AGREEMENT ESTABLISHING AN ALLIANCE BETWEEN THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION U.S. DEPARTMENT OF LABOR AND THE SCAFFOLD INDUSTRY ASSOCIATION, INC.


The Occupational Safety and Health Administration (OSHA) and the Scaffold Industry Association, Inc. (SIA) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA and SIA hereby form an Alliance to provide SIA's members, and others in the construction industry, with information, guidance, and access to training resources that will focus on reducing safety and health hazards associated with the use of mast climbing scaffolding and aerial lift equipment. In particular, the Alliance will address reducing and preventing exposure to fall and caught-in-between hazards. In developing this Alliance, OSHA and SIA recognize that OSHA's State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort.

OSHA and SIA will work together to achieve the following training and education goal:

  • Work with OSHA to provide expertise to develop training and education programs for the construction industry regarding mast climbing scaffolding and aerial lift issues and to provide expertise in communicating such information to employers and employees in the construction industry.

OSHA and SIA will work together to achieve the following outreach and communication goals:

  • Work with OSHA to provide expertise in developing information on the recognition and prevention of workplace hazards, and to provide expertise in developing ways of communicating such information (e.g., print and electronic media, electronic assistance tools and OSHA's and the SIA's Web sites) to employers and employees in the construction industry.
  • Speak, exhibit, or appear at OSHA's or SIA conferences, local meetings, or other events such as SIA's 36th Annual Convention & Exposition.
  • Share information among OSHA personnel and industry safety and health professionals regarding SIA's best practices or effective approaches and publicize results through outreach by SIA and through OSHA- or SIA-developed materials, training programs, workshops, seminars, and lectures (or any other applicable forum).
  • Promote and encourage SIA members' or worksites' participation in OSHA's cooperative programs such as compliance assistance, the Voluntary Protection Programs, and the On-site Consultation Program and its Safety and Health Achievement Recognition Program.
  • Work with other Alliance participants on specific issues and projects on mast climbing scaffolding and aerial lift issues that are addressed and developed through the Alliance Program.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. Team members will include representatives of OSHA's Directorate of Cooperative and State Programs, Directorate of Construction and any other appropriate offices. OSHA will encourage State Plan States' and OSHA On-site Consultation Projects' participation on the team.

This agreement will remain in effect for two years. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of all signatories.

Todd Briggs and Diane Hurns also spoke regularly to discuss and plan NAOSH Week-related activities such as the 2008 NAOSH Week Kick-off event at the Department of Labor (DOL).

        Safety Alert: Electrocution and Shock Hazards in Shipyard Employment

        ASSE representatives, along with other Alliance Program participants, the SCA, ASA, NSRP, and AIHA developed "Safety Alert: Electrocution and Shock Hazards in Shipyard Employment." The alert was finalized and posted to the SCA Web site and linked to from the OSHA and ASSE Alliance Program Web page in February 2008.

        OSHA continues to update the OSHA and ASSE Alliance Program Web page on the Agency's Web site. The page contains information on the Alliance's products and resources, including news releases, annual reports, activities and events, and milestones and successes.         ASSE and OSHA Alliance Program Web Page

        ASSE continues to update its ASSE and OSHA Alliance Program Web page on the Association's Web site. The page includes information on the Alliance and its activities and other OSHA compliance assistance resources such as QuickCards, fact sheets and public service announcements (PSAs) in English and Spanish.

        Safety and Health Topics Pages

        ASSE representatives serve on the editorial boards for the following Safety and Health Topics pages on the OSHA Web site: Making the Business Case for Safety and Health and Motor Vehicle Safety.

        Publications and Newsletters

        Information and news releases on the activities of the OSHA and ASSE Alliance have appeared in publications produced by OSHA, including the Agency's news releases and Alliance Quarterly Review (AQR). Information on the OSHA and ASSE Alliance has also been published in a number of safety and health print and electronic publications such as Occupational Hazards Magazine, ASSE Society Update, Professional Safety and Industry News. In addition, the ASSE newsletter, Government Affairs Update, is regularly distributed to the ASSE Chapter Chairs, OSHA, and others interested in government affairs and regulatory and legislative activities. The newsletter includes information on the Alliance Program and OSHA's activities. Please see the chart in this report under "Alliance Program Reach" for additional information.

        ASSE Professional Development Conference (PDC), Safety 2008, Las Vegas Convention Center, June 9-12, 2008, Las Vegas, Nevada

        During the ASSE 2008 PDC in Las Vegas, Nevada, a number of OSHA senior level staff spoke to the attendees during plenary and workshop sessions, including:

        • Edwin G. Foulke, Jr., then-Assistant Secretary, USDOL-OSHA, participated in the Plenary Session and addressed the key issues and concerns of safety, health, and environment professionals regarding the impact of the federal government on standards development and compliance assistance efforts. Mr. Foulke also participated in the "OSHA Business of Safety Roundtable" with a panel of safety, health, and environment professionals to discuss the business of safety and how OSHA sees its role in this area.

        Edwin G. Foulke, Jr., then-Assistant Secretary, USDOL-OSHA, attended the ASSE SPALW Annual Meeting on June 10, 2008. Lee Anne Jillings, then-Director, OOSA, DCSP, USDOL-OSHA, Diana Cortez, Area Director, Region II, Tarrytown, New York Area Office, USDOL-OSHA; and Todd Briggs, Program Analyst, OOSA, DCSP, USDOL-OSHA, also attended the SPALW meeting. During the meeting, OSHA staff provided information on the Agency's Hispanic-related compliance assistance and outreach activities and answered questions.

      • Work with other Alliance participants on specific issues and projects that are addressed and developed through the Alliance Program.

        2008 North American Occupational Safety and Health (NAOSH) Week Kick-off, May 5, 2008, Department of Labor, Washington, DC

        On May 5, 2008, Deputy Assistant Secretary Donald Shalhoub, USDOL-OSHA and ASSE then-President, Michael Thompson were the keynote speakers at the 2008 NAOSH Week kick-off event at the Department of Labor (DOL) in Washington, D.C. Sponsored annually by ASSE, and the Canadian Society of Safety Engineering, the Week focuses on the importance of preventing injuries and illnesses in the workplace. The theme for the 2008 NAOSH Week was "Safety is Good Business." The OSHA and ASSE Alliance, along with a number of other Alliance Program participants, supported the Week.

