AGREEMENT RENEWING AN ALLIANCE

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Cleveland Area Office and The Cleveland Safety Forum continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and The Cleveland Safety Forum hereby renew the Alliance signed May 23, 2014 and renewed June 6, 2016, with a continued emphasis on hazards that affect the health and safety of construction workers. Specifically, both organizations are committed to providing The Cleveland Safety Forum members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address safety and health hazards including falls, electrical, struck-by, caught in or between, confined space, and air contaminants such as silica and carbon monoxide.

This renewal agreement provides a framework and objectives for the Alliance’s activities. Alliance participants will summarize specific activities and timeframes for completion in a written work plan.

Through the Alliance, the organizations will use relevant injury, illness, and hazard exposure data when appropriate to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options to evaluate the effectiveness of the Alliance and measure the impact of its overall effort on improving workplace safety for employers and workers. In renewing this Alliance, OSHA and The Cleveland Safety Forum recognize that OSHA’s State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness of OSHA's Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve and following goal related to raising awareness of OSHA's rule making and enforcement initiatives:

  • To share information on OSHA's National/Regional/Local Emphasis Programs, regulatory agenda, and provide opportunities to participate in the rulemaking process.
  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.

Training and Education

The Participants intend to work together to achieve the following training and education objectives:

  • To develop effective training and education programs for the local construction industry regarding construction hazards such as falls, silica exposure, electrical, and caught in or between hazards, and to communicate such information to constituent employers and workers.
  • To develop effective training and education programs for the local construction industry to promote understanding of workers’ rights, and the responsibilities of employers and to communicate such information to workers and employers.
  • To deliver or arrange for the delivery of seminars on construction related topics aimed at reducing workplace hazard, including training workers on the new silica standard and revised standards, industry best practices, as well as the new confined space standard.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication objectives:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA’s Web site) to employers and workers in the construction industry.
  • To speak, exhibit, or appear at OSHA’s or The Safety Forum local meetings, or training events, such as the OSHA Outreach Trainers and Construction Safety Council of Northeast Ohio meetings to share information among OSHA personnel and industry safety and health professionals. Topics may include best practices or effective approaches through training programs, workshops, seminars and lectures developed by participants.
  • To share information among OSHA personnel and industry safety and health professionals regarding The Safety Forum’s good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by the participants.
  • To develop and disseminate literature on occupational hazards in the construction industry, including, but not limited to falls, electrical, caught in or between, confined space and silica exposures.

OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party’s products or services.

An implementation team made up of representatives of each organization will meet to develop a work plan, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Cleveland OSHA Office. OSHA will encourage State Plan States’ and OSHA On-site Consultation Projects’ participation on the team.

This agreement will remain in effect for five years. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the written concurrence of all signatories.

  5. Upcoming Milestones

    The Alliance is due for renewal in November 2018. Discussions between representatives of both parties have detailed the extreme success of this Alliance, and we foresee that both parties will support its renewal. This has been an extremely effective Alliance over multiple renewals, and the Agency should pursue continuing the Alliance going forward.

    The purpose of this Alliance is to establish a collaborative relationship to provide Mexican Nationals in Illinois and Wisconsin with information, guidance and access to education and training resources to promote worker safety and health. Additionally, the alliance aims at helping workers understand the rights of workers and responsibilities of employers under the Occupational Safety and Health Act.

    Planning Meetings were held on May 28, July 9, and August 24, 2015 to plan and organize the worker rights week in late August and early September. A follow-up meeting is held following the labor rights week to discuss the successes/shortcomings of the worker rights week held in August/September and to plan for future events.

    • Training and Education:

      • Outreach presentations have been held at various locations for workers from the Hispanic community in Spanish informing them of the employee rights under the Occupational Safety and Health Act. Information was also provided about OSHA and employer responsibilities under the OSH Act.

      • Presentations in Spanish were held during the labor rights week informing Spanish speaking employees of their rights and employer responsibilities.

    • Outreach and Communication:

      • During labor rights week- August 31- September 4, 2014 outreach events were held at various locations including, the Mexican Consulate in Chicago, mobile consulate locations, community centers, churches, schools, etc. During the events, Spanish speaking OSHA personnel manned an OSHA booth, handed out Spanish publications and answered questions. The worker rights week was attended by a large number of Spanish speaking workers and was very well received.

      • Guest appearance were made at two Spanish radio stations, Radio Claret America and Radio LaBamba by Spanish speaking compliance officers. Compliance officers answered questions related to workers’ rights under OSHA.

    • Promotion of National Dialogue:

      • The Alliance helped establish a cooperative relationship with the Mexican Consulate in Chicago.

      • Training and outreach activities organized as a result of the Alliance increased awareness and helped educate Spanish speaking employees about workers rights under OSHA.

