The Chicago Area Offices of the Occupational Safety and Health Administration (OSHA) and the International Union of Operating Engineers, Local 150 Apprenticeship and Skill Improvement Program recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces.

These organizations hereby form an Alliance to provide the apprentices and journeymen participating in the Local 150 Apprenticeship and Skill Improvement Program with information, guidance, and access to training resources that will help them protect employees' health and safety, particularly in reducing and preventing exposure to the hazards associated with cranes, earth moving and other construction equipment including operations associated with trenching/excavations and hazardous waste (HAZWOPER) sites. In developing this Alliance, OSHA and the International Union of Operating Engineers, Local 150 Apprenticeship and Skill Improvement Program recognize that OSHA's State Plan and Consultation Project partners are an integral part of the OSHA national effort.

OSHA and the International Union of Operating Engineers, Local 150 Apprenticeship and Skill Improvement Program will work together to achieve the following outreach and communication goals:

  • Speak, exhibit, or appear at Local 150 apprenticeship training or other training sessions.
     
  • Deliver or arrange for the delivery of an OSHA presentation at HAZWOPER refresher training sponsored by the Local 150 Skill Improvement and Training Program.
     
  • Share information between OSHA personnel and industry safety and health professionals regarding best practices for on-site crane and heavy equipment management.

 


OSHA and the International Union of Operating Engineers, Local 150 Apprenticeship and Skill Improvement Program will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health:

 

  • Raise awareness of and demonstrate commitment to workplace safety and health whenever OSHA leaders address groups.
     
  • Convene or participate in forums, round table discussions, or stakeholder meetings on issues regarding the use of heavy construction equipment and work at HAZWOPER sites to help forge innovative solutions in the workplace or to provide input on safety and health issues.

 


OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services.

OSHA agrees to obtain written consent from the Local 150 Apprenticeship and Skill Improvement Program prior to obtaining or using any materials developed by the Program.

An implementation team made up of representatives of these organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. The team will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

This agreement will remain in effect for two years from the date of the agreement. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of all signatories.

The parties to this agreement are and remain independent entities and one shall not be construed as being an agent or employee of the other.

  2. Implementation Team Meetings
    • The Chicago Assistant Regional Administrator held their first planning meeting via phone with the Vice Consul the week after the Alliance signing. Several OSHA resources were discussed that would be of use for the Consulate. A midyear meeting was held at the Ecuadorian Consulate on April 16, 2015 to review the progress of the alliance goals along with a discussion for brainstorming additional outreach events throughout the year. The group discussed additional plausible venues of collaborations where OSHA may assist with Ecuadorian workers’ matters.
  3. Activities and Products

    Training and Education

    • The Chicago Regional Office was able to facilitate construction safety training provided by a Region V Susan Harwood grant organization. The training took place over a weekend in March 2015 which resulted in 31 Ecuadorian nationals being trained on construction hazards, the OSH Act, and employer/employees’ rights and responsibilities.
    • An additional training was provided in April 2015 which consisted of a Train-the- Trainer that focused on hazard recognition in the workplace along with employer/employee safety rights. This training was also provided through the connection with a Region V Susan Harwood Grantee.
    • The Chicago Regional Office and Vice Consul of Ecuador participated in several worker rights roundtable discussion meetings that discussed strategies in bridging resource gaps amongst various federal and state agencies so that vulnerable workers may be reached more effectively.

    Outreach and Communication

    • The Chicago Regional Office participated in a mobile consular event in Fort Wayne, Indiana on October 18, 2014. Information was presented on worker’s rights under OSHA along with several publication materials on construction and general industry safety and health.
    • The Chicago Regional office participated during a Labor rights week consular event on November 15, 2014 which presented information about worker rights under OSHA, handed out publications and answered questions the Ecuador constituent workers had.
    • The Indianapolis OSHA Area Office participated in the Latino Indiana Expo on June 20th 2015. The OSHA Area Director provided the consulate and others in attendance with OSHA publications which included educational brochures, pamphlets and training materials. The publications and information provided by Region V are made available at the consulate for distribution throughout the year.