        ASSE National Capitol Chapter and AIHA Potomac Section Joint Chapter Meeting, March 27, 2008, Department of Labor, Washington, DC

        Through the OSHA and ASSE Alliance, OSHA hosted the ASSE National Capitol Chapter and AIHA Potomac Section Joint Chapter Meeting on March 27, 2008 at DOL in Washington, D.C. During the meeting, senior representatives from DCSP, DSG, then-DTSM, and DEP delivered an OSHA program update to the meeting attendees. Edwin G. Foulke, Jr., OSHA’s then-Assistant Secretary, also delivered an OSHA compliance assistance and cooperative program update to 101 people and answered questions.

        Designing for Construction Safety Slide Presentation

        John Mroszczyk, ASSE, and other Alliance Program participants such as representatives from the Construction Institute (CI) presented "Designing for Construction Safety 2-4 Hour Course" at a number of conferences and meetings, including:

        • May 15, 2008: 6th International Conference on Occupational Risk Prevention 2008, A Coruna, Spain.

        The course was developed by the Alliance Program Construction Roundtable Design for Safety Workgroup.

        Prevention of Fall Fatalities and Injuries Slide Presentation

        Through the Construction Roundtable Design for Safety and Fall Protection Workgroups, John Mroszczyk, ASSE, chaired a workgroup to develop "Prevention of Fall Fatalities and Injuries in Construction" slide presentation. The presentation was posted to the Design for Safety Web site and linked to from the OSHA Alliance Program Construction Roundtable Web page on the Agency’s Web site. OSHA is working with SPALW to translate the presentation into Spanish. Mr. Mroszczyk delivered the presentation at the following conference:

        • November 18, 2008: ASSE New England Chapter PDC, Worcester, Massachusetts.
      • Encourage ASSE's chapters to build relationships with OSHA's Regional and Area Offices to address health and safety issues.

        OSHA Regional/Area Office and ASSE Alliances

        The following OSHA Regional and Area Offices and ASSE Chapter Alliances have been signed and are ongoing:

        • Region IV, Ft. Lauderdale, Florida Area Office and the Gold Coast Chapter of American Society of Safety Engineers, signed August 7, 2008.

          Through the Alliance, the organizations are providing the teachers, students and staff with safety information, accident prevention guidance, and access to safety training resources that will help them protect the health and safety of teachers and students, particularly in reducing and preventing youth workers exposure to hazards in the workplace and industry training environments within the school system.

        • Region, IV, Birmingham and Mobile, Alabama Area Offices, the Alabama and Mississippi Chapters of ASSE, and the University of Alabama- Safe State Consultation Program, signed October 10, 2006

          Through the Alliance, the organizations are providing  career/technical education teachers, students, and others with information, guidance, and access to training resources that will help them protect the health and safety of career/technical education students and educators, particularly in reducing and preventing youth workers exposure to the prevalent work hazards in the workplace and school laboratory environment.

        • Region IV,Atlanta-East, Atlanta-West and Savannah Area Offices and the Georgia Chapter of ASSE, signed June 19, 2006

          Through the Alliance, OSHA and ASSE are working to provide career/technical education teachers, students and others with information, guidance and access to training resources that will help protect career/technical education students’ health and safety, particularly in reducing and preventing youth workers exposure to hazards in the construction industry, and general industry hazards. Through the Alliance, OSHA wrote the "OSHA Region IV Alliance Educates Students About Construction Hazards" success story focusing on the Alliance educating students about construction hazards. The success story was posted to the Regional and State Plan State Success Stories Web page on OSHA’s Web site in December 2007.

        • Region II, Avenel, Hasbrouck Heights, Marlton and Parsippany Area Offices and the Penn-Jersey Chapter of ASSE, signed April 26, 2006

          Through the Alliance, OSHA and ASSE are working to provide all young workers and non-English speaking Hispanic workers with information, guidance, and access to training resources that will help them protect workers’ safety and health, particularly in reducing and preventing exposure to work-related hazards such as chemical, electrical, falls, excavations, amputations and exposure to lead and silica.

        • Region I Concord Area Office and the Granite State Chapter of ASSE, signed March 28, 2005

          Through the Alliance, the organizations are helping to advance a culture of prevention while sharing best practices and technical knowledge, especially in the area of ergonomics and reducing musculoskeletal disorders, construction safety, and bloodborne pathogens.

        • Region II, Avenel, Hasbrouck Heights, Marlton, and Parsippany Area Offices and the New Jersey Chapter of the American Society of Safety Engineers, signed May 6, 2004.

          Through the Alliance, the organizations are providing non-English speaking Hispanic workers with information, guidance, and access to training resources that will help them protect workers’ safety and health, particularly in reducing and preventing exposure to work-related hazards such as chemical, electrical, falls, excavations, and amputations.

        • Region II Avenel, Bayside, Manhattan, and Tarrytown Area Offices and the New York Metropolitan Chapter of ASSE (Metro ASSE), signed March 10, 2004

          Through the Alliance, the organizations are providing non-English speaking Hispanic workers with information, guidance, and access to training resources that will help them protect workers’ safety and health, particularly in reducing and preventing exposure to work-related hazards such as chemical, electrical, falls, excavations, and amputations.

        • OSHA Region I and the New England Chapters of the American Society of Safety Engineers (NEA ASSE), signed December 2, 2003

          Through the Alliance the organizations are providing NEA ASSE members and others with information, guidance, and access to training resources to help them protect employees’ health and safety, particularly in reducing and preventing exposure to occupational safety hazards such as those associated with machinery operations, electrical equipment, lockout/tagout systems, confined spaces, powered industrial trucks and fall protection.

