ARRANGEMENT ESTABLISHING AN ALLIANCE
BETWEEN
THE U.S. DEPARTMENT OF LABOR'S
OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
APPLETON AND EAU CLAIRE, WISCONSIN AREA OFFICES
AND
THE CONSULATE OF MEXICO IN ST. PAUL, MINNESOTA


The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Appleton and Eau Claire, Wisconsin Area Offices and the Consulate of Mexico in St. Paul, Minnesota (the Consulate), hereinafter referred to collectively as "the Participants;"

RECOGNIZING the joint commitment to protect workers' rights for Mexican workers in the United States acknowledged in the Letter of Arrangement between the Occupational Safety and Health Administration of the United States of America and the Ministry of Foreign Affairs of the United Mexican States, signed at Washington, D.C., on June 1, 2010; and

RECOGNIZING that OSHA's Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;

Intend to form an Alliance to achieve the following:

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican Nationals in Northern Wisconsin and others information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in Northern Wisconsin regarding workplace safety and health.
  • To develop training and education programs for Mexican workers and Mexican employers in Northern Wisconsin to promote understanding of workers' rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate's Web site) to Mexican Nationals working in Northern Wisconsin and their employers.
  • To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events.
  • To participate in "Mobile Consulate" activities and events.

Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights under the OSH Act whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in Northern Wisconsin to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers' rights and responsibilities of employers under the OSH Act.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

    The purpose of this Alliance is to establish a collaborative relationship to provide Mexican Nationals in Illinois and others with information, guidance and access to education and training resources to promote worker safety and health. Additionally, the alliance aims at helping workers understand the rights of workers and responsibilities of employers under the Occupational Safety and Health Act.

    Planning Meetings were held on May 30, June 26, and July 31, 2017 to plan and organize the worker rights week in late August and early September. A follow-up meeting is held following the labor rights week to discuss the successes/shortcomings of the worker rights week held in August/September and to plan for future events.

    • Training and Education:
      • Outreach presentations have been held at various locations for workers from the Hispanic community in Spanish informing them of the employee rights under the Occupational Safety and Health Act. Information was also provided about OSHA and employer responsibilities under the OSH Act.
      • Presentations in Spanish were held during the labor rights week informing Spanish speaking employees of their rights and employer responsibilities.
    • Outreach and Communication:
      • During labor rights week- August 18- September 1, 2017 outreach events were held at various locations including, the Mexican Consulate in Chicago, mobile consulate locations, community centers, churches, schools, Consulate locations, etc. During the events, Spanish speaking OSHA personnel manned an OSHA booth, handed out Spanish publications and answered questions. The worker rights week was attended by a large number of Spanish speaking workers and was very well received.
      • Guest appearance were made at two Spanish radio stations, Radio Claret America and Spanish Public Radio by Spanish speaking compliance officers. Compliance officers answered questions related to workers' rights under OSHA.
    • Promotion of National Dialogue:
      • The Alliance helped establish a cooperative relationship with the Mexican Consulate in Chicago.
      • Training and outreach activities organized as a result of the Alliance increased awareness and helped educate Spanish speaking employees about workers rights under OSHA.

La Oficina Regional de Chicago de la Administración de Seguridad y Salud Ocupacional (OSHA) del Departamento de Trabajo de los Estados Unidos de América, y el Consulado General del Ecuador, en adelante identificados de forma individual como “Participante” y colectivamente como “los Participantes;”

RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores ecuatorianos reconocidos en la Carta de Acuerdo entre la Administración de Seguridad y Salud Ocupacional de los Estados Unidos de América y el Ministerio de Relaciones Exteriores, Comercio e Integración de Ecuador, firmada en Washington, D.C., el 11 de Junio de 2012; y

RECONOCIENDO que el Programa de Alianza de OSHA prevée el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se propone establecer una Alianza para lograr lo siguiente:

 