    Promoting the National Dialogue on Safety and Health

    • The Chicago Acting Assistant Regional Administrator and Program Manager attended a consular outreach service, and ceremony for the 206th anniversary of the Declaration of Ecuador Independence on August 7, 2015.
  4. Results
    • Through the joint efforts of the Alliance, the Consulate General of Ecuador now has greater access to OSHA outreach information and publications for the Ecuadorian workers in Region V. In addition an increased awareness of OSHA’s continued efforts to reach at-risk workers remains a paramount goal.
  5. Upcoming Milestones

    The Alliance plans to reestablish its collaborative efforts and continue towards meeting the goals for the next evaluation year. In the first quarter of the new fiscal year, Region V has scheduled a tele-conference with the Vice Consul for the purpose of conducting an overall review of Alliance achievements and goals. A focus will be based on expanding outreach assistance to Ecuadorian nationals in the state of Ohio. Strategic goals for the follow-on period of the alliance will also be reviewed. Region V is jointly continuing:

    • Promotion of occupational safety and health for the Ecuadorian community in Region V.
    • OSHA participation in mobile consulate events.
    • OSHA participation in consulate activities during the year.

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in Wisconsin regarding workplace safety and health.
  • To develop training and education programs for Mexican workers and Mexican employers in Wisconsin to promote understanding of workers’ rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA’s Web site from the Consulate’s Web site) to Mexican Nationals working in Wisconsin and their employers.
  • To speak, exhibit, or appear at the Participants’ conferences, local meetings, or other events.
  • To participate in “Mobile Consulate” activities and events.

Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers’ rights under the OSH Act whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in Wisconsin to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers’ rights and responsibilities of employers under the OSH Act.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least two times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

    Alliance Overview

    Primary goals of the alliance are to develop relationships with the electrical contractors and apprentice electricians through the apprenticeship training program at the NECA training facility in Alsip Illinois. Initial target area was the hazards associated with arc flash and arc blast and the OSHA 10-hr. course.

    The alliance has expanded activities to include presentations sponsored by the OSHA Training Institute (OTI) and the Region V Training Committee. Approximately twenty-five CSHOs attended each of the two training sessions. A session for OSHA CSHOs was given on May 16, 2012 through the OSHA Training Institute (OTI) – Electrical Standards course. CSHOs from throughout the U.S. attend and the training incorporated hands-on utilization of the equipment found at the EJATT facility.

    On June 14, 2012 the EJATT facility was used for LOTO training sponsored by the Region V training committee. CSHOs from various local OSHA offices attended and utilized the motor control and PLC classrooms to discuss LOTO and potential arc flash / arc blast scenarios.

    Alliance Products

    No specific outreach products have been developed through the alliance, but the PowerPoint presentations used during the Introduction to OSHA, blast / arc flash presentations and the training through the OTI were provided to EJATT for use in other sessions.

  5. Results

    This alliance continues to be very successful in building a strong relationship between OSHA, specific electrical contactors in the area and the union’s training facility. When initiated, the alliance focused on the emerging topic of arc flash / arc blast and was successful in presenting information on the subject. This has expanded to include Introduction to OSHA presentations as part of OSHA 10-Hour courses. With the majority of local electrical apprentices receiving training at the EJATT, the setting is ideal to continue the relationship with future tradesmen. All parties involved are very pleased with the activities and strong relationship developed to date.

  6. Upcoming Milestones

    A goal for 2012/13 is to expanded activities to include additional training of OSHA Compliance Officers on equipment available at the facility and to continue utilizing the facility for OTI and other OSHA sponsored courses. The training facility has an extensive system of sample circuits and panel boards at which CSHOs can receive background on associated hazards and industry practices for service and maintenance.

    It is the recommendation to renew this alliance as scheduled in 2014.

The Occupational Safety and Health Administration (OSHA) and the Lake County Contractors Association (LCCA) recognize the value of continuing a collaborative relationship to foster safer and more healthful workplaces within the County of Lake, State of Illinois. OSHA and LCCA, therefore, agree to renew the Alliance, signed April 12, 2006, to use their collective expertise to help advance a culture of accident prevention while sharing information, guidance, best practices, access to training resources and technical knowledge that will help protect employees' safety and health. In particular, the Alliance focuses on, but not limited to, efforts to reach members of the LCCA through outreach on safety and health issues. The outreach activity will complement OSHA's goals, as outlined in its Strategic Management Plan (SMP), of reducing occupational hazards through compliance assistance, outreach and education. In renewing this Alliance, OSHA and the LCCA will continue to provide education, training and other technical resources to reduce and prevent exposures to the most commonly identified safety and health hazards in construction and general industry. In addition, both parties recognize that OSHA's State Plan and Consultation Project partners are an integral part of the OSHA national effort.