      Promoting the National Dialogue on Workplace Safety and Health Goals

      • Convene or participate in forums, roundtable discussions, or stakeholder meetings on safety and health issues to help forge innovative solutions in the workplace or to provide input on safety and health issues.

        Events

        OSHA Construction Roundtable Joint Design for Safety (DFS) and Fall Protection Workgroup

        Representatives from ASSE continue to participate in the Alliance Program Construction Roundtable Joint DFS and Fall Protection Workgroup meetings. The Workgroup is developing compliance assistance and training materials for employers and employees in the construction industry, including slide presentations, safety tips sheets, and case studies. The workgroup's activities include:

        • Developed "Prevention of Fall Fatalities and Injuries in Construction" slide presentation.
        • Updated the "Design for Safety" Web site.
        • Delivered "Designing for Construction Safety" and "Prevention of Fall Fatalities and Injuries in Construction" slide presentations at a number of conferences.
    2. Results

      During the sixth year of the OSHA and ASSE Alliance, OSHA and ASSE continued to help advance a culture of prevention while sharing best practices and technical knowledge.

      To meet the Alliance’s goals, OSHA and ASSE continued a number projects that were started in the Alliance’s fifth year and made presentations and exhibited at conferences to share information about the agreement, its goals and products.

      For example, on June 10, 2008, at the ASSE 2008 PDC in Las Vegas, Nevada, OSHA's then-Assistant Secretary Edwin G. Foulke, Jr. delivered a Plenary Session presentation focusing on the Agency’s compliance assistance and cooperative programs and the activities of the OSHA and ASSE Alliance. On June 10, Steven F. Witt, Director, DCSP, presented "Safety and Health Management Systems - A Comparison of US and Global Models." In addition, Richard Fairfax, Director, DEP, and Dorothy Dougherty, Director, DSG, presented "OSHA Current Activities Update."

      Further, OSHA had an exhibit booth in the exhibition hall and distributed copies of the Agency’s compliance assistance and cooperative program materials such as the OSHA and ASSE Alliance Activities Summary and answered the attendees’ questions.

      OSHA and ASSE also worked together to sponsor a 2008 NAOSH Week Kick-off event on May 5, 2008, at DOL in Washington, D.C. and have begun planning for the 2009 NAOSH Week Kick-off event to be held on May 4, 2009.

      In addition, ASSE representatives serve on the editorial boards of the OSHA Making the Business Case for Safety and Health and the Motor Vehicle Safety, Safety and Health Topics pages. ASSE representatives also continued to participate in the Alliance Program Construction Roundtable Joint DFS and Fall Protection Workgroup to help develop compliance assistance and training materials for employers and workers in the construction industry. John Mroszczyk, a member of the DFS Workgroup, presented "Prevention of Fall Fatalities and Injuries in Construction" and "Designing for Construction Safety" slide presentations at several conferences, including the 2008 ASSE PDC in Las Vegas, Nevada.

      Further, OSHA and ASSE worked with other Alliance Program participants, SCA, ASA, NSRP, and AIHA to develop safety alerts focusing on electrocution and shock hazards and control of hazardous energy (Lockout/Tagout) in shipyard employment.

      Lastly, Alliances between OSHA’s Area Offices and ASSE Chapters throughout the U.S. continue to provide the association’s members and others with information, guidance, and access to training resources that will help them protect employees’ health and safety through outreach, education, and training.

  4. Upcoming Milestones

    During the upcoming year, OSHA and ASSE will continue to work together through the Alliance to provide employers, employees, OSHA staff, and the public with safety and health information. For example, during the ASSE PDC, Safety 2009, June 28 - July 1, in San Antonio, Texas, a number of senior level OSHA staff from OSHA's National and Regional Offices and Alliance Program participants are planning to speak during workshop sessions including:

      • A representative from the Office of the Assistant Secretary will be invited to present during an occupational safety and health panel plenary discussion.
      • Richard Fairfax, Director, DEP; Dorothy Dougherty, Director, DSG; and Steven Witt, Director, DCSP, will present "OSHA Current Activities Update."
      • A representative from DOC will present "OSHA Construction Update."
      • Steven Witt, Director, DCSP, will present "Small Businesses Leverage Resources to Create Effective Safety and Health Programs.
      • James Boom, Safety and Occupational Health Specialist, DCSP, will present "OSHA Challenge: Your Roadmap to Safety and Health Excellence."
      • John W. Mroszczyk, ASSE, will present, "The Future of the Safety Engineering Profession in the United States"

    OSHA representatives will staff an exhibit booth during the conference and distribute copies of the Agency’s compliance assistance and cooperative program materials, including the OSHA and ASSE Alliance Activities Summary and answer the attendees' questions. During the conference, representatives from OSHA will also deliver an update on the Agency’s Hispanic outreach activities at the ASSE SPALW Annual Workgroup meeting. SPALW is also working with OSHA to translate Alliance Program developed products (developed in cooperation with ASSE) into Spanish, including the "Prevention of Fall Fatalities and Injuries in Construction" slide presentation.

    Further, ASSE representatives will continue to participate in the OSHA Alliance Program Construction Roundtable Joint DFS and Fall Protection Workgroup meetings to develop compliance assistance and training materials for employers and workers in the construction industry. John Mroszczyk, ASSE, is chairing a subgroup to develop safety tips sheets, toolbox talks, and slide presentations  focusing on strains and sprains in the workplace, ASSE representatives will also continue to serve on the editorial boards of the Agency’s Making the Business Case for Safety and Health and the Motor Vehicle Safety, Safety and Health Topics pages.

    The OSHA and ASSE Alliance is working with more than 35 other Alliance Program participants to promote and support 2009 NAOSH Week, May 3-9, 2009. The theme for the Week is "Safety Means Always Coming Home." ASSE will host a number of events to commemorate the Week, including a reception at the U.S. Capitol on May 5 to recognize the winners of the ASSE Kids’ "Safety on the Job" poster contest. In addition, the OSHA maritime industry-related Alliances, SCA, ASA, and NSRP, and AIHA, will continue to work with ASSE to develop safety alerts focusing on maritime-related safety and health issues, including welding/hotwork and hearing conservation.  

