The Office of Management and Budget (OMB) has reviewed the
collection of information requirements in the expanded Hazard
Communication Standard (HCS) in accordance with the Paperwork
Reduction Act. Except for the three collection of information
requirements in the HCS which were disapproved by OMB, the HCS will
become fully effective May 23, 1988, as scheduled in the rule. This
document reprints the text of the letter from OMB to the Department
of Labor explaining the OMB decision.

hearing proposes modifications to the Hazard Communication Standard,
published in the Federal Register on August 24, 1987 (52:31852),
including a determination made by the Office of Management and
Budget (OMB) under the Paperwork Reduction Act regarding the
information collection requirements of the final rule. OSHA is
inviting comment for sixty (60) days following publication of this
NPRM, and is scheduling a public hearing to provide an opportunity
for additional input.

On August 24, 1987, OSHA revised its Hazard Communication Standard
(HCS) (52:31852) to expand the scope of the industries covered by
the rule from the manufacturing section to all industries where
employees are exposed to hazardous chemicals. The revised rule
required the non- manufactoring sector of industry to be in full
compliance with its provisions May 23, 1988. The U.S. Court Appeals
for the Third Circuit, however, has stayed the rule with respect to
the construction industry.

adding a control number assigned by the Director of Office of
Management and Budget (OMB) after each section of the Code of
Federal Regulations in which the rule appears [1910.1200, 1915.99,
1917.28, 1918.90, and 1926.59]. This document reprints the OMB
letter to DOL on its review of information collection requirements
of the Hazard Communication Standard. These amendments are effective
December 4, 1987. The OMB approval expires May 23, 1988.

providing a sixty day start-up period, until December 6, 1988,

administrative stay of these provisions.

OSHA has decided to administratively stay paragraphs (m)(1)(i)
through (m)(4)(ii) of the Formaldehyde Standard for a period of nine
months. During this period, OSHA will propose to revoke these
paragraphs and to invite comments on the substitution of the full
Hazard Communication Standard (1910.1200) or other equally
protective alternatives. Pending completion of this rulemaking,
affected employers must continue to comply with the provisions of
the Hazard Communication Standard.
