Abstract:
Parts 1910, 1915, 1917, 1918, 1926, and 1928 are amended by revising
the Hazard Communication Standard, 1910.1200, and by adding 1915.99,
1917.28, 1918.90 and 1926.59 to contain the identical text of the
revised 1910.1200 including Appendices A, B, C, and D of 1910.1200.
This document expands the scope of the Hazard Communication Standard
to cover all employers with employees exposed to hazardous chemicals
in their workplaces. This regulation is effective September 23,
1987.

collection of information requirements in the expanded Hazard
Communication Standard (HCS) in accordance with the Paperwork
Reduction Act. Except for the three collection of information
requirements in the HCS which were disapproved by OMB, the HCS will
become fully effective May 23, 1988, as scheduled in the rule. This
document reprints the text of the letter from OMB to the Department
of Labor explaining the OMB decision.

hearing proposes modifications to the Hazard Communication Standard,
published in the Federal Register on August 24, 1987 (52:31852),
including a determination made by the Office of Management and
Budget (OMB) under the Paperwork Reduction Act regarding the
information collection requirements of the final rule. OSHA is
inviting comment for sixty (60) days following publication of this
NPRM, and is scheduling a public hearing to provide an opportunity
for additional input.

On August 24, 1987, OSHA revised its Hazard Communication Standard
(HCS) (52:31852) to expand the scope of the industries covered by
the rule from the manufacturing section to all industries where
employees are exposed to hazardous chemicals. The revised rule
required the non- manufactoring sector of industry to be in full
compliance with its provisions May 23, 1988. The U.S. Court Appeals
for the Third Circuit, however, has stayed the rule with respect to
the construction industry.

Management and Budget (OMB) after each section of the Code of
Federal Regulations in which the rule appears [1910.1200, 1915.99,

administrative actions, OSHA has not enforced the rule in the
construction industry, and has not enforced in any industry certain
requirements dealing with maintenance of MSDSs on multi-employer
worksites, coverage of consumer products, and coverage of drugs in
the non-manufacturing sector.