    OSHA Regional/Area Offices will continue to sign Alliances with ASSE Chapters, including the Wisconsin Chapter and Greater Baton Rouge, Louisiana Chapters of ASSE in 2009.

    Finally, through the Alliance, OSHA will host the ASSE National Capitol Chapter and AIHA Potomac Section Joint Chapter meeting at DOL on March 12, 2009, in Washington, DC. Senior level staff from DOC, DCSP, DTSEM, DSG, DEP, the Office of Communications, and the Office of the Assistant Secretary will be invited to deliver presentations focusing on the Agency’s compliance assistance, cooperative program, and enforcement-related activities. Dave Heidorn and David Hicks, AIHA, will also deliver updates on the ASSE and AIHA Alliances

In addition, the NTSP added links to a number of OSHA’s safety and health resources such as OSHA’s Ergonomics: Solutions for Electrical Contractors eTool. Recently, NTSP added an "Office Lighting" presentation first given as a Webcast on November 19, 2008 that OSHA staff attended.

      2008 International Telecommunications Safety Conference, Park City, Utah, September 9-11, 2008

      On September 9, 2008, Edwin G. Foulke, Jr., former-Assistant Secretary (posting request has been sent), USDOL-OSHA, gave the keynote address at the 2008 International Telecommunications Safety Conference in Park City, Utah.

      On September 10, 2008, Brett Besser, Ergonomist, SLTC, DTSEM, USDOL-OSHA, gave a presentation "OSHA Update, Computer Work Stations and Editorial Boards," to 55 attendees.

      On September 10, 2008, Dan Crane, Lead Physical Scientist, SLTC, DTSEM, USDOL-OSHA, gave a presentation on material failure issues in the telecommunications industry to 55 attendees.

      In addition, on September 11, 2008, Frank Bannister, Ergonomist, Sprint Nextel and member of the OSHA and NTSP Alliance Implementation Team, gave a presentation entitled "NTSP Ergonomics Committee and OSHA and NTSP Ergonomics Alliance Update."

      • Share information addressing ergonomics among OSHA personnel and industry safety and health professionals regarding NTSP’s best practices or effective approaches and publicize results through outreach by NTSP and OSHA and through OSHA- or NTSP-developed materials, training programs, workshops, seminars, and lectures (or any other applicable forum).

      Web Cast Seminar "Office Lighting"

      Through the Alliance, NTSP invited OSHA staff to participate in a Web Cast Seminar entitled "Office Lighting." The seminar was given by Kathleen Turner, Ergonomist, AT&T, and Alliance Implementation Team member, on November 19, 2008. OSHA staff participating in the Seminar included Brett Besser and Joanna Sznajder, both Implementation Team members. The presentation is currently posted on the NSTP Web site.

      Office Lighting Fact Sheet

      Through the Alliance, NTSP developed a draft Office Lighting Fact Sheet to help companies and individuals identify and correct the ergonomic or safety and health aspects of office lighting. The final draft of the Fact Sheet is in the OSHA vetting process and, once finalized, will be posted on the NTSP Web site and linked to from the OSHA and NTSP Alliance Web page on the Agency’s Web site.

      2008 North American Occupational Safety and Health (NAOSH) Week May 4-9, 2008

      On May 5, 2008, Deputy Assistant Secretary Donald Shalhoub, USDOL-OSHA spoke to OSHA staff, Alliance Program participants and other safety and health professionals during the 2008 North American Occupational Safety and Health (NAOSH) Week kick-off event at the U.S. Department of Labor in Washington, D.C. Sponsored annually by the American Society of Safety Engineers (ASSE), an Alliance Program participant, and the Canadian Society of Safety Engineering, the Week focuses on the importance of preventing injuries and illnesses in the workplace. The theme for the 2008 NAOSH Week was "Safety is Good Business." The OSHA and NTSP Alliance, along with a number of other Alliance Program participants, supported the Week.

      Stakeholder Meeting with the National Association of Tower Erectors (NATE) January 23, 2009

      Through the Alliance, OSHA was able to arrange a meeting between NTSP and NATE to discuss a number of topics of interest to both groups including:

      • Cooperative outreach activities
      • Addressing sub-contractor issues including identification of qualified sub-contractors
      • Educational and speaking opportunities

      In addition, NTSP and NATE exchanged invitations to have speakers address their respective groups.

      Promoting the National Dialogue on Workplace Safety and Health Goals

      • Develop and disseminate case studies illustrating the business value of ergonomics and publicize their results.

        During this reporting period, OSHA and NTSP did not work on projects to address this goal.

    2. Executive Summary

      During the reporting period, OSHA and NTSP Alliance have continued to work together through the Alliance to address ergonomic issues in the telecommunications industry by developing information, guidance and access to training resources.

      Through the Alliance, OSHA and NTSP shared information through speaking opportunities. For example, at the 2008 International Telecommunications Safety Conference in Park City, Utah:

    OSHA and NTSP will work together to complete work on the Fact Sheet "Office Lighting" which will be posted to the NTSP Web site and linked to from the OSHA and NTSP Alliance Web page on the Agency Web site.

    The group will begin developing telecommunications-related safety and health Fact Sheets addressing issues in the industry including:

    • Retail sales
    • Shoveling

    In addition, OSHA and NTSP representatives will promote the OSHA and NTSP Alliance and discuss ergonomic issues through speeches at meetings, such as NTSP’s 2009 International Telecommunications Safety Conference in September 2009. The NTSP will work with NATE to exchange safety and health information including the possibility of providing speakers to each others conferences in 2009.

    In addition, the NTSP is planning on offering future Webcasts on various safety and health-related topics including powered industrial trucks. OSHA staff nationwide and Alliance Program participants will be invited to participate in future NTSP Webcast seminars.

    Further, as part of the OSHA and NTSP’s Alliance’s ongoing activities NTSP will support the 2009 NAOSH Week along with a number of other Alliance Program participants.