Objetivo General

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales ecuatorianos en Chicago y en la jurisdicción común a ambos Participantes (Ohio, Illinois, Indiana, Michigan, y Wisconsin) y a otros, información, orientación y acceso a recursos educativos y de capacitación con miras a promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y ayudarlos a comprender los derechos de los trabajadores y responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para trabajadores ecuatorianos en la región de Chicago y en la jurisdicción común a ambos Participantes (Ohio, Illinois, Indiana, Michigan, y Wisconsin) sobre los temas de seguridad y salud ocupacionales.
  • Elaborar programas de capacitación y educación para trabajadores y empleadores ecuatorianos en la región de Chicago y en la jurisdicción común a ambos Participantes (Ohio, Illinois, Indiana, Michigan, y Wisconsin) a fin de promover la comprensión de derechos de los trabajadores y las responsabilidades de los empleadores, como usar el proceso de quejas de OSHA.

Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Preparar información sobre el reconocimiento y prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos o electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de OSHA desde el sitio Web del Consulado) a ecuatorianos trabajando en el región de Chicago y en la jurisdicción común a ambos Participantes (Ohio, Illinois, Indiana, Michigan, y Wisconsin) y a sus empleadores.
  • Dar charlas, hacer presentaciones, y participar en exposiciones, conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del “Consulado Móvil.”

Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo nacional sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, discusiones de mesa redonda o reuniones con interesados directos sobre temas que afectan directamente a Ecuatorianos que trabajan en la región de Chicago, a fin de ayudar a forjar soluciones innovadoras en temas referentes a la salud y la seguridad en el lugar de trabajo, los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act.
  • Compartir información sobre las leyes y normas aplicables de los EE.UU. relativas a los derechos de los trabajadores y las responsabilidades de los empleadores en la región de Chicago y en la jurisdicción común a ambos Participantes (Ohio, Illinois, Indiana, Michigan, y Wisconsin).

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de dar seguimiento e intercambiar información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Acuerdo compromete a los Participantes a erogar recursos.

Este Acuerdo puede iniciarse una vez firmado por los dos Participantes. El presente Acuerdo cesará después de dos (2) años de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Acuerdo notificará por escrito al otro Participante con treinta (30) días de antelación. El presente Acuerdo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

    Alliance Activity

    • OSHA assisted in providing safety and health information and publications in Spanish. The OSHA Poster and Worker Rights information are displayed on a bulletin board at the Consulate entrance. Other OSHA publications are in a brochure display rack in the waiting area.
    • A number of networking opportunities has helped government agencies reach the vulnerable population. Federal OSHA and the Consulate staff co-attended a number of Hispanic related events during the past year such as the Stevens Point Agricultural Safety Connections conference and the NIOSH/ UW- Eau Claire Symposium on Rural Health.
  4. Results

    • Federal OSHA partnered with Federal Wage and Hour Division and the State of MN Consultation Service to offer a broader range of resources to the Mexican employer and worker. The Federal Wage and Hour Division and the State of MN Consultation Service have an on-going Alliance with the Consulate that was revitalized.
    • Federal OSHA representatives attended Mobile Consulates that were held in Winona, Minnesota and Wisconsin.
    • The Consulate staff has referred Mexican workers to Federal OSHA for safety and health assistance.

  5. Upcoming Milestones

     

    • OSHA will renew and develop Alliances with the Consulate of Mexico based on the new territorial boundaries.
      • The St Paul Consulate will include the Eau Claire and Madison Area Office.
      • The Milwaukee Consulate will include Milwaukee, Appleton and Madison Area Office. The Upper Peninsula of Michigan is part of the Milwaukee Consulate and the State of Michigan may be included in the Milwaukee Alliance.
      • The Chicago Consulate will be limited to Illinois OSHA offices.
    • OSHA and Consulate of Mexico in St. Paul, MN will continue to attend the mobile consulates held in Northern Wisconsin.
    • OSHA will participate in the Labor Rights Week in August, 2016.
    • OSHA will coordinate with the Consulate to support for the 2017 Agricultural Safety Connections conference.

