AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
AND
THE NATIONAL DEMOLITION ASSOCIATION

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) and The National Demolition Association (NDA) recognize the value of maintaining a collaborative relationship to foster safety and health practices and programs to improve American Workplaces. To that end, OSHA and NDA hereby enter into an Alliance with an emphasis on worker safety within the demolition and environmental industry. Both organizations are committed to providing NDA members, safety and health professionals, the public, labor representation groups, and others in the demolition industry with information, guidance, and access to training that will help them protect workers by reducing and preventing exposure to hazardous waste hazards within the demolition industry by addressing the proper removal and recycling of hazardous materials, as well as the those hazards associated with the use and maintenance of demolition equipment, and promote a better understanding of worker rights and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

This agreement provides a framework and objectives for the Alliance’s activities. Alliance participants also agree to meet the requirements for program participation laid out in the “Fundamental Requirements for OSHA Alliance Program Participants” and the “Guidelines for OSHA’s Alliance Program Participants: Alliance Products and Other Alliance Projects.”

Through the Alliance, the organizations will use available injury, illness, and hazard exposure data, when appropriate, to help identify and prioritize areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In developing this Alliance, OSHA and NDA recognize that OSHA’s State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness of OSHA’s Rulemaking and Enforcement Initiatives

The Participants will work together to achieve the following raising awareness of OSHA’s rulemaking and enforcement objectives:

  • Share information on OSHA's National Initiatives (Emphasis Programs, Regulatory Agenda, Outreach) compliance assistance products, and opportunities to participate in the rulemaking process, including those relevant to demolition and related industries.
  • Disseminate information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers through communications such as: OSHA and NDA websites, print, electronic (NDA newsletters, membership network emails) and social media (blogs, Facebook, Twitter, etc., utilizing OSHA campaign #hashtags), NDA Library, electronic assistance tools, and scheduled calls/meetings.
  • Speak, exhibit, or appear at OSHA and NDA conferences, local meetings, forums, roundtable discussions, or stakeholder meetings on health and safety hazards in demolition and related industries to help forge innovative solutions in the workplace or to provide input on safety and health issues.
  • Work collaboratively through the Alliance with other stakeholders to develop and disseminate an alliance product focusing on best practices in “Power Plant Demolition,” which will promote the advancement of safety and health for NDA members, safety and health professionals, the public, and other stakeholders in the demolition sector.
  • Encourage worker participation by including the Laborers’ Health and Safety Fund of North America as an active participant in the Alliance implementation team and Alliance projects.

Training and Education

The Participants will work together to achieve the following training and education objectives:

  • Expand existing relationships between the NDA members and OSHA's Regional/Area Offices to address health and safety issues, including providing “Best Practice Training” to agency staff focusing on deconstruction and selective dismantlement of building components for re-use, repurposing, recycling, and waste management, in addition to providing technical expertise, when appropriate.
  • Review and provide feedback on OSHA compliance assistance and educational materials related to demolition practices to ensure they reference current industry best practices.
  • Revise existing and/or develop new best practices for demolition contractors to incorporate into workplace safety and health management systems and other safety performance programs.

OSHA’s Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communication, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization’s products or services.

An implementation team made up of representatives of each organization will meet one to two times per year to discuss the responsibilities of the participants, to share information on activities, and to track results in achieving the goals of the Alliance. OSHA team members will include representatives from the Directorate of Cooperative and State Programs, the Directorate of Standards and Guidance, the Directorate of Construction, and any other offices as appropriate. OSHA will encourage the participation of State Plans and OSHA On-site Consultation Programs on the team, as well as share any products or activities that result from the work of the Alliance.

This agreement will remain in effect for two years. Either signatory may terminate it for any reason at any time, provided they give 30 days’ written notice. This agreement may be modified at any time with the written concurrence of both signatories.