OSHA and the LCCA will work together to achieve the following outreach and communication goals:

  • Develop and disseminate LCCA information through print and electronic media, including electronic tools and links from OSHA's and the LCCA's web sites, along with applicable articles in their print media.
  • Provide a forum for OSHA personnel to speak, exhibit or appear at conferences sponsored by the LCCA.
  • Promote and encourage members associated with the LCCA to participate in OSHA's compliance assistance, education and outreach programs.


OSHA and the LCCA will work together to achieve the following goals related to promoting dialogue on workplace safety and health:

  • Develop and present a seminar for the LCCA members to be delivered in conjunction with OSHA.
  • Organize and provide the necessary resources for the presentations of OSHA's construction course for the organization's members when OSHA and the organization identify the need.
  • Promote and encourage members of the LCCA to individually participate in OSHA's cooperative program of compliance assistance, the Voluntary Protection programs, Consultation and SHARP. In addition, OSHA will recognize members that aspire to excellence in health and safety for their worksites.
  • The LCCA will consult with OSHA personnel and industry safety and health professionals in the effective construction safety management practices as jointly determined by OSHA and the LCCA.
  • Use the LCCA's newsletters, websites, workshops, meetings and other resources as vehicles to disseminate OSHA or LCCA developed information and guidance on the workplace safety issues.
  • Encourage the LCCA's members to act as industry liaisons and resources for OSHA's cooperative programs and compliance assistance specialist.
  • Raise awareness through speeches and appearances by the LCCA's leaders of safe worksite programs and their commitment to workplace safety and health.


OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training, education, outreach and communication to promote a dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's product or service.

Representatives of both LCCA and OSHA will continue to meet at least quarterly to track and share information on activities and results in achieving the goals of this Alliance.

This agreement will remain in effect for 2 years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with concurrence of both signatories. Signed April 16, 2008.

    Overview

    OSHA and the Cleveland Safety Forum renewed the alliance for another two year period to continue to provide local construction companies, employees and others with information, guidance, and access to training resources to help them protect the health and safety of construction workers. The members of the Safety Forum include a group of union contractors, management, and union training coordinators. The alliance addresses occupational topics such as crane regulations, fall protection, silica exposure and education, training in hazard recognition and control in the construction industry.

    There were also many phone calls made and email correspondence over the course of the year regarding the progress of the alliance and to make plans for upcoming meetings.

    Training and Education

    • Events

      The second annual Construction Safety Initiative was held on February 11, 2014 at Cuyahoga Community College, Corporate College facility. This day-long event was developed jointly between all members of the alliance. It was again, a very successful event for local construction companies, superintendents, foremen, workers and other individuals within the Cleveland OSHA office jurisdiction. There were approximately 250 attendees. The content of the training included a variety of topics addressing the most hazardous areas in construction including falls, ladder safety, and power tools, cranes and confined spaces. Two keynote presentations were given, one by the Toledo OSHA Area Director on jobsite inspections and the other by a motivational speaker on the importance of safety training. Many vendors were onsite to offer their services from personal protection equipment to health and wellness programs. The feedback received from the attendees was very positive, most requesting to have a 3rd annual event next year.

      Another very successful event that was held nationwide was "OSHA's Fall Safety Stand Down Campaign." Throughout the week-long Stand-Down (June 2-6), employers and workers paused during their workday to focus on the hazards of falls and how to prevent them from occurring. Industry and business leaders, including universities, labor organizations, construction companies, and community and faith-based groups, had scheduled stand-downs in all 50 states and across the world. Locally, in the Cleveland area, OSHA participated with three construction companies in their training activities, all relating to the subject of fall protection. All of the companies had been a part of the alliance membership at some point during the past three years. All of the workers at the sites were represented by the local union building trades.