    In the upcoming year, the OSHA and NTSP Alliance will continue to maintain and update the OSHA and NTSP Alliance Web page on OSHA’s Web site and NTSP’s Ergonomics Web page on its Web site.

    Finally, an OSHA and NTSP Alliance implementation team member will continue to serve on the editorial board for OSHA’s eTool, Ergonomics: Solutions for the Electrical Contractors, and provide OSHA with input and expertise to keep the eTool up to date.

OSHA and Shipbuilders Council of America (SCA) Alliance
Close-out Report

On January 31, 2003, OSHA and SCA formed an Alliance to use their collective expertise to advance a culture of injury and illness prevention while sharing best practices and technical knowledge in the areas of shipbuilding and ship repair practices. The Alliance particularly focused on reducing and preventing exposure to shipyard safety and health hazards such as electrical, welding/hotwork, and ergonomics, and in promoting hearing conservation. The Alliance was renewed on February 8, 2007 and March 6, 2009.

Because OSHA is working with SCA, the American Shipbuilders Association (ASA), the National Shipbuilding Research Program (NSRP), and the Shipbuilders Council of America (SCA) to sign one shipbuilding group Alliance that will address the same goals and topic areas, the organizations agreed to conclude the Alliance as of September 13, 2010. A number of successes resulted from the Alliance, including:

  • SCA worked with ASA, NSRP, American Industrial Hygiene Association, and the American Society of Safety Engineers to develop a series of safety alerts focusing on safety issues in shipyard employment:
    • Safety Alert: Control of Hazardous Energy - Lockout/Tagout Procedures in Shipyard Employment
    • Safety Alert: Electrocution and Shock Hazards in Shipyard Employment
    • Safety Alert: Welding and Other Hot Work Procedures in Shipyard Employment
    • Safety Alert: Ventilation Procedures in Shipyard Employment
  • SCA reviewed and provided feedback on a number of OSHA-developed products, including a Safety and Health Information Prevention Sheet focusing on rigging and "Tool Box Talks: Hearing Conservation in the Shipbuilding Industry."
  • SCA reviewed and provided feedback on the confined space flashpoint outreach document developed by the OSHA and the Gulf Coast Maritime Safety Association Alliance in Region IV.
  • SCA representatives serve on the Editorial Board for the OSHA Maritime Industry and Shipbuilding and Ship Repair Safety and Health Topics page's and the Shipyard Employment eTool. The pages received 43,646 visits in Fiscal Year 2008.
  • SCA supported North American Occupational Safety and Health Week in 2008 and 2009.
  • OSHA representatives were invited by SCA to deliver maritime safety and health-related presentations at the SCA Spring and Fall Health and Safety Seminars in 2008, 2009, and 2010.
  • OSHA and SCA representatives presented "Maritime Industry Safety and Health Products and Information" at the National Safety Council Congress and Expo on October 27, 2009, in Orlando, Florida.

      OSHA is continuing to update the OSHA and IEC Web page that is posted on the Agency's Web site. The page includes the OSHA and IEC Alliance agreement, renewal agreements, news releases, activities and events and milestones and successes.

      IEC continues to update the Safety-related links page on its Web page. It includes information about the OSHA and IEC Alliance and links to OSHA's Web site, including the Ergonomic eTool: Solutions for Electrical Contractors, Spanish Compliance Assistance Resources Web page, and Compliance Assistance Quick Start: Construction. In addition, the safety-related links page features the Fall Protection Safety Tips Sheets for Employers and Employees, which was developed through the OSHA Alliance Program Construction Roundtable's Fall Protection Workgroup on which IEC representatives participated.

      IEC National Legislative Conference, April 24-26, 2007, Washington, DC

      On April 24, 2007, Bob Isiminger, Office of Engineering Safety, Directorate of Standards and Guidance, USDOL-OSHA, provided an OSHA Electrical Standards Update to 10 attendees at the IEC Safety Committee meeting which was held during the IEC National Legislative Conference.

      IEC 49th National Convention and Electric Expo, September 27-30, 2006, Denver, Colorado

      Erv Krueger, Labor Liaison, Regional Office, Region VIII, USDOL-OSHA staffed the IEC and OSHA Alliance exhibit booth at the 49th Annual IEC National Convention and Electric Expo, September 27-30, 2006 in Denver, Colorado. The Alliance Program booth was next to IEC's exhibit booth in the Expo's Safety Zone. The Safety Zone displayed a banner developed by the OSHA and IEC Alliance, that read, "IEC/OSHA Alliance: Excellence in Job Safety and Health Programs."

      During the Expo, four OSHA Region VIII representatives attended the Basic Safety Training Classes on topics such as fall protection and arc flash.

      • Share information among OSHA personnel and industry safety and health professionals regarding best practices or effective approaches and publicize results through outreach by IEC and through OSHA- or IEC-developed materials, training programs, workshops, seminars, and lectures (or any other applicable forum).

      29 CFR 1910 Subpart S-Electrical Standard Training Program

      IEC continued to deliver the slide presentation that was developed through the OSHA and IEC Alliance regarding the updates made to 29 CFR 1910 Subpart S-Electrical Standard. The presentation focuses on topics such as hot work and arc flash. During the reporting period, the presentation and was delivered to more than 643 people during several training sessions at IEC member and non-member companies.

      • Promote and encourage IEC members' participation in OSHA's cooperative programs such as compliance assistance, the Voluntary Protection Programs, Consultation and its Safety and Health Achievement Recognition Program.

      OSHA's Voluntary Protection Program Challenge Program Administrator

      IEC continues to participate as a Challenge Program Administrator. Five IEC members continue to participate in OSHA's Voluntary Protection Program Challenge program.

      Informational Packets

      IEC created a packet of information on OSHA's cooperative programs and compliance assistance resources, including the OSHA and IEC Alliance Activities Summary and the Small Business Handbook. IEC distributed the packets to both potential and new IEC members.

      • Work with other Alliance participants on specific issues and projects regarding falls, rear-end auto collisions, and material-handling hazards that are addressed and developed through the Alliance Program.

