AGREEMENT ESTABLISHING AN ALLIANCE

LEHIGH CONSTRUCTION GROUP, INC.


The Occupational Safety and Health Administration (OSHA) and Lehigh Construction Group, Inc. (Lehigh) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA and Lehigh hereby form an Alliance to use their collective expertise to help foster a culture of prevention while sharing best practices and technical knowledge.

OSHA and Lehigh agree to establish an Alliance to promote safe and healthful working conditions for future members of the construction industry by:

  • Providing high school and collegiate level construction students with information, guidance, and training. This training will help protect their health and safety and raise their awareness as to the value of safety in the construction career field.
  • Increasing access to, and sharing of, safety and health information and training resources.

OSHA and Lehigh will work together to achieve the following training and education goals:

  • Identify schools in the western New York area having curriculums associated with the building trades and develop safety and health training materials and programs for students in those curriculums. This training will include dissemination of and sharing of best practices, as jointly determined by Lehigh and OSHA, with construction students. The development and delivery of this training and education will serve to better prepare tomorrow's construction leaders and workers at both the high school and collegiate levels.
  • Promote the implementation of this training opportunity through print or electronic media, at conferences, or by other means of outreach.

OSHA and Lehigh will work together to achieve the following outreach and communication goals:

  • Seek opportunities to jointly develop and disseminate information at school job fairs, events, or through print and electronic media, including links from OSHA's and Lehigh's Web site.
  • Seek opportunities to speak, exhibit, or appear at school functions, student association meetings or other events.
  • Provide opportunities to cross-train OSHA personnel when construction management best practices and/or effective approaches are discussed in advanced courses at the collegiate level.

OSHA and Lehigh will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health:

  • Raise others' awareness of and demonstrate our commitment to workplace safety and health whenever Lehigh leaders address groups.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least quarterly to track and share information on activities and results in achieving the goals of the Alliance.

This agreement will remain in effect of one year. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of both signatories.

AGREEMENT RENEWING AN ALLIANCE BETWEEN

UNIVERSITY OF PUERTO RICO RIO PIEDRAS CAMPUS


The Occupational Safety and Health Administration (OSHA) and the Río Piedras Campus of the University of Puerto Rico recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA and the Río Piedras Campus of the University of Puerto Rico therefore agree to renew the Alliance, signed on January 22, 2004, to provide the Río Piedras Campus of the University of Puerto Rico with information, guidance, and access to training resources that will help them protect employees’ health and safety, particularly in reducing and preventing exposure to occupational health and safety hazards. In developing this Alliance, OSHA and the Río Piedras Campus of the University of Puerto Rico recognize that OSHA’s State Plan and Consultation Project partners are an integral part of the OSHA national effort.

OSHA and the Río Piedras Campus of the University of Puerto Rico, through the Division of Continuing Education and Professional Studies (DECEP for its Spanish acronym) and the Environmental Protection and Occupational Safety Office (OPASO for its Spanish acronym) will work together to achieve the following training and educational goals:

  • Work with OSHA to provide expertise to develop training and education programs on various safety and health issues and targeted to general, construction and maritime industries, employees, students and the general community.
     
  • Deliver or arrange for the delivery of occupational health and safety courses.
     
  • Work with OSHA to provide expertise to develop workplace safety and health curricula through the Certificate in Occupational Health and Safety of DECEP.

OSHA and the Río Piedras Campus of the University of Puerto Rico will work together to achieve the following outreach and communication goals:

  • Work with OSHA to provide expertise in developing information on the recognition and prevention of workplace hazards, and to provide expertise in developing ways of communicating such information (e.g. print and electronic media, electronic tools and OSHA’s and the Río Piedras Campus of the University of Puerto Rico Web sites) to employers and employees in the industry.
     
  • Speak, exhibit, or appear at the Río Piedras Campus of the University of Puerto Rico conferences, courses, workshops, local meetings, or other educational events.
     
  • Promote and encourage the Río Piedras Campus of the University of Puerto Rico employees and students participation in OSHA’s cooperative programs such as compliance assistance, the Voluntary Protection Programs, Consultation and its Safety and Health Achievement Recognition Program.
     
  • Share information among OSHA personnel and industry safety and health professional regarding the Río Piedras Campus of the University of Puerto Rico best practices or effective approaches and publicize the results through outreach by the Río Piedras Campus of the University of Puerto Rico and through OSHA or the Río Piedras Campus of the University of Puerto Rico developed materials, training, programs, workshop, seminars, and lectures.
     
  • Work with other Alliance participants on specific issues and projects on occupational health and safety issues that are addressed and developed through the Alliance Program.
     
  • Encourage OPASO and DECEP of the Río Piedras Campus of the University of Puerto Rico to build relationships with OSHA’s Regional and Area Offices to address health and safety issues.

OSHA and the Río Piedras Campus of the University of Puerto Rico will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health:

  • Raise others’ awareness of and demonstrate their own commitment to workplace safety and health whenever the Río Piedras Campus of the University of Puerto Rico leaders address groups.
     
  • Develop and disseminate case studies illustrating the business value of safety and health and publicize their results.
     
  • Convene or participate in forums, round table discussions, or stakeholder meetings on occupational health and safety issues to help forge innovative solutions in the workplace or to provide input on safety and health issues.

