AGC Greater Milwaukee Partnership Promotes Safety and Health in the Construction Industry


Background:

In May 2009, The Associated General Contractors (AGC) of Greater Milwaukee and Wisconsin Onsite Consultation Program (WisCon) formed an OSHA Strategic Partnership (OSP) to help reduce occupational-related fatalities and serious injuries within the construction industry, effectively implement all facets of jobsite safety, and achieve self-compliance through cooperative efforts. Fifteen employer participants participate in the OSP which covers approximately 800 workers. The planned end date of the OSP is May 2012.

    Alliance Overview

    Primary goals of the Alliance are to strengthen the relationship with the Operating Engineers - Local 150, participate in training sessions and work on special training projects that are mutually beneficial to all participants.

    The Alliance includes participation by all the OSHA offices in Illinois.

    Implementation team meetings are conducted by conference calls and e-mails regarding various projects and alliance activities. A meeting was held in October 2016 to meet the new facility director and go over future planning regarding the Alliance.

    This report summaries activities through the Alliance and includes activities since the report of September, 2015.

    Alliance Activity

    The foundation of the Alliance is OSHA’s participation in training sessions and the OSHA 10 & 30 hour programs established by Local 150. Alliance activities also included Local 150 providing HAZWOPER and/or HAZWOPER Refresher courses to OSHA personnel. Local 150 also works with the OSHA Training Institute (OTI) on conducting the Cranes & Rigging (#2050), Cranes and Materials Handling for General Industry (#2080), Trenching and Shoring (#3010) and Concrete Forms & Shoring (#3030) courses. These courses are held at the ASIP training facility in Wilmington, IL.

    The sessions marked with an “*” notes OSHA 10 Hour courses offered through Local 150 for High School teachers specializing in vocational programs and students in these programs. This represented a very unique opportunity for educators and students to obtain an OSHA 10-Hour card and for OSHA to interact with this audience.

    The sessions marked with an “**” were OSHA 30 Hour courses.

    Each session included a Q / A session between Local 150 attendees and OSHA personnel.

    Region V employees attended 40 hour HAZWOPER training courses and HAZWOPER refresher courses to satisfy their annual refresher training requirement.

    An Illinois Construction Consistency meeting was held at the training site in June of 2016. This meeting included training on trench measurement techniques and shoring options. For this training Local 150 ASIP dug multiple trenches in their indoor arena to assist Compliance staff measuring techniques and abatement options.

    Local 150 worked with the Regional Office and conducted a series of Crane Training courses for Region V employees.

    As indicated in prior evaluations of this Alliance, the value of this type of cooperative action, especially with the limited availability of these resources to OSHA, can not be overstated.

    Alliance Products

    Training materials used in 2016 included the handouts for the OSHA 10 Hour, OSHA 30 Hour, HAZWOPER and HAZWOPER refresher courses reference above. These materials were assembled by Local 150 and OSHA especially for these training sessions. Previous training products developed through the Alliance include the Power Point and webinar material used in the Quick Coupler training and the material provided during the Tower Crane training.

  4. Results

    This Alliance has been very successful in continuing the strong relationship between OSHA and Local 150. This Alliance should be considered a major success, and the cooperation of Local 150 should be commended.

  5. Upcoming Milestones

    Local 150 Apprenticeship and Skill Improvement Program (ASIP) will continue to provide HAZWOPER Refresher Training for OSHA personnel, as well as work with the OSHA Training Institute on Crane Courses. OSHA will provide speakers for the OSHA 10 and 30 hour courses.

    OSHA and ASIP will met at the end of Fiscal Year 2016 to discuss future products that may be developed as part of the Alliance, as well as training sessions that will be conducted in FY17. Meeting will also be conducted throughout FY17 to discuss the Alliance.

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Toledo, Cleveland and Lansing Area Office and the Consulate of Mexico in Detroit (the Consulate), hereinafter referred to collectively as "the Participants;"

RECOGNIZING the joint commitment to protect workers' rights for Mexican workers in the United States acknowledged in the Letter of Arrangement between the Occupational Safety and Health Administration of the United States of America and the Ministry of Foreign Affairs of the United Mexican States, signed at Washington, D.C., on November 6, 2014; and

RECOGNIZING that OSHA's Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;

Intend to form an Alliance to achieve the following:

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican Nationals in Michigan and Ohio and others information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the Occupational Safety and Health Act (OSH Act).

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in Michigan and Ohio regarding workplace safety and health.
  • To develop training and education programs for Mexican workers and Mexican employers in Michigan and Ohio to promote understanding of workers' rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate's Web site) to Mexican Nationals working in Michigan and Ohio and their employers.
  • To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events.
  • To participate in "Mobile Consulate" activities and events.

Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights under the OSH Act whenever leaders from the Participants address groups.
  • To convene or participate In forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in Michigan and Ohio to help forge Innovative solutions on issues concerning workplace safety and health and understanding of workers' rights and responsibilities of employers under the OSH Act.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This arrangement may continue for (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of Its Intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Cleveland Office and The Cleveland Safety Forum recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and the Cleveland Safety Forum hereby form an Alliance to provide the Cleveland Safety Forum members and others with information, guidance, and access to training resources that will help them protect the health and safety of construction workers. The Cleveland Safety Forum includes a group of union contractors and union training coordinators. Established in 2011, the group coordinates the safety and health needs of their members, identifies best practices in the construction industry and promotes the availability of training opportunities. The Alliance will address occupational topics including, but not limited to crane regulations, fall protection, silica exposure and education, training in hazard recognition and control in the construction industry, and the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). In developing this Alliance, OSHA and the Cleveland Safety Forum recognize that OSHA's State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort.

Raising Awareness of OSHA's Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve the following goals related to raising awareness of OSHA's rulemaking and enforcement initiatives:

  • To share information on OSHA's National/Regional/Local Emphasis Programs, regulatory agenda, and provide opportunities to participate in the rulemaking process.

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop effective training and education programs in conjunction with OSHA personnel, construction industry workers, and management to promote understanding of workers' rights. These include the use of the OSHA complaint process, and responsibilities of employers to communicate such information to workers.
  • To encourage worker participation in workplace safety and health by providing training methods in job hazard awareness and eliminating those hazards by utilizing the job hazard analysis (JHA) form.
  • To deliver or arrange for the delivery of silica training, crane education, job hazard analysis method, hazard recognition, and the encouragement of worker participation in the workplace.
  • Conduct seminars aimed at reducing workplace hazards, including training workers on new and revised standards and industry best practices.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To speak, exhibit, or appear at The Safety Forum, local meetings, or training events, such as the OSHA Outreach Trainers and Construction Safety Council of Northeast Ohio meetings to share information among OSHA personnel and industry safety and health professionals. Topics may include best practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by the participants.
  • To develop ways of communicating information (e.g., print and electronic media, electronic assistance tools, including OSHA's web site) to employers and workers in the industry.
  • To develop and disseminate literature on occupational hazards in the construction industry including, but not limited to crane regulations, fall hazards, silica exposure.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Cleveland OSHA Office and any other appropriate offices. OSHA will encourage State Plan States' and OSHA On-site Consultation Projects' participation on the team.

This agreement will remain in effect for two years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the written concurrence of both signatories.

    • The 2015 Safety Day is September 17, 2015 with the topic OSHA Region V fatality statistics, Chicago North Area Office fatalities and accidents, OSHA regulatory update, Confined Space in Construction and Confined Space and Fall rescue.
    • Joint seminar by OSHA/ LCCA/LCBTC highlighting hazards in construction to be presented at Plumbers Union Local 130, Volo, IL
    • Participate in National Safety Stand Down to Prevent Falls in Construction in 2016
    • 2016 Safety Awards dinner and OSHA presentation

Agreement Establishing an Alliance

The Occupational Safety and Health Administration (OSHA), Eau Claire, Wisconsin Area Office, and the Chippewa Valley Technical College (CVTC) recognize the value of establishing a collaborative relationship to support workplace safety and reduce hazards and associated losses.

OSHA and CVTC agree to form an Alliance to provide staff, outside employers, and members of our community with information, guidance, and access to training and related resources that will help promote and improve employee health and safety. In developing this Alliance, OSHA and CVTC recognize the Eau Claire, Wisconsin OSHA Area Office as playing an integral role in the agency's national efforts.

OSHA and CVTC will work together to achieve the following training and education goals:

  1. Develop training programs and written materials focusing on relevant health and safety issues, designed to improve technical knowledge and educational skills to students enrolled in CVTC programs, as well as students and staff within the Wisconsin Technical College system.
     
  2. Deliver or arrange for the presentation of courses such as OSHA 10 and 30 hour classes for employees, supervisors and management working in the CVTC district and areas covered by this alliance.
     
  3. Develop workplace safety and health curricula in the specific areas of interest to the partners, as well as training in other areas that may become apparent during the course of this alliance.
     
  4. Cross-train OSHA and CVTC personnel with best practices or effective approaches.

OSHA and CVTC will work together to achieve the following outreach and communication goals:

  1. Develop and disseminate information through print and electronic media (such as Internet or Web-based links from OSHA and CVTC.)
     
