant injury, illness, and hazard exposure data when appropriate to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options to evaluate the effectiveness of the Alliance and measure the impact of its overall effort on improving workplace safety for employers and workers. In renewing this Alliance, OSHA, MCEPS, and OSHA Consultation recognize that OSHA's State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.
Raising Awareness of OSHA's Rulemaking and Enforcement Initiatives
The Participants intend to work together to achieve the following goals related to raising awareness of OSHA's rulemaking and enforcement initiatives:
- To share information on OSHA's National/Regional/Local Emphasis Programs, Regulatory Agenda, and opportunities to participate in the rulemaking process.
- To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
- To convene or participate in forums, roundtable discussions, or stakeholder meetings on safety and health issues to help forge innovative solutions in the workplace or to provide input on safety and health issues.
- To encourage worker participation in workplace safety and health by Alliance members incorporating such opportunities into company worksite safety and health management programs.
Training and Education
The Participants intend to work together to achieve the following training and education objectives:
- To develop effective training and education programs for MCEPS monthly industry meetings regarding topics relevant to issues of current safety and health concern to the oil and gas Industry, and to communicate such information to constituent employers and workers.
- To develop effective training and education programs for Alliance members to promote understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.
- To deliver or arrange for the delivery of training opportunities offered by industry recognized/accredited resources, organizations or providers such as ETC, IADC, PEC, OSHA, and OIPA.
Outreach and Communication
The Participants intend to work together to achieve the following outreach and communication objectives:
- To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA's and the MCEPS, and OSHA Consultation's Web sites) to employers and workers in the industry.
- To speak, exhibit, or appear at OSHA's or Oil and gas Industry conferences, local meetings, or other events.
- To share information among OSHA personnel and industry safety and health professionals regarding good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by MCEPS or Alliance members.
- To work with other Alliance participants on specific issues and projects on the oil and gas Industry that are addressed and developed through the Alliance Program.
- To develop and disseminate case studies on accident investigations or near misses in the oil and gas Industry and publicize their results.
OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.
An implementation team made up of representatives of each organization will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Oklahoma City Area Office and any other appropriate offices. OSHA will encourage OSHA On-site Consultation Projects' participation on the team.
This agreement will remain in effect for three years. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the written concurrence of all signatories.

Since entering into an Alliance on September 9, 2004, with subsequent renewal(s) on August 24, 2006, October 27, 2008, September 20, 2011, February 12, 2014, March 9, 2017, and March 18, 2019, the U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) – Puerto Rico Area Office, the Puerto Rico Department of Labor and Human Resources – Puerto Rico Occupational Safety and Health Administration (PR OSHA) and the College of Engineers and Land Surveyors of PR (CIAPR, in English) have worked together to improve workplace health and safety by sharing information, guidance, and access to training resources that address occupational hazards, and promoting understanding of the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act.
OSHA, PR OSHA, and CIAPR continue to recognize the value of maintaining a collaborative relationship to improve safety and health practices and programs in American workplaces, and commit to continue their work together through an Alliance Program Ambassador relationship.
In recognition of this ongoing commitment, OSHA will continue to foster an active relationship with CIAPR and PR OSHA by:
- Providing routine communications on enforcement, regulatory, and outreach initiatives.
- Sharing invitations to and offering opportunities to speak at OSHA Alliance Program and other agency stakeholder meetings or events, such as outreach and training activities through the National, Regional, or Area Office, and the National Alliance Program Construction Roundtable and Forum.
- Engaging in information sharing and technical discussions, as appropriate, including completing special projects of mutual interest that align with agency priorities and as resources allow.
- Maintaining the organization's status as Alliance Program Ambassador on the agency's public webpage.
CIAPR and PR OSHA will continue to foster an active relationship with OSHA by:
- Sharing information with members and stakeholders on OSHA's National Initiatives (Enforcement, Regulatory, and Outreach), and encouraging their participation in OSHA’s outreach initiatives and rulemaking processes.
- Sharing information with members and stakeholders on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
- Encouraging CIAPR to build relationships with OSHA's National, Regional and Area Offices to address health and safety issues.
- Sharing information with OSHA and PR OSHA personnel and industry safety and health professionals regarding CIAPR good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).
- Offering OSHA and PR OSHA opportunities to speak, exhibit, or appear at one another's conferences, local meetings, or other CIAPR events.
- Adhering to requirements laid out in the Alliance Program Directive regarding the prohibition on promoting or implying the agency's endorsement of their policies, products, or services, including acknowledging that they will not receive any preferential treatment related to any statutory function of the agency.
- Abiding by all terms and conditions for the use of the Alliance Program logo as specified in OSHA's Guidelines for Use of the Alliance Logo.
OSHA's cooperative programs provide organizations an opportunity to participate in a voluntary, collaborative relationship with OSHA for purposes such as raising awareness of OSHA's initiatives, outreach, communication, training, and education. These programs have proven to be valuable tools for both OSHA and participants. By entering into this Ambassador relationship, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization's products or services.