      OSHA Alliance Program Construction Roundtable, Fall Protection and Design for Safety Workgroups

      IEC is continuing to participate in the Design for Safety and Fall Protection Workgroups that were created at the Alliance Program's Construction Roundtable on July 8, 2004.

      Design for Safety Workgroup - Through its participation on the Workgroup, during the reporting period IEC helped develop a 2-4 Hour Design for Safety Training Course. The course is based on the Design for Construction Safety slide presentation and provides technical information for those that are interested learning more about designing for safety. Mr. Masarick attended the Workgroup meeting on February 21, 2007.

      Fall Protection Workgroup - Through its participation on the Workgroup, during the reporting period IEC helped develop the Fall Hazard Awareness for the Construction Industry training program. The program is designed for construction industry audiences, including small business owners, trainers, foreman and workers. In addition, the Workgroup is developing toolbox talks for ladders that address topics such as Do's and Don'ts of Using a Ladder, Choosing the Right Ladder and Set-Up and Use of a Ladder. John Masarick, Director of Codes, Standards and Safety, IEC, attended the Workgroup meeting on March 15, 2007.

      OSHA Small Business Roundtable, February 1, 2007, Washington, DC

      On February 1, 2007, John Masarick, Director of Codes, Standards and Safety, IEC, and representatives from five Alliances, OSHA and the On-site Consultation Program participated in the OSHA Small Business Roundtable. During the meeting, the Alliance Program participants were updated on the status of the recommendations to enhance small business compliance assistance activities and resources that they provided during the September 8, 2005 Roundtable meeting. The Roundtable also reviewed new training resources that were developed by the Florida On-site Consultation Program and OSHA Training Institute.

      2007 North American Occupational Safety and Health Week (NAOSH), May 6-12, 2007

      IEC joined with a number of other Alliance Program participants and OSHA to support 2007 NAOSH Week, May 6-12, 2007. Sponsored annually by the American Society of Safety Engineers (ASSE), an Alliance Program participant, and the Canadian Society of Safety Engineering, the Week focuses on the importance of preventing injuries and illnesses in the workplace. In support of NAOSH Week, IEC printed articles about NIOSH Week in IEC Connection, IEC Insights, and IEC Codes and Safety Newsletter. In addition, IEC sent e-mail messages to its chapter executives and distributed NIOSH posters to the chapters.

      • Encourage IEC's chapters' to build relationships with OSHA's Regional and Area Offices to address health and safety issues, including, falls, rear-end auto collisions, and material-handling hazards.

      Regional Alliances

      The following OSHA Regional and Area Offices and IEC Chapter Alliances were signed before the current reporting period and are ongoing:

      OSHA Region V Cincinnati, Ohio Area Office and the IEC of Greater Cincinnati Alliance, signed an Alliance May 18, 2006

      • OSHA and IEC of Greater Cincinnati are using their collective expertise to help protect employees' health and safety, particularly in reducing and preventing exposure to electrical hazards.

      OSHA Region VI Dallas, Texas Area Office and the IEC Dallas Chapter Alliance, signed July 19, 2005

      • OSHA and IEC Dallas Chapter are providing IEC employees and others with information, guidance, and access to training resources in order to help protect employees' health and safety, particularly in reducing and preventing exposure to electrical, fall, confined space entry, toxic substance(s), and struck-by hazards.

      State of Maryland, Department of Labor, Licensing and Regulation, Maryland Occupational Safety and Health and the IEC Chesapeake Chapter Alliance, signed on July 8, 2004.

      • Maryland OSHA and IEC Chesapeake Chapter are using their collective expertise to help protect employees' health and safety, particularly in reducing and preventing exposure to electrical hazards.
    2. Executive Summary

      Through the Alliance Program, OSHA and IEC are continuing to work together to develop products and resources to protect electrical contractors employees from exposure to falls, rear-end auto collisions and material-handling hazards. This positive relationship has led to the development of the many programs and projects that the team is currently working on or has produced. For example:

      • IEC delivered the slide presentation regarding the updates made to 29 CFR 1910 Subpart S-Electrical Standard that was developed through the OSHA and IEC Alliance to more than 643 people during several training sessions.
      • IEC representatives continue to serve on the Design for Safety and Fall Protection Workgroups that were created at the July 8, 2004 OSHA Alliance Program Construction Roundtable meeting.
      • IEC joined with other Alliance Program participants and OSHA to support 2007 NAOSH Week.
      • IEC promoted the activities of the OSHA and IEC Alliance and OSHA's compliance assistance resources and cooperative programs through articles in its publications Insights magazine, Connection and Codes & Safety. The articles focused on a number of topics such as fleet safety.
      • The association's chapters are continuing to recognize the value of working together with OSHA through the Alliance Program and are implementing agreements with OSHA's Regions and Area Offices and State Plan States addressing a number of safety and health issues and hazards, including electrical, fall, confined space entry, toxic substance(s), and struck-by hazards.

      Based upon the ongoing successes realized through the OSHA and IEC agreed to continue the Alliance and signed a renewal Alliance agreement on October 30, 2006.

  4. Upcoming Milestones

    The OSHA and IEC Alliance Implementation Team has discussed a number of activities that will be undertaken in the upcoming year.

    Through the Alliance, the OSHA and IEC Alliance implementation team plans to develop the following compliance assistance resources, with input and participation from industry and OSHA representatives:

    • Hot Work Programs for Industrial/Commercial and Residential Sites
    • CFR 29 1910 Subpart S Fact Sheet
    • Fleet Safety Written Program
    • Quick Card for Vehicle Safety
    • Personal Protective Equipment (PPE) Matrix

    In addition, IEC will continue to attend meetings of the Alliance Program Construction Roundtable's Design for Safety and Fall Protection Workgroups. IEC representatives will also continue to serve on OSHA's Electrical and Electrical Contractors Safety and Health Topics pages' and Ergonomic eTool: Solutions for Electrical Contractors' editorial boards and will review and provide comments on the resources.