  2. Speak, exhibit, or appear at conferences, workshops, symposiums, local meetings, or other events.

OSHA and CVTC will work to achieve the following goals related to promoting the national dialogue on workplace safety and health, including the following areas:

  1. Raise awareness of and demonstrate a commitment to workplace safety and health.
     
  2. Focus on risk control, hazard identification, mitigation and correction.
     
  3. Develop and communicate results from case studies or actual events, illustrating the value of safety and health.
     
  4. Convene or participate in forums, round table discussions, or stakeholder meetings on safety and health issues to help forge innovative solutions in the workplace or to provide input on safety and health issues.
     
  5. Promote and encourage participation in OSHA's cooperative programs such as compliance assistance, the Voluntary Protection Program, Consultation, and the Safety and Health Achievement Recognition Program.
     
  6. Share information on best practices with companies and organizations in the CVTC district, and publicize the results through outreach training programs and materials.
     
  7. Work with other alliance participants on specific issues and projects as they relate to education and safety and are addressed and developed through the alliance program.
     
  8. Encourage CVTC degree and certification programs to build positive relationships with OSHA's Area Offices regarding health and safety issues.

OSHA alliances provide an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes including training and education, outreach and communication, promoting a national dialogue on workplace safety and health. These alliances have proven to be valuable tools for both OSHA and its alliance participants. By entering into this alliance, OSHA is not endorsing the College's products or services.

An implementation team made up of representatives from OSHA and CVTC will meet to develop action plans, determine operating procedures, and identify roles and responsibilities. Quarterly or more frequent meetings will be held to share information on activities and evaluate the results from the cooperative endeavors.

This agreement will remain in effect for three years. Either organization may withdraw from the agreement at any time, provided they give 30 days written notice. This agreement may be modified with the concurrence of both organizations.

Las Oficinas las Áreas de Illinois y Wisconsin de la Administración de Seguridad y Salud Ocupacionales (OSHA) del Departamento del Trabajo de los Estados Unidos de América y el Consulado General de México en Chicago (el Consulado), en adelante denominados conjuntamente "los Participantes";

RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores mexicanos en los Estados Unidos, reconocidos en la Carta de Arreglo entre la Administración de Seguridad y Salud Ocupacionales del Departamento del Trabajo de los Estados Unidos de América y la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos, firmada en Washington, D.C., el 1° de junio de 2010; y

RECONOCIENDO que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente:

Objetivo General

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos en los condados de Illinois y Wisconsin que se encuentren dentro de la circunscripción del Consulado (en adelante "la circunscripción del Consulado") información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de los Estados Unidos de América sobre los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en la circunscripción del Consulado sobre la seguridad y la salud en el lugar de trabajo, y comunicar dicha información a los empleadores y trabajadores en cuestión.
  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en la circunscripción del Consulado a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores, incluyendo el uso del procedimiento de quejas de OSHA, y comunicar dicha información a los empleadores y trabajadores.
Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado, a los nacionales mexicanos que trabajan en la circunscripción del Consulado y a sus empleadores.
  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del "Consulado Móvil".
Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan en la circunscripción del Consulado para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento los derechos de los trabajadores y las responsabilidades de los empleadores.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Se tiene la intención de que el Arreglo cese a los dos (2) años de la fecha de suscripción. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

    3. Overview:

      The Alliance with the Consulate General of Ecuador was established to facilitate fostering cooperative relationships for such purposes as, training and education, outreach and communication, and promoting a national dialogue on workplace safety and health.

      The Participants intentions are to establish a collaborative relationship to provide Ecuadorian workers information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

  2. Implementation Team Meetings

     

    • An in person meeting was held on August 12, 2017. Participants: Andres Saldana, Regional Safety & Health Manager and Catalina Landivar, Vice Consul of Ecuador. The group reviewed the outcome of the collaboration since the Alliance was signed, and discussed opportunities to build on the work done.

     

  3. Activities and Products

    Training and Education

    • Contacts established with Region V Susan Harwood Grantees allowed the Consulate of Ecuador to host two training sessions on safety in the workplace and employer--employees' rights and responsibilities:
      • February 11 & 12: OSHA 10 Training for Construction and Landscaping Workers.
    • The Consulate of Ecuador hosted labor rights fairs on August 29th and September 13th.
      • During these fairs, Facebook Live was used to promote workers' rights and resources and reach out to a larger audience. Topics covered were: what are labor rights, what to do in case workers' rights are violated, the importance of labor unions, who to contact. These videos reached 1000 viewers, and the videos continue to be seen.
    • The Chicago Regional Office and Vice Consul of Ecuador continue to participate in several worker rights roundtable discussions on developing and implementing strategies to connect more effectively various federal and state agencies with vulnerable workers.