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) and the Lake County Contractors Association (LCCA) recognize the value of maintaining a collaborative relationship to foster safer and more healthful workplaces within the County of Lake, State of Illinois. To that end, OSHA and LCCA, hereby renew the Alliance, signed April 16, 2008, and renewed April 16, 2010, with a continued emphasis on advancing a culture of accident prevention. Specifically, both OSHA and LCCA are committed to providing LCCA members and others with information, guidance, best practices, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through this Alliance, OSHA and LCCA will address the hazards in construction including, falls, electrocutions, struck by objects, caught-in/between. In renewing the Alliance, OSHA and LCCA recognize that OSHA's State Plan and Consultation Program partners are an integral part of the OSHA national effort.

Raising Awareness of OSHA's Rulemaking and Enforcement Initiatives

The participants intend to work together to achieve the following goals related to raising awareness of OSHA's rulemaking and enforcement initiatives:

  • To share information on OSHA's National/Regional/Local Emphasis Programs, Regulatory Agenda, and opportunities to participate in the rulemaking process.
  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.

Training and Education

The participants intend to work together to achieve the following training and education goals:

  • To organize and provide the necessary resources for the presentations of OSHA's construction course for the organization's members when OSHA and the organization identify the need.
  • The LCCA will consult with OSHA personnel and industry safety and health professionals in the effective construction safety management practices as jointly determined by OSHA and the LCCA.
  • To deliver or arrange for the delivery of OSHA 10-hr and/or OSHA 30-hr classes as needed.

Outreach and Communication

The participants intend to work together to achieve the following outreach and communication goals:

  • To develop and present a seminar for the LCCA members to be delivered in conjunction with OSHA.
  • To provide a forum for OSHA personnel to speak, exhibit or appear at conferences sponsored by the LCCA.
  • To develop and disseminate LCCA information through print and electronic media, including electronic tools and links from OSHA's and the LCCA's web sites, along with applicable articles in their print media.
  • Use the LCCA's newsletters, websites, workshops, meetings and other resources as vehicles to disseminate OSHA or LCCA developed information and guidance on the workplace safety issues.
  • To raise awareness through speeches and appearances by the LCCA's leaders of safe worksite programs and their commitment to workplace safety and health.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of the party's product or service.

An implementation team made up of representatives of each organization will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least quarterly to track and share information on activities and results in achieving the goals of this Alliance. OSHA team members will include representatives of the Chicago North Area Office. OSHA will encourage OSHA On-site Consultation Programs' participation on the team.

This agreement will remain in effect for 2 years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with concurrence of both signatories.

OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training, education, outreach and communication to promote a dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party’s products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party’s product or service.

Representatives of both LCCA and OSHA will continue to meet at least quarterly to track and share information on activities and results in achieving the goals of this Alliance.

    The Abbott Laboratories-GLCA-OSHA Safety Day is providing an opportunity to expand our safety message by attracting non-member contractors to the free training program that is subsidized by Abbott and GLCA. The safety day also provides and opportunity for OSHA Compliance Officers to attend the training.

  5. Upcoming Milestones

    The Alliance was renewed for another two years. Both implementation team members and general members of the organization find the alliance a useful tool in protecting the safety and health of contractors in Lake County Illinois.

    Going forward there are several items on the agenda including:

    • The 2018 Safety Day is scheduled for October 2018 with the topic OSHA Region V fatality statistics, Chicago North Area Office fatalities and accidents, OSHA regulatory update, Case Studies presented by OSHA on Hazzard Awareness
    • Continue to evaluate safety award criteria.
    • Update website to highlight all safety services available.
    • OSHA staff to continue participating in GLCA sponsored 10 and/or 30 hour courses.