    • Products

      Through the alliance membership, the Job Safety Analysis form that was specifically developed to target the operations that are found on construction sites continued to be utilized this year as well. The focus is on the potential hazards that could occur and necessary personal protective equipment to protect the worker. Each task is analyzed to assure the worker is knowledgeable to complete the job. Training on the JSA form was incorporated into the local OSHA 30 hour classes being taught to construction workers, reaching over several hundred individuals.

      On a monthly basis the local construction safety council has meetings that are designed around the needs of construction companies regarding improving safety and health on their jobsites. In conjunction with the local OSHA office, the area director and/or compliance officer would routinely speak at the meetings to update the audience on the latest topics relating to OSHA, enforcement, and the construction industry. One of the topics presented by the local OSHA office this year was on the OSHA recordkeeping standard requirements, where over 150 employers attended.

    • Handouts, pamphlets, and other products have been provided to safety council attendees. Especially critical were pamphlets and posters related to OSHA's heat and fall prevention campaigns.

    • The subject of silicosis prevention for construction workers remains a high priority for the members of the safety forum. Areas include health hazards created by silica dust and the need to develop an awareness (education), medical monitoring and respirator program. The purpose of the Monitoring, Awareness and Respirator Safety ("MARS") Program is to help facilitate the employers' efforts to provide a safe, healthy work environment for employees. Today, the MARS program has been implemented in the local unions for the cement masons as well as the laborers, covering over 200 employees.

    • Products

      Delivery of monthly Safety Newsletters to local construction companies. Over 5,000 companies and individuals receive the hard copy document that covered a variety of safety and health topics designed for construction businesses.

      On the date of the alliance renewal signing, all signatories participated in a video-taping sponsored by the Construction Employers Association (CEA) which will be placed on their website. The intent was to describe the merits of working together collaboratively through the formality of the alliance to make advances in the safety and health of the workers in the local construction industry.

  4. Results

    The successful second year of this alliance has resulted in educating construction companies and individuals on the prevention of workplace hazards, OSHA regulations and methods for creating and maintaining safety and health programs. This alliance has been instrumental in furthering the relationship between OSHA and the construction industry of Northeast Ohio, and therefore, all parties agreed to renew it for two additional years.

  5. Upcoming Milestones

    The major planned activity for the alliance is the 3rd annual Construction Safety Day currently being discussed for February 2015. The 1st and 2nd annual events were very successful day-long conferences for local construction companies, superintendents, foremen and workers. There were approximately 250 attendees each year.

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA), Chicago Regional Office (Region V) and the Consulate General of Ecuador in Chicago (the Consulate), hereinafter referred to individually as "Participant" and collectively as "the Participants";

Recognizing the joint commitment to protect the well-being of Ecuadorian workers in the United States acknowledged in the Letter of Arrangement between the Occupational Safety and Health Administration of the United States of America and the Ministry of Foreign Affairs, Commerce and Integration of Ecuador, signed at Washington, D.C., on August 26th, 2016; and

Recognizing that OSHA's Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;

Intend to form an Alliance to achieve the following:

Overall Objective

The Participants intend to establish a collaborative relationship to provide Ecuadorian nationals in Chicago and the Participants' common jurisdiction and others, information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Ecuadorian workers and Ecuadoran employers in Chicago and the Participants' common jurisdiction regarding workplace safety and health.
  • To develop training and education programs for Ecuadorian workers and employers in Chicago and the Participants' common jurisdiction to promote understanding of workers' rights and responsibilities of employers, including the use of the OSHA complaint process.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate's Web site) to Ecuadorian nationals working in Chicago and the Participants' common jurisdiction and their employers.
  • To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events.
  • To participate in "Mobile Consulate" activities and events.

Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a national dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights under the OSH Act whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Ecuadorian nationals working in Chicago and the Participants' common jurisdiction to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers' rights and responsibilities of employers under the OSH Act.
  • To share information on U.S. laws and standards, including those relating to workers' rights and responsibilities of employers under the OSH Act.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This Arrangement is intended to discontinue two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advance written notice of its intent to discontinue its participation in this Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

    1. The Alliance with the Mexican Consulate in Detroit, Michigan has opened opportunities to communicate and provide education and resources for under-served and oftentimes, a difficult to reach group of workers.  The Alliance has been successful in having stakeholders attend meetings and mobile education events to promote the safety and health of the worker, in addition to educating workers on whistleblower protection activities.