    Outreach and Communication

    • The Chicago Regional office and Chicago North Area office attended a consular outreach service that was hosted by the Consulate of Ecuador in Chicago. The event was held on August 29, 2017 at the Consulate of Ecuador Annex located in the area of Albany Park in Chicago, Illinois. The Chicago North Area Office Compliance Safety and Health Officer spoke to a group of approximately 100 Ecuadorian and Ecuadorian Americans, regarding the OSH Act, employer/employees' rights and responsibilities, as well as OSHA's functions and services. Additionally, the Compliance Safety and Health Officer provided consular outreach service attendees with OSHA Quick Cards and Fact Sheets, and answered the attendees' questions.
    • The Chicago Regional office and whistleblower department attended a consular outreach radio station interview that was hosted by the Consulate of Ecuador in Chicago. The interviews were held on September 7 & 14, 2017 which presented information about employer/employees' rights and responsibilities as well as whistleblower worker protection rights. Both events were streamed on social media as well as over the air Spanish public radio. The information was able to reach thousands of Spanish speakers through the US, Central and South America and Europe and Mexico. It's expected that more than 3000 people were reached through this communication tool.
    • OSHA trainings hosted by Union Latina de Chicago in other places than the Consulate, where promoted on Facebook.
    • The Consulate of Ecuador sponsored ARISE Chicago's publication on Workers' Rights Resources Manual in Spanish.

    Promoting the National Dialogue on Safety and Health

    • The Chicago Assistant Regional Administrator and Program Manager attended a consular outreach service, and ceremony for the 208th anniversary of the Declaration of Ecuador Independence on August 10, 2017.
  4. Results

    • Through the joint efforts of the Alliance, the Consulate General of Ecuador now has greater access to OSHA outreach information and publications for the Ecuadorian workers in Region V; while OSHA Region V has gained access to a previously untapped channel of outreach and communication with workers in the seven-state jurisdiction of the Consulate of Ecuador.
    • OSHA's continued efforts to reach at-risk workers remains a paramount goal.
    • The Regional Office, in conjunction with the Consulate, developed a directory of the most commonly contacted federal and state agencies within the OSHA regional jurisdictions. The directory was developed for consular personnel and Ecuadorian nationals to use as reference tool for public services.
    • The Consulate of Ecuador's ability to provide assistance/referrals to those workers in need has greatly increased with this alliance, for example:
      • The regional office labor liaison was able to support the consulate with clarification of a fatality inspection for an Ecuadorian national who passed in a construction worksite in Delaware, Ohio. Follow-up contact with the Ohio workers compensation were also provided.
    • Those construction workers attending OSHA 10 trainings and Fall Prevention trainings are better prepared to identify unsafe work conditions, to know what are the workers' rights, and to know where to report.
    • Approximately 150 people have participated in the several OSHA trainings since 2014.
  5. Upcoming Milestones

    • The Alliance plans to reestablish its collaborative efforts to renew the Alliance.
    • A focus will be based on expanding outreach assistance to Ecuadorian nationals in other states, such as Ohio, Indiana, and Wisconsin.
    • Jointly continuing:
      • Promotion of occupational safety and health for the Ecuadorian community in Region V.
      • Participation in mobile consulate events.
      • Participation in consulate activities during the year.
      • Participation in outreach and education events

    Alliance Overview:

    The purpose of the alliance is to establish a collaborative relationship to support workplace safety and reduce hazards and associated losses. This Alliance targets staff, students, outside employers, and members of our community with information, guidance, and access to training and related resources that will help promote and improve employee health and safety.

    • CVTC instructional staff tailored a four hour “Introduction to Nanotechnology” training course for OSHA and WisCon personnel.

  4. Results
     
    • OSHA used CVTC’s facility for unique outreach opportunities at no cost.
    • OSHA personnel received an excellent training opportunity at no cost.
    • OSHA participated in the CVTC sponsored courses such as OSHA 10 and 30 hour courses without managing the logistics.
    • OSHA and CVTC have developed a broader network for future projects

  5. Upcoming Milestones
    • As a result of the “Nanotechnology” training session held in January, 2008:
      • OSHA and WisCon will work with the Nanotechnology program as they do with the UW- Madison Nanotechnology group to develop more networking between the groups.
      • The materials presented at this session could be developed into an Alliance Product to be shared.
    • OSHA will work more closely with the CVTC staff members to implement safe work practices into the curriculum for areas such as residential construction and health care services.
    • OSHA and CVTC will develop a day-long Fall Rescue Course – Aerial Lift Course.
    • CVTC will provide OSHA assistance in Powered Industrial Vehicle / Dock Safety through the driving school.