    Primary goals of the Alliance are to strengthen the relationship with the Operating Engineers - Local 150, participate in training sessions and work on special training projects that are mutually beneficial to all participants.

    Alliance Activity

    The foundation of the Alliance is OSHA’s participation in training sessions and the OSHA 10-Hour program established by Local 150. Alliance activities were previously expanded to include an OSHA topic at the annual HAZWOPER refresher training offered through Local 150. Local 150 also permits the use of their facility for crane courses through OSHA’s Training Institute (OTI).

    Each session included a Q / A session between Local 150 attendees and OSHA personnel. Two CSHOs attended the HAZWOPER training to satisfy their annual refresher training requirement.

    Additional projects included a 40 Hour HAZWOPER course for the Region 5 Emergency Response Team and a crane training course for CSHOs. The reviews for both of these courses were excellent. It was noted that the HAZWOPER session included exercises while the participants were dressed in "Level A" suits.

    As indicated in prior evaluations of this Alliance, the value of this type of cooperative action, especially with the limited availability of these resources to OSHA, can not be overstated.

    Alliance Products

    Training materials used in 2011 include the handouts for the two courses reference above. These materials were assembled by Local 150 especially for these training sessions. Previous training products developed through the Alliance include the Power Point and webinar material used in the Quick Coupler training and the material provided during the Tower Crane training.

  4. Results

    This Alliance has been very successful in continuing the strong relationship between OSHA and Local 150. This Alliance should be considered a major success, and the cooperation of Local 150 should be commended.

  5. Upcoming Milestones

    As mentioned in last year’s report, Local 150 is installing Wind Farm equipment at their facility to train their members on proper installation and maintenance techniques. These will be available to train CSHOs on the hazards associated with this equipment.

THE CLEVELAND SAFETY FORUM

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA), and The Cleveland Safety Forum continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and The Cleveland Safety Forum hereby renew the Alliance signed June 19, 2012, with a continued emphasis on providing Safety Forum members and others with information, guidance, and access to training resources that will help them protect the health and safety of construction workers. Through the Alliance, the organizations will continue to address occupational topics including, but not limited to crane regulations, fall protection, silica exposure, training and education in hazard recognition and control in the construction industry, and the rights and responsibilities of workers and employers under the Occupational Safety and Health Act (OSH Act). In renewing this Alliance, OSHA and The Cleveland Safety Forum recognize that OSHA's State Plan and On-Site Consultation Project partners are an integral part of the OSHA national effort.

Raising Awareness of OSHA's Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve and following goal related to raising awareness of OSHA's rule making and enforcement initiatives:

  • To share information on OSHA's National/Regional/Local Emphasis Programs, regulatory agenda, and provide opportunities to participate in the rulemaking process.

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop effective training and education programs in conjunction with OSHA personnel, construction industry workers, and management to promote understanding of workers' rights. These include the use of the OSHA complaint process and responsibilities of employers to communicate such information to workers.
  • To encourage worker participation in workplace safety and health by providing training methods in job hazard awareness and eliminating those hazards by utilizing job hazard analysis (JHA) forms.
  • To deliver or arrange for the delivery of silica training, crane education, JHA's, hazard recognition, and the encouragement of worker participation in workplace safety and health.
  • Conduct seminars aimed at reducing workplace hazards, including training workers on new and revised standards and industry best practices.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To speak, exhibit, or appear at The Safety Forum, local meetings, or training events, such as the OSHA Outreach Trainers and Construction Safety Council of Northeast Ohio meetings to share information among OSHA personnel and industry safety and health professionals. Topics may include best practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by participants.
  • To develop ways of communicating information (e.g., print and electronic media, electronic assistance tools, including OSHA's web site) to employers and workers in the industry.
  • To develop and disseminate literature on occupational hazards in the construction industry including, but not limited to crane regulations, fall hazards and silica exposures.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will meet to develop a plan of action, determine working procedures and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Cleveland OSHA Office.

    In January 2010, it will be time to renew the Alliance. We hope to continue supporting the Council’s COSS class and their OSHA 30 hour classes, when requested. The Area Director will continue to provide an annual OSHA Update to members of the Safety Council, and will continue to sit on the Safety Council’s Board of Directors. The Safety Council will continue to include safety and health highlights and information in their monthly newsletter which goes out to 1,000+ members and will continue to distribute OSHA information via their membership email distribution list.

    • OSHA and WITC support the RISC (Regional Indianhead Safety Council) which reorganized in 2012. OSHA presented and WITC hosted the meeting.
    • Eau Claire OSHA office loaned noise dosimeters to get time-weighted averages for various shops at the different campuses.