To that end, OSHA, BCSP, and the BCSP Foundation hereby renew the Alliance signed February 1, 2018, in part, with a continued emphasis on developing effective training, educational webinars, safety and health professional certifications, safety and health programs, and fall protection. Specifically, all organizations understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act) and are committed to providing BCSP and the BCSP Foundation members, safety and health practitioners, and the public with information, guidance, and access to training resources that will help them protect the health and safety of workers. BCSP will provide their expertise during the development of the guidance documents and will share them through BCSP and BCSP Foundation websites, print and electronic methods (newsletters, emails), social media (blogs, Facebook, Twitter, etc., utilizing OSHA campaign #hashtags and materials), electronic assistance tools, and scheduled calls/meetings. Speak, exhibit, or appear at OSHA or BCSP and BCSP Foundation conferences, local meetings, or other events.
  • Encourage BCSP members and their downstream user networks to build relationships with OSHA’s Regional and Area Offices to address health and safety issues relevant to their respective industries.

Training and Education

The Participants intend to work together to achieve the following objectives:

  • Identify OTI Education Centers’ classes that contribute to various BCSP professional certification educational and eligibility criteria and incorporate those into BCSP materials on certification.
  • Develop effective training and educational webinars for safety and health practitioners and the general public, including employers and workers, on various safety and health topics (e.g., safety training programs, fall protection, etc.) as agreed upon with OSHA and communicate such information broadly.

OSHA’s Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communication, training, and education. These Alliances have proved to be valuable tools for both OSHA and Alliance participants. The Bismarck Area Office of the Occupational Safety and Health Administration and the Coalition of Trench Training Partners continue to recognize the value of establishing a collaborative relationship to foster safer and more healthful North Dakota workplaces. To that end, OSHA and the Coalition hereby renew the Alliance signed May 3, 2018, to provide North Dakota’s employers and workers with information, guidance and training resources that will assist them in implementing a robust systems approach to advancing the health and safety of employees within trenching and excavating in the construction industry and the energy services industry.

The overarching goal of this Alliance is to reduce the number of occupational exposures to physical and atmospheric hazards, which can result in injuries and fatalities. This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the requirements for program participation laid out in the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects."

Through the Alliance, the organizations will use injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities.   • Collaborate to provide continual awareness to its members through presentations and printed media on the hazards associated with trenching and excavations.
  • Collaborate with other governmental agencies and private entities to facilitate occupational and environmental health and safety presentations, training and resources at quarterly organizational meetings specifically related to trenching.
  • Encourage worker participation of their members in workplace safety and health training through surveys and observations to measure the effectiveness of alliance activities and gaps that need to be addressed.

The Coalition members will provide feedback to OSHA quarterly on this partnership’s effectiveness by:

  • Identifying the total number of employers they have trained and the total number of employees affected by their training.
  • Identifying the number of employees that have been trained as competent persons for trenching and excavating.
  • Identifying the number of onsite inspections/monitoring’s their organization have conducted regarding trenching and excavating and the most prevalent hazards identified. Company names will not be provided to OSHA, to ensure employer confidentiality.

OSHA will support the Coalition’s efforts in the area of training and education by providing the following as requested:

  • Providing specific training to Coalitions inspectors and auditors on how to identify trenching hazards.
  • Provide outreach activities and presentations to these organizations relating to trenching and excavating.
  • Assist in providing information for the development of training materials, hazard warnings, and safety alerts for coalition members.
  • Coordinate quarterly meetings to monitoring overall alliance progress.

The Alliance provides parties an opportunity to participate in a voluntary cooperative relationship with the Bismarck Area Office of OSHA for the purposes of training and education, outreach and communication, and promoting a dialogue on workplace safety and health.

The Alliance has proved to be a valuable tool for both OSHA and its participants. By entering into an Alliance, the Coalition does not endorse any of the participant’s products or services. Nor does the Coalition enter into an Alliance with the purpose of promoting a particular party’s products or services.

      The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) and the Alabama Trucking Association Workers’ Compensation Fund (ATAWCF) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. The Alliance formed is focused on reducing and preventing exposure to hazards on the highway, at pick-up and delivery points, as well as maintenance shops for ATAWCF members, representing nearly 550 (Alabama and outside of Alabama) individually owned companies engaged in operations as a Motor Carrier, For-Hire/Private Carrier, Allied, Warehousing, Beer Distributors, Household Movers or Manufacturing.

  2. Implementation Team Meetings

    Due to COVID-19, pandemic, no on-site meetings were held with Ms. Morris. The ATA Comp Fund Risk Managers were very limited to their on-site visits, but continued to provide loss control/safety services via phone/video conferencing and emails.