    IEC will continue to promote OSHA compliance assistance materials and cooperative programs and the OSHA and IEC Alliance through the IEC Web site and articles in its monthly publication Insights and its eNewsletters, Connection and Safety and Codes. Further, IEC will include OSHA publications and the OSHA and IEC Alliance Activities Summary in membership packets for new members. Finally, OSHA will promote the products the Alliance produces in the Alliance Quarterly Review.

AGREEMENT RENEWING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
AND
THE JOINT COMMISSION AND JOINT COMMISSION RESOURCES, INC.


The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA), The Joint Commission (TJC), and Joint Commission Resources, Inc. (JCR) continue to recognize the value of maintaining a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA, TJC, and JCR hereby renew in part the Alliance signed July 27, 2004, and renewed November 8, 2006, January 14, 2009, and August 21, 2013, with a continued emphasis on reducing and preventing exposures to healthcare industry hazards. Specifically, OSHA, TJC, and JCR are committed to providing TJC-accredited healthcare organizations and other healthcare industry stakeholders with information, guidance, and access to resources that will help them protect the health and safety of workers, and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act. Through the Alliance, the organizations will continue to address ergonomic hazards from lifting and repetitive tasks; workplace violence; bloodborne pathogens; tuberculosis; slips, trips, and falls; and other healthcare industry hazards, as appropriate.

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants will summarize specific activities and timeframes for completion in a written work plan.

Through the Alliance, the organizations will use relevant injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In renewing this Alliance, OSHA, TJC, and JCR recognize that OSHA's State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

The Participants intend to work together to achieve the following outreach and communication objectives:

  • Share information on OSHA's National Initiatives (Emphasis Programs, Regulatory Agenda, Outreach), and opportunities to participate in initiatives and the rulemaking process.
  • Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • Develop information on the recognition and prevention of workplace hazards, and communicate such information (e.g., via print and electronic media, including JCR's Environment of Care News and TJC's The Joint Commission Online e-newsletter; social media; and the OSHA, TJC, and JCR websites) to employers and workers in the healthcare industry.
  • Share information with OSHA personnel and healthcare industry safety and health professionals regarding good practices or effective approaches for safeguarding healthcare worker safety through training programs, workshops, seminars, webinars, and lectures (or any other applicable forum).
  • Speak, exhibit, or appear at OSHA, TJC, or JCR conferences, local meetings, or other events.
  • Convene or participate in forums, roundtable discussions, or stakeholder meetings on healthcare industry hazards to help forge innovative solutions in the workplace or to provide input on safety and health issues.

OSHA's Alliance Program provides organizations an opportunity to participate in a voluntary cooperative relationship with OSHA and has proven to be a valuable tool for both OSHA and Alliance Program participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization's products or services.

An implementation team made up of representatives of each organization will meet at least once per year to discuss the responsibilities of the participants, to share information on activities, and to track results in achieving the goals of the Alliance. OSHA team members will include representatives of the Directorate of Cooperative and State Programs, the Directorate of Enforcement Programs, the Directorate of Standards and Guidance, the Directorate of Technical Support and Emergency Management, and any other appropriate offices. OSHA will encourage State Plans' and OSHA On-Site Consultation programs' participation on the team.

This agreement will remain in effect for five years. Any signatory may terminate it for any reason at any time, provided that they give 30 days' written notice. This agreement may be modified at any time with the written concurrence of all signatories.

      Outreach and Communication Goals
       
      • Work with OSHA to provide expertise in developing information on the recognition and prevention of hearing loss caused by workplace hazards, and to provide expertise in developing ways of communicating such information (e.g. print and electronic media, electronic assistance tools, and OSHA's, NIOSH's and NHCA's Web sites) to employers and employees in affected industries.

      OSHA and NIOSH/NHCA Alliance Web Page

      OSHA updates the OSHA and NIOSH/NHCA Alliance Web page on the Agency's Web site with information about the Alliance and its activities, including news releases and activities and events. In addition, the page features links to resources developed by NIOSH/NHCA through the Alliance Program, including the "Hearing Protection-Emerging Trends: Individual Fit Testing" best practice guide and the "Toolbox Talks: Hearing Conservation in the Shipbuilding Industry."

      NHCA/OSHA Alliance Web Page

      NHCA updates the NIOSH/NHCA and OSHA Alliance Web page on the association's Web site. The page includes information about the Alliance and links to Alliance-developed products, including the "Hearing Protection-Emerging Trends: Individual Fit Testing" best practice guide and the "Toolbox Talks: Hearing Conservation in the Shipbuilding Industry."

      OSHA Safety and Health Topics Pages

      A representative from the NIOSH/NHCA Alliance is serving on the editorial board of OSHA's Noise and Hearing Conservation Safety and Health Topics page and Noise and Hearing Conservation eTool on the OSHA Web site.
       
      • Speak, exhibit, or appear at OSHA, NIOSH, or NHCA sponsored conferences, local meetings, or other events such as the annual NHCA conference.

      NHCA 35th Annual Conference, February 25-27, 2010, Orlando, Florida

      A NIOSH/NHCA Alliance representative staffed an Alliance Program exhibit booth at the NHCA 35th Annual Conference on February 25-27, 2010, in Orlando, Florida. Alliance representatives distributed Alliance-developed information on hearing loss prevention, including the "Hearing Protection-Emerging Trends: Individual Fit Testing" best practice guide and the "Toolbox Talks: Hearing Conservation in the Shipbuilding Industry." Deborah Gabry, Health Scientist, DTSEM, USDOL-OSHA, hosted a breakfast meeting with eight conference attendees and discussed future projects of the OSHA and NIOSH/NCHA Alliance. The theme for the conference was "Explore the World of Hearing Loss Prevention."
       
      • Share information among OSHA and NIOSH personnel and industry safety and health professionals regarding NHCA recommended best practices or effective approaches and publicize results through outreach by OSHA, NIOSH, and NHCA developed materials, training programs, workshops, seminars, and lectures (or any other applicable forum).

        The OSHA and NIOSH/NHCA Alliance Implementation Team started work on this project but have not completed any products or activities to address this goal.
      • Work with other Alliance participants on specific issues and projects that are addressed and developed through the Alliance Program.