ARRANGEMENT ESTABLISHING AN ALLIANCE BETWEEN
THE U.S. DEPARTMENT OF LABOR'S
OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION,
ILLINOIS AND WISCONSIN AREA OFFICES
AND THE
CONSULATE GENERAL OF MEXICO IN CHICAGO


The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA), Illinois and Wisconsin Area Offices and the Consulate General of Mexico in Chicago (the Consulate), hereinafter referred to collectively as "the Participants,"

RECOGNIZING the joint commitment to protect workers' rights for Mexican workers in the United States acknowledged in the Letter of Arrangement between the Occupational Safety and Health Administration of the United States of America and the Ministry of Foreign Affairs of the United Mexican States, signed at Washington, D.C., on June 1st, 2010; and

RECOGNIZING that OSHA's Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;

Intend to form an Alliance to achieve the following:

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican nationals in Illinois and Wisconsin counties within the circumscription of the Consulate (Hereinafter "the Consulate's circumscription") information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act.

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and employers in the Consulate's circumscription regarding workplace safety and health, and to communicate such information to constituent employers and workers.
  • To develop training and education programs for Mexican workers and Mexican employers in the Consulate circumscription to promote understanding of workers' rights and responsibilities of employers, including the use of the OSHA complaint process, and to communicate such information to employers and workers.
Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate Web site) to Mexican nationals working in the Consulate's circumscription and their employers.
  • To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events.
  • To participate in "Mobile Consulate" activities and events.
Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican nationals working in the Consulate's circumscription to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers' rights and responsibilities of employers.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

This Arrangement is indented to cease for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time with the concurrence of the Participants.

  1. Alliance Background

    Alliance Overview.

    The Safety Council of Northwest Ohio Alliance utilizes collective expertise to help foster a culture of prevention while sharing best practices and technical knowledge.

    Goals of the Alliance include:

    Training and Education
    • Develop training and education programs on injury/accident prevention; implementation of safety and health management systems; incident/accident investigation & analysis; safety, health & environmental auditing/inspections/evaluations; job safety analysis; regulatory compliance management; process safety management; safety performance management; transportation safety management; safety and evacuation plans; hazard recognition, evaluation, analysis & control; ergonomics; emergency preparedness; first aid; Cardiopulmonary Resuscitation (CPR); Automated External Defibrillator (AED); workplace violence; avoidance and reduction of traffic collisions; and safety/prevention issues targeted for employer and employee awareness;
    • Deliver or arrange for the delivery of safety awareness, prevention, management, and compliance courses;
    • Develop workplace safety and health curricula;
    • Increase awareness of available OSHA and SCNWO resources.
    Outreach and Communication
    • Develop and disseminate information at conferences, events, or through print and electronic media, including links from OSHA’s and SCNWO’s Web sites;
    • Speak, exhibit, or appear at conferences, local meetings, or other events;
    • The Safety Council placed a direct link to OSHA’s website on their web page, www.scnwo.org.

  4. Results
    1. The OSHA/Safety Council of Northwest Ohio Alliance provided an opportunity to increase the safety and health knowledge of safety council members in Northwest Ohio. OSHA personnel provide current occupational safety and health information to the Council who in turn distribute to their membership either via email or newsletter venues.

    3. Open Communication continues between the Safety Council of Northwest Ohio and the Toledo OSHA office.
       
  5. Upcoming Milestones

    OSHA hopes to continue supporting the Council’s COSS class and their OSHA 30-hour classes, when requested. The Area Director will continue to provide an annual OSHA Update to members of the Safety Council, and will continue to sit on the Safety Council’s Board of Directors.

    The Safety Council will continue to include safety and health highlights and information in their monthly newsletter which goes out to 1,000+ members and will continue to distribute OSHA information via their membership email distribution list.

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican Nationals in Illinois and Wisconsin with information, guidance, and access to education and training resources to promote workers’ rights in protecting their occupational health and safety, particularly with regards to reducing and preventing exposure to safety hazards and/or addressing health issues, and to help them understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act.

Training and Education

The Participants intend to work together to achieve the following training and education goals

  • To develop training and education programs for Mexican Nationals in Illinois and Wisconsin regarding safety and health issues in general industry and construction, including unguarded or inadequately guarded machinery, the unexpected energization of machinery during maintenance, exposure to hazardous chemicals, and falls from elevated work surfaces, and to communicate such information to constituent employers and workers.
     
  • To deliver or arrange for the delivery of safety and health courses.
     
  • To develop workplace safety and health curricula on hazards faced by Mexican Nationals in Illinois and Wisconsin.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA’s Web site from the Consulate’s Web site) to Mexican Nationals in Illinois and Wisconsin and their employers.
     
  • To speak, exhibit, or appear at OSHA’s or the Consulate’s conferences, local meetings, or other events, such as Labor Week, Health Week, and Labor Window.

In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.
