The Occupational Safety and Health Administration Bismarck Area Office (OSHA) and the North Dakota Safety Council recognize the value of establishing an alliance and collaborative relationship to foster safer and more healthful American workplaces. OSHA and the North Dakota Safety Council hereby form an Alliance to share information with employers and employees regarding how to develop a culture of safety and build safer workplaces. Participants in this Alliance will summarize specific activities and timeframes for completion in a written work plan.
This Alliance will enhance employee health and safety throughout various industry sectors in North Dakota and will provide OSHA staff the opportunity to present key information to stakeholders throughout North Dakota. OSHA and the North Dakota Safety Council will focus on safety and health hazard identification and abatement techniques in the construction, general industry, grain, and oil and gas industries.
Raising Awareness of OSHA's Rulemaking and Emphasis Programs
The Participants intend to work together to achieve the following goals related to raising awareness of OSHA’s rulemaking and enforcement initiatives:
- To share information on OSHA’s Regulatory Agenda, and occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
- To share information on OSHA’s National/Regional/Local Emphasis Programs, with special attention to falls in construction, grain handling facilities, oil and gas industry, amputations in manufacturing, silica, automotive services, combustible dust, trenching and excavating, and workplace violence.
- To convene or participate in forums, roundtable discussions, or stakeholder meetings to increase hazard awareness and abatement options.
Training and Education
The Participants intend to work together to achieve the following training and education objectives:
- To work collaboratively on the delivery of workshops on pertinent hazards.
- To share information among OSHA personnel and industry safety and health professionals regarding best practices or effective approaches through training programs, workshops, seminars, and written materials on agreed upon topics with regard to workplace safety and health.
Outreach and Communication
The Participants intend to work together to achieve the following outreach and communication objectives:
- To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA’s and the North Dakota Safety Council’s website)
- To speak, exhibit, or appear at the North Dakota Safety Council’s conferences, local meetings or other events.
- To share information among OSHA personnel and industry safety and health professionals regarding best practices or effective approaches through training programs, workshops, seminars, and lectures developed by the participants.
OSHA’s Alliance will provide parties an opportunity to participate in a voluntary cooperative relationship for purposes such as training and education, outreach and communication and raising awareness of OSHA’s rulemaking and enforcement initiatives. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party’s products or services.
Representatives of both organizations will meet to develop a work plan, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least two times per year to track progress and share information on activities and results in achieving the goals of the Alliance.
This Alliance will remain in effect for a two year period. Any signatory may terminate it for any reason at any time, provided it gives 30-days written notice. This alliance may be modified at any time with the concurrence of all signatories. This instrument is neither a fiscal nor a funds obligation document. Any endeavor or transfer or anything of value involving reimbursement or contribution of funds between the parties to this will be handled in accordance with applicable laws, regulations, and procedures.

The Bismarck Area Office of the Occupational Safety and Health Administration and the Coalition of Trench Training Partners continue to recognize the value of establishing a collaborative relationship to foster safer and more healthful North Dakota workplaces. To that end, OSHA and the Coalition hereby renew the Alliance signed May 3, 2018, to provide North Dakota’s employers and workers with information, guidance and training resources that will assist them in implementing a robust systems approach to advancing the health and safety of employees within trenching and excavating in the construction industry and the energy services industry.
The overarching goal of this Alliance is to reduce the number of occupational exposures to physical and atmospheric hazards, which can result in injuries and fatalities. This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the requirements for program participation laid out in the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects."
Through the Alliance, the organizations will use injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In renewing this Alliance, OSHA and the Coalition recognize that OSHA’s State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.
The Coalition members will work together to achieve the following outreach and communication goals:
- Collaborate to develop and communicate training and education programs for the construction industry and the energy services industry that meets or exceeds the requirements for trenching and excavating in 29 CFR 1926 Subpart P.
- Collaborate to provide continual awareness to its members through presentations and printed media on the hazards associated with trenching and excavations.
- Collaborate with other governmental agencies and private entities to facilitate occupational and environmental health and safety presentations, training and resources at quarterly organizational meetings specifically related to trenching.
- Encourage worker participation of their members in workplace safety and health training through surveys and observations to measure the effectiveness of alliance activities and gaps that need to be addressed.
The Coalition members will provide feedback to OSHA quarterly on this partnership’s effectiveness by:
- Identifying the total number of employers they have trained and the total number of employees affected by their training.
- Identifying the number of employees that have been trained as competent persons for trenching and excavating.
- Identifying the number of onsite inspections/monitoring’s their organization have conducted regarding trenching and excavating and the most prevalent hazards identified. Company names will not be provided to OSHA, to ensure employer confidentiality.
OSHA will support the Coalition’s efforts in the area of training and education by providing the following as requested:
- Providing specific training to Coalitions inspectors and auditors on how to identify trenching hazards.
- Provide outreach activities and presentations to these organizations relating to trenching and excavating.
- Assist in providing information for the development of training materials, hazard warnings, and safety alerts for coalition members.
- Coordinate quarterly meetings to monitoring overall alliance progress.
The Alliance provides parties an opportunity to participate in a voluntary cooperative relationship with the Bismarck Area Office of OSHA for the purposes of training and education, outreach and communication, and promoting a dialogue on workplace safety and health.
The Alliance has proved to be a valuable tool for both OSHA and its participants. By entering into an Alliance, the Coalition does not endorse any of the participant’s products or services. Nor does the Coalition enter into an Alliance with the purpose of promoting a particular party’s products or services.
This agreement will remain in effect for two years. Any signatory may terminate it for any reason at any time, provided they give a 30 day written notice. This agreement may be modified at any time with the concurrence of all signatories.