    Due to COVID restrictions and susceptibilities, it was determined that several projects needed to be put on hold until all involved parties feel comfortable and have fully re-opened. The table below reflects the ATAWCF projects delayed due the COVID-19 pandemic.

    Construction Zone Safety This project was to be in conjunction with the Alabama Trucking Association (ATA). The ATA and ATA Comp Fund have a solid working relationship for DOT/OSHA regulations. The future goal for this project has been discussed with the ATA (Tim Frazier, VP-Safety & Compliance). I will also reach out to Ms. Morris on OSHA data that will be used to further enhance our objective. The ATA Comp Fund will assist in creating mock situation(s) and utilizing their drone to give a birds-eye view to capture a larger perspective of the exposure(s).
    Participation of the OSHA Area Director in the Safety & Maintenance Management Council (SMMC) meeting All SMMC meetings and roadside inspections have been cancelled (except for the recent April 2021 roadside inspection). The SMMC has a September 2021 meeting in Montgomery, AL, that includes their three chapters. Ms. Morris, Area Director for the Birmingham Area Office has been invited to speak at that event. Additionally, Ms. Morris has also been invited to participate in the ATAWCF’s Risk Management Advisory Council (RMAC) meeting in October 2021.
    Safety Stand-Downs at specific Fund member locations Due to COVID precautions, this project was placed on hold. One of the project items approved during the RMAC meeting will be our 1st annual Safety Blitz/Stand-Down to prevent falls. The ATAWCF team will create training for terminal/office personnel on proper 3-point contact techniques and why it is important. The ATAWCF Risk Managers will also be visiting member sites to encourage participation in the Blitz/Stand-Down. Focus will be on those sites with high frequency/severity rates for slips, trips and falls

AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN
ERIE AREA OFFICE
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
AND
THE PENNSYLVANIA OSHA CONSULTATION PROGRAM
AND
GANNON UNIVERSITY SMALL BUSINESS DEVELOPMENT CENTER

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Erie Area Office, Pennsylvania OSHA Consultation Program and Gannon University Small Business Development Center (Gannon University SBDC) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA, Pennsylvania OSHA Consultation Program, and Gannon University SBDC (herein after referred to collectively as “the Participants”) hereby form an Alliance to provide small businesses with information, guidance, and access to training resources that will help them protect the health and safety of workers, particularly in reducing and preventing exposure to occupational safety and health hazards, and understanding the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

This agreement provides a framework and objectives for the Alliance’s activities. Alliance participants also agree to meet the “Fundamental Requirements for OSHA Alliance Program Participants” and the “Guidelines for OSHA’s Alliance Program Participants: Alliance Products and Other Alliance Projects.”

Through the Alliance, the participants will use relevant injury, illness and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options to evaluate the effectiveness of the Alliance and measure the impact of its overall effort to improving workplace safety for employers and workers. In developing this Alliance, OSHA and Gannon University SBDC recognize that OSHA’s State Plan and Consultation Project partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives, as resources permit:

  • To share information on OSHA’s National/Regional/Local Emphasis Programs, Regulatory Agenda, and opportunities to participate in the rulemaking process.
  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • To share information on workplace hazards and communicate information (e.g. print and electronic media, electronic assistance tools and participant web sites) to employers and small businesses.
  • To speak, exhibit, or appear at participant workforce education events.
  • Promote and communicate the free service provided by the Pennsylvania OSHA Consultation Service to employers and small businesses.

Training and Education

The Participants intend to work together to achieve the following objectives, as resources permit:

  • To assist in the development of effective training and educational programs for small businesses and others regarding workplace hazards within the construction and general industry sectors and to communicate such information to constituent employers and workers.
  • To assist in the development of effective training to promote understanding of the responsibilities of employers.

OSHA’s Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communications, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization’s products or services.

An implementation team made up of representatives of each organization will meet one to two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Erie and any other appropriate offices. OSHA will encourage State Plans’ and OSHA On-Site Consultation program’ participation on the team.

This agreement will remain in effect for two years. Any signatory may terminate it for any reason at any time, provided they give 30 days’ written notice. This agreement may be modified at any time with the concurrence of all signatories.