      2010 North American Occupational Safety and Health (NAOSH) Week, May 2-8, 2010

      On May 2-8, 2010, the NIOSH/NHCA Alliance and a number of other Alliance Program participants supported 2010 NAOSH Week. Sponsored annually by the American Association of Safety Engineers (ASSE), an Alliance Program participant, and the Canadian Society of Safety Engineering (CSSE), the Week focuses on the importance of preventing injuries and illnesses in the workplace. The theme for 2010 was "Mission NAOSH 2010: Safe Workplaces."

      Promoting the National Dialogue on Workplace Safety and Health Goals
       
      • Convene or participate in forums, round table discussions, or stakeholder meetings on workplace hearing loss prevention issues to help forge innovative solutions in the workplace or to provide input on safety and health issues.

      OSHA Alliance Program Construction Roundtable Meeting, Department of Labor (DOL), July 29, 2010, Washington, DC

      On July 29, 2010, a NIOSH/NHCA Alliance representative participated in the OSHA Alliance Program Construction Roundtable meeting at DOL in Washington, D.C. During the meeting, Alliance Program participants discussed products developed through the Roundtable, including the Construction Workplace Design Solutions, and identified potential projects and compliance assistance resources to help address safety and health hazards in the construction industry, including noise.

      On February 17, 2011, NIOSH/NHCA Alliance representatives participated in the OSHA Alliance Program Construction Roundtable meeting at DOL in Washington, D.C. During the meeting, Alliance Program participants discussed products developed through the Roundtable, including the next series of draft Construction Workplace Design Solutions, and identified potential projects and compliance assistance resources to help address safety and health hazards in the construction industry, including noise.
    2. Results

      During the third year of the OSHA and NIOSH/NHCA cooperative agreement, the Alliance worked on a number of projects and activities to share information about reducing and preventing exposure to noise and chemical ototoxic agents. For example:

      A NIOSH/NHCA Alliance representative staffed an Alliance Program exhibit booth at the NHCA 35th Annual Conference on February 25-27, 2010, in Orlando, Florida. Deborah Gabry, Health Scientist, DTSEM, USDOL-OSHA, hosted a breakfast with eight conference attendees and discussed the future projects of the OSHA and NIOSH/NCHA Alliance.

      A NIOSH/NHCA Implementation Team representative also participated in the Alliance Program Construction Roundtable meetings and provided feedback on a number of products, including the Construction Workplace Design Solutions, safety tips sheets, slide presentations, a toolbox talk focusing on the prevention of strains and sprains in the construction industry. The group also identified potential projects and compliance assistance resources to help address safety and health hazards in the construction industry, including noise.

      Further, the OSHA and NIOSH/NHCA Alliance, along with a number of other Alliance Program participants supported and promoted 2010 NAOSH Week, "Mission NAOSH 2010: Safe Workplaces."

      Members of the Alliance implementation team are sharing their hearing protection expertise by serving on the editorial board of OSHA's Noise and Hearing Conservation Safety and Health Topics page and Noise and Hearing Conservation eTool on the Agency's Web site.

      Lastly, NHCA updated the NIOSH/NHCA and OSHA Alliance Web page on the association's Web site.   4. Upcoming Milestones

    In 2011, the OSHA and NIOSH/NHCA Alliance will continue to provide NHCA members and others, including young workers and small businesses, with information, guidance, and access to training resources that will help them protect employees' health and safety, particularly in reducing and preventing exposure to noise and chemical ototoxic agents. For example:

    The Alliance will work to develop an outreach product for employers and workers that address hearing protection labeling after the Environmental Protection Agency issues a final rule on this topic.

    NIOSH/NHCA representatives will staff an exhibit booth at the 36th Annual Hearing Conservation Conference on February 24-26, 2011, in Phoenix Marriott Mesa, Arizona. Copies of Alliance- developed products will be disseminated to the conference attendees.

    Further, OSHA and NIOSH/NHCA will work together to translate "Toolbox Talks: Hearing Conservation in the Shipbuilding Industry" into Spanish. In addition, NIOSH/NHCA team members will revise the toolbox talks for the construction industry. NIOSH/NHCA team members will also work with the Professional Landcare Network (PLANET), an Alliance Program participant, to revise the toolbox talks for the landcare services industry.

    A NIOSH/NHCA Alliance representative will continue to participate in the OSHA Alliance Program Construction Roundtable meetings to help address safety and health hazards in the construction industry, including noise.

    In addition, the NIOSH/NHCA Alliance will join with other Alliance Program participants to promote and support OSHA's initiative focusing on distracted driving and 2011 NAOSH Week, May 1-7, "Celebrating a Century of Safety."

    Finally, a representative from the NIOSH/NHCA Alliance will continue to share their hearing protection expertise by serving on the editorial board of OSHA's Noise and Hearing Conservation Safety and Health Topics page and Noise and Hearing Conservation eTool on the OSHA Web site.

AGREEMENT RENEWING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
AND
THE AMERICAN SOCIETY OF SAFETY ENGINEERS


The Occupational Safety and Health Administration (OSHA) and the American Society of Safety Engineers (ASSE) recognize the value of continuing a collaborative relationship to foster safer and more healthful American workplaces. OSHA and ASSE hereby renew the Alliance agreement signed on December 4, 2002 and renewed June 8, 2004 and June 12, 2006. Through the Alliance, OSHA and ASSE will continue to provide ASSE's members and others, including small businesses, with information, guidance, and access to training resources that will help them protect employees' health and safety, including non-English or limited English speaking and youth workers. In particular, the Alliance will focus on addressing ergonomic and motor vehicle safety issues and promoting the annual North American Occupational Safety and Health (NAOSH) Week. In renewing this Alliance, OSHA and ASSE recognize that OSHA's State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. Team members will include representatives of OSHA's Directorate of Cooperative and State Programs and any other appropriate offices. OSHA will encourage State Plan States' and OSHA On-site Consultation Projects' participation on the team.

This agreement will remain in effect for two years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of both signatories.