Since entering into an Alliance on January 22, 2004, with subsequent renewal(s) on April 3, 2006, April 15, 2008, September 30, 2010, December 18, 2012, December 17, 2014, February 28, 2017 and March 29, 2019, the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Puerto Rico Area Office, the Puerto Rico Occupational Safety and Health Administration (PROSHA), and the Rio Piedras Campus of the University of Puerto Rico, through the Division of Continued Education and Professional Studies (DECEP, in Spanish), the Environmental Protection and Occupational Safety Office (OPASO, in Spanish) and the Institute of Labor Relationships (IRT, in Spanish) from the Faculty of Social Sciences, have worked together to improve workplace health and safety by sharing information, guidance, and access to training resources that address occupational hazards, and promoting understanding of the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act.

SOUTH DAKOTA ONE-CALL NOTIFICATION BOARD
The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA), the South Dakota State University Engineering Extension Program and the South Dakota One-Call Notification Board (SD One-Call) continue to recognize the value of maintaining a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and SDSU Engineering Extension and SD One-Call hereby renew the Alliance signed February 19, 2021, with a continued emphasis on trench and excavation activities. Specifically, excavation safety practices and education activities targeting trench/excavation contractors throughout the state. Each organization is committed to providing their members and the public with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address hazards associated with trench excavation activities.
This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the requirements for program participation laid out in the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects."
Through the Alliance, the organizations will use relevant injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In renewing this Alliance, OSHA and SDSU Engineering Extension and SD One-Call recognize that OSHA's On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.
Raising Awareness: Outreach and Communication
The Participants intend to work together to achieve the following objectives:
Share information on OSHA's National/Regional/Local Initiatives (Emphasis Programs, Regulatory Agenda, Outreach), and opportunities to participate in initiatives and the rulemaking process.

Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers particularly through Spring Damage Prevention Meetings.

Develop information on the recognition and prevention of workplace hazards and communicate such information in conjunction with the SD One-Call Certification Program to employers and workers in the industry.

Speak, exhibit, or appear at OSHA and SD One-Call conferences, local meetings, or other events.

Convene or participate in forums, roundtable discussions, or stakeholder meetings on excavation and trench safety to help forge innovative solutions in the workplace or to provide input on safety and health issues particularly through Spring Damage Prevention Meetings.

Share information among OSHA personnel and industry safety and health professionals regarding SD One-Call's good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).

Encourage worker participation in workplace safety and health through the Spring Damage Prevention Meetings and the SD One-Call Certification Program.

Collaborate with other Alliance participants on specific issues and projects on trench safety.

Share case studies on excavation mishaps and publicize their results via SD One-Call website.

Encourage SD One-Call's customers to build relationships with OSHA's Regional and Area Offices as well as SDSU Engineering Extension Program to address health and safety issues, including excavation safety.
Training and Education
The Participants intend to work together to achieve the following objectives:
Develop effective training and education programs for the excavation industry in South Dakota regarding Excavation Safety and to communicate such information to constituent employers and workers.

Deliver or arrange for the delivery of training products through presentations and outreach with affected stakeholders.

Develop effective training and education programs for excavators to promote understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.
OSHA's Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's initiatives, outreach, communication, training, and education. These Alliances have proved to be valuable tools for both OSHA and Alliance participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization's products or services.
An implementation team made up of representatives of each organization will meet one to two times per year to discuss the responsibilities of the participants, to share information on activities, and to track results in achieving the goals of the Alliance. OSHA team members will include representatives of the Directorate of Cooperative and State Programs and any other appropriate offices. OSHA will encourage OSHA On-Site Consultation programs' participation on the team.
This agreement will remain in effect for three years. Any signatory may terminate this agreement for any reason at any time, provided they give 30 days' written notice. This agreement may be modified at any time with the written concurrence of all signatories.