TOLEDO, CLEVELAND, AND LANSING AREA OFFICES, 
MICHIGAN OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION 
AND 
THE CONSULATE OF MEXICO IN DETROIT


The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA), Toledo, Cleveland and Lansing Area Offices, the Michigan Occupational Safety and Health Administration (MIOSHA) and the Consulate of Mexico in Detroit (the Consulate), hereinafter referred to collectively as "the Participants;"

RECOGNIZING the joint commitment to protect workers' rights for Mexican workers acknowledged in the Letter of Arrangement between the Occupational Safety and Health Administration of the Department of Labor of the United States of America and the Ministry of Foreign Affairs of the United Mexican States, signed at Washington, D.C., on June 1st, 2010; and

RECOGNIZING that OSHA's Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;

Intend to form an Alliance to achieve the following:

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican nationals in Michigan and Ohio information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act.

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in Michigan and Ohio regarding workplace safety and health, and to communicate such information to constituent employers and workers. 
     
  • To develop training and education programs for Mexican workers and employers in Michigan and Ohio to promote understanding of workers' rights and responsibilities of employers, including the use of the OSHA complaint process, and to communicate such information to employers and workers.
Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate's Web site) to Mexican nationals working in Michigan and Ohio and their employers. 
     
  • To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events. 
     
  • To participate in "Mobile Consulate" activities and events.
Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights whenever leaders from the Participants address groups. 
     
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican nationals working in Michigan and Ohio to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers' rights and responsibilities of employers.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement is intended to cease for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time with the concurrence of the Participants.

APPRENTICESHIP and SKILL IMPROVEMENT PROGRAM,
OPERATING ENGINEERS, LOCAL 150


The Chicago Area Offices of the Occupational Safety and Health Administration (OSHA) and the International Union of Operating Engineers, Local 150 Apprenticeship and Skill Improvement Program recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces.

These organizations hereby form an Alliance to provide the apprentices and journeymen participating in the Local 150 Apprenticeship and Skill Improvement Program with information, guidance, and access to training resources that will help them protect employees’ health and safety, particularly in reducing and preventing exposure to the hazards associated with cranes, earth moving and other construction equipment including operations associated with trenching/excavations and hazardous waste (HAZWOPER) sites. In developing this Alliance, OSHA and the International Union of Operating Engineers, Local 150 Apprenticeship and Skill Improvement Program recognize that OSHA’s State Plan and Consultation Project partners are an integral part of the OSHA national effort.

OSHA and the International Union of Operating Engineers, Local 150 Apprenticeship and Skill Improvement Program will work together to achieve the following outreach and communication goals:

 

  • Speak, exhibit, or appear at Local 150 apprenticeship training or other training sessions.

  • Deliver or arrange for the delivery of an OSHA presentation at HAZWOPER refresher training sponsored by the Local 150 Skill Improvement and Training Program.

  • Share information between OSHA personnel and industry safety and health professionals regarding best practices for on-site crane and heavy equipment management.

  • Share information between OSHA personnel and industry safety and health professionals regarding best practices for construction, operations and maintenance of wind farms.

OSHA and the International Union of Operating Engineers, Local 150 Apprenticeship and Skill Improvement Program will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health:

 

 

  • Raise awareness of and demonstrate commitment to workplace safety and health whenever OSHA leaders address groups.

  • Convene or participate in forums, round table discussions, or stakeholder meetings on issues regarding the use of heavy construction equipment and work at HAZWOPER sites to help forge innovative solutions in the workplace or to provide input on safety and health issues.

  • Convene or participate in forums, round table discussions, or stakeholder meetings on issues regarding the use of heavy construction equipment and work at wind farms to help forge innovative solutions in the workplace or to provide input on safety and health issues.

OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party’s products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party’s products or services.

OSHA agrees to obtain written consent from the Local 150 Apprenticeship and Skill Improvement Program prior to obtaining or using any materials developed by the Program.

An implementation team made up of representatives of these organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. The team will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

This agreement will remain in effect for two years from the date of the agreement. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of all signatories.

RECOGNIZING that OSHA's Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;

  • To develop training and education programs for Mexican workers and Mexican employers in Illinois to promote understanding of workers' rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.