This was accomplished by sharing information, guidance, and access to training resources that address occupational hazards, and promoting understanding of the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act.

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Region VIII Office, Englewood Area Office, and Denver Area Office; the Colorado (21d) On-Site Health & Safety Consultation Program; the Brewers Association; the Master Brewers Association of the Americas and the Colorado Brewers Guild continue to recognize the value of maintaining a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and the aforementioned organizations hereby renew the Alliance signed on March 8, 2019, with a continued emphasis on the safety and health of workers in the brewing industry. Specifically, each organization is committed to providing their members and others with information, guidance, and access to training resources that will help protect workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address reducing and preventing exposure to hazards during the brewing, storing, containerizing, handling and delivery of beer.
This agreement provides a framework and objectives for the Alliance’s activities. Alliance participants also agree to meet the requirements for program participation laid out in the “Fundamental Requirements for OSHA Alliance Program Participants” and the “Guidelines for OSHA’s Alliance Program Participants: Alliance Products and Other Alliance Projects.”
Through the Alliance, the organizations will use injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In renewing this Alliance, OSHA, the Colorado (21d) On-Site Health & Safety Consultation Program, the Brewers Association, the Master Brewers Association of the Americas, and the Colorado Brewers Guild recognize that OSHA’s State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.
Raising Awareness: Outreach and Communication
The Participants intend to work together to achieve the following objectives:

To share information on OSHA’s National/Regional/Local Emphasis Programs, Regulatory Agenda, and opportunities to participate in the rulemaking process.

To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
-
To convene or participate in forums, roundtable discussions, or stakeholder meetings in the brewery industry to help forge innovative solutions in the workplace or to provide input on safety and health issues such as permit-required confined space, lockout/tagout, powered industrial trucks, hazard communication, walking-working surfaces, personal protective equipment and electrical hazards.

To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and alliance member web sites) to employers and workers in the industry.

To speak, exhibit, or appear at OSHA’s or the Brewers Association’s, Master Brewers Association of the Americas’ and Colorado Brewers Guild’s conferences, local meetings, or other related events.

To share information among OSHA personnel and industry safety and health professionals regarding brewery industry best practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by the participants.

To work with brewery industry participants to encourage their members to develop site-specific safety and health programs using resources available from alliance participants.

To encourage members of the Brewers Association, Master Brewers Association of the Americas and Colorado Brewers Guild to participate in OSHA’s Safe + Sound Campaign with on-site safety and health promotional activities.

To encourage worker participation in workplace safety and health by continuing to offer workshops, presentations, webinars, and other training opportunities at brewing industry conferences and through sessions conducted by the Colorado (21d) On-Site Health & Safety Consultation Program.
Training and Education
The Participants intend to work together to achieve the following objectives:

To develop effective training and education programs for the brewing industry regarding common safety and health hazards associated with breweries and general information about OSHA standards, regulations, policies, and compliance assistance resources, and to communicate such information to constituent employers and workers.

To develop effective training and education programs for the brewing industry to promote understanding of workers’ rights, including the use of the OSHA complaint process, and the responsibilities of employers, and to communicate such information to workers and employers.
OSHA’s Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communication, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization’s products or services.
An implementation team made up of representatives of each organization will meet one to two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Denver Area Office and Englewood Area Office and any other appropriate offices. OSHA will encourage State Plans’ and OSHA On-Site Consultation programs’ participation on the team.
This agreement will remain in effect for a period of 2 years. Any signatory may terminate it for any reason at any time, provided they give 30 days’ written notice. This agreement may be modified at any time with the written concurrence of all signatories.

AGREEMENT ESTABLISHING AN ALLIANCE

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Sioux Falls Area Office, the South Dakota State University Engineering Extension Program and the South Dakota One-Call Notification Board recognize the value of establishing a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, they hereby form an Alliance to provide employers and employees conducting excavation work with information, guidance, and access to training resources that will help them protect workers by reducing and preventing exposure to hazards related to trenching activities, and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).
This agreement provides a framework and objectives for the Alliance’s activities. Alliance participants also agree to meet the “Fundamental Requirements for OSHA Alliance Program Participants” and the “Guidelines for OSHA’s Alliance Program Participants: Alliance Products and Other Alliance Projects.”
Through the Alliance, the organizations will use available injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. Raising Awareness: Outreach and Communication
The Participants intend to work together to achieve the following objectives:
- Share information on OSHA’s National/Regional/Local Initiatives (Emphasis Programs, Regulatory Agenda, Outreach), and opportunities to participate in initiatives and the rulemaking process.
- Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers particularly through Spring Damage Prevention Meetings.
- Develop information on the recognition and prevention of workplace hazards, and communicate such information in conjunction with the South Dakota 811 Certification Program to employers and workers in the industry.
- Speak, exhibit, or appear at OSHA and South Dakota 811 conferences, local meetings, or other events.
- Convene or participate in forums, roundtable discussions, or stakeholder meetings on excavation and trench safety to help forge innovative solutions in the workplace or to provide input on safety and health issues particularly through Spring Damage Prevention Meetings.
- Share information among OSHA personnel and industry safety and health professionals regarding South Dakota One-Call Notification Board’s good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).
- Encourage worker participation in workplace safety and health through the Spring Damage Prevention Meetings and the South Dakota 811 Certification Program.
- Collaborate with other Alliance participants on specific issues and projects on trench safety.
- Share case studies on excavation mishaps and publicize their results via South Dakota 811 website.
- Encourage South Dakota One-Call Notification Board’s customers to build relationships with OSHA’s Regional and Area Offices as well as SDSU Engineering Extension Program to address health and safety issues, including excavation safety.
Training and Education
The Participants intend to work together to achieve the following objective:
- Develop effective training and education programs for the excavation industry in South Dakota regarding Excavation Safety and to communicate such information to constituent employers and workers.
- Deliver or arrange for the delivery of courses.
- Develop effective training and education programs for excavators to promote understanding of workers’ rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.
OSHA’s Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communications, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. Entering into this agreement does not establish an expectation that SD One Call board members would provide expert testimony or otherwise routinely participate in OSHA litigation.
This agreement will remain in effect for two years. Either signatory may terminate it for any reason at any time, provided they give 30 days’ written notice. This agreement may be modified at any time with the written concurrence of all signatories.

La oficinas de área en Denver y Englewood de la Administración de Seguridad y Salud Ocupacional (OSHA) del Departamento de Trabajo de los Estados Unidos de América y el Consulado de México en Denver, Colorado en adelante denominados conjuntamente “los Participantes”;
RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores mexicanos en los Estados Unidos; y
RECONOCIENDO que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;
Se proponen establecer una Alianza para lograr lo siguiente:
Objetivo General
Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos y a otros en el estado Colorado información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de los Estados Unidos de América sobre los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).
Capacitación y Educación
Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Colorado sobre la seguridad y la salud en el lugar de trabajo.
-
Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Colorado a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act, incluyendo el uso del procedimiento de quejas de OSHA.
Difusión y Comunicación
Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

Elaborar información sobre el reconocimiento y la prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado), a los nacionales mexicanos que trabajan en Colorado y a sus empleadores.

Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
-
Participar en las actividades y los eventos del “Consulado Móvil”.
Promoción de un Diálogo Nacional
Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
-
Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan Colorado para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act.
Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.
Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.
Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Denver and Englewood Area Offices and the Consulate of Mexico in Denver, Colorado (the Consulate), hereinafter referred to collectively as “the Participants”;
RECOGNIZING the joint commitment to protect workers’ rights for Mexican workers in the United States; and
RECOGNIZING that OSHA’s Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;
Intend to form an Alliance to achieve the following:
Overall Objective
The Participants intend to establish a collaborative relationship to provide Mexican Nationals in the state of Colorado and others information, guidance, and access to education and training resources to promote workers’ rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).
Training and Education
The Participants intend to work together to achieve the following training and education goals:

To develop training and education programs for Mexican workers and Mexican employers in Colorado regarding workplace safety and health.
-
To develop training and education programs for Mexican workers and Mexican employers in Colorado to promote understanding of workers’ rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.
Outreach and Communication
The Participants intend to work together to achieve the following outreach and communication goals:

To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA’s Web site from the Consulate’s Web site) to Mexican Nationals working in Colorado and their employers.

To speak, exhibit, or appear at the Participants’ conferences, local meetings, or other events.

To participate in “Mobile Consulate” activities and events.
Promotion of a National Dialogue
The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

To raise awareness of and demonstrate commitment to workplace safety and health and workers’ rights under the OSH Act whenever leaders from the Participants address groups.
-
To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in Colorado to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers’ rights and responsibilities of employers under the OSH Act.
An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.
Nothing in this Arrangement commits the Participants to the expenditure of any funds.
This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.