As part of this Agreement, both parties agree to comply with the following:

  • No employee and/or functionary of the University of Puerto Rico have direct or indirect pecuniary interest in the subscription of this agreement consistent with Law no. 12, of July 4, 1985, known as the Commonwealth of Puerto Rico Government Ethics Act. In the same way, the functionary who represents the precinct in this act does not have any kind of pecuniary interest in realizing the same.
     
  • The University of Puerto Rico – Río Piedras Campus agrees to keep reports, working assistance sheets, and other documents related with services object of this agreement, so they can be audited or copied by the Office of Internal Auditors of the University of Puerto Rico, by an external audit firm hired by the University of Puerto Rico, or by the Office of the Comptroller of Puerto Rico in their auditing procedures of the University of Puerto Rico. The audits will be made in reasonable dates during the course of the services or after rendering the same according to practices of audit generally known. Such documents will be kept for a period, no less than six (6) years or until an investigation by the Office of the Comptroller of Puerto Rico is made, whichever come first.
     
  • OSHA and the University of Puerto Rico - Rio Piedras Campus agree to comply with otherwise applicable Federal equal opportunity laws.

OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party’s products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party’s products or services.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Puerto Rico Area Office, the Puerto Rico Occupational Safety and Health Administration (PR OSHA), and the Río Piedras Campus of the University of Puerto Rico, through the Division of Continued Education and Professional Studies (DECEP, in Spanish), the Environmental Protection and Occupational Safety Office (OPASO, in Spanish) and the Institute of Labor Relationships (IR T, in Spanish) from the Faculty of Social Sciences, continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and PR OSHA, and the Río Piedras Campus of the University of Puerto Rico hereby renew the Alliance signed January 22, 2004 and renewed April 3, 2006, April 15, 2008, September 30, 2010, December 18, 2012 and December 17, 2014, with a continued emphasis on reducing and preventing exposure to occupational safety and health hazards. Specifically, each organization is committed to providing the Río Piedras Campus of the University of Puerto Rico members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address struck by, caught by, fall, electrocution, exposure to chemicals, and psychosocial (including workplace violence) hazards as well as emergency management issues, and legal aspects focused on employees' rights under the OSH Act. In renewing this Alliance, OSHA and the Río Piedras Campus of the University of Puerto Rico recognize that OSHA's State Plan and Consultation Division partners are an integral part of the OSHA national effort.

This renewal agreement provides a framework and objectives for the Alliance's activities. Alliance participants will summarize specific activities and timeframes for completion in a written work plan.

Through the Alliance, the organizations will use relevant injury, illness, and hazard exposure data when appropriate to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options to evaluate the effectiveness of the Alliance and measure the impact of its overall effort on improving workplace safety for employers and workers. In renewing this Alliance, OSHA and the Río Piedras Campus of the University of Puerto Rico recognize that OSHA' s State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness of OSHA' s Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve the following goals related to raising awareness of OSHA' s rulemaking and enforcement initiatives:

  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on construction, general and maritime industry hazards, including psychosocial hazards such as workplace violence, as well as emergency management issues, and legal aspects focused on employees' rights under the OSH Act, to help forge innovative solutions in the workplace or to provide input on safety and health issues.
  • To encourage worker participation in workplace safety and health by providing outreach, seminars, and courses where rulemaking and employees' right and responsibilities discussions are held.

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop effective training and education programs for employees, students and the general community regarding construction, general and maritime industry related hazards, and to communicate such information to constituent employers and workers.
  • To develop effective training and education programs for construction, general and maritime employees and employers to promote understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.
  • To deliver or arrange for the delivery of safety and health courses, seminars, and training sponsored by DECEP, IRT, and OPASO.
  • To share information among OSHA personnel and industry safety and health professionals regarding UPR' s best practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum) developed by the participants.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA's and the Río Piedras campus of the University of Puerto Rico's Web sites) to employers and workers in the industry.
  • To speak, exhibit, or appear at OSHA's or the Río Piedras Campus of the University of Puerto Rico's conferences, local meetings, or other educational events.
  • To work with other Alliance participants on specific issues and projects on construction, general and maritime industries, that are addressed and developed through the Alliance Program.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will meet to develop a work plan, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least two times per· year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Puerto Rico Area Office, and any other appropriate offices. PR OSHA team members will include representatives from the Consultation Division.

    CIAPR’s Continued Education Division, through this Alliance, continues to qualify training sessions offered by Regional Office Technical Support Safety Engineer as continued education. This allows the courses on safety and health topics to be taught to professional engineers (PE) and engineers-in-training (EIT), enhancing their awareness and knowledge of occupational hazards. CIAPR is also allowing EITs and PEs who attend safety and/or health seminars and courses outside the institutions to obtain CEUs, which can be credited towards their licenses’ CEUs.

    In addition, CIAPR has continued to make the courses and seminars offered by OSHA available to professionals outside the CIAPR, expanding the Agency’s outreach efforts throughout the various industries. Over 12,759 participants from the construction and general industries have attended safety and/or health courses, seminars, conferences, or speeches since the initial signing of this Alliance in September 2004.

  5. Upcoming Milestones

      • A 10-hour OSHA General Industry course was offered to employees of the Planning Board Union and the Independent Public Building Authority Employees Union on March 17 and 19, 2015. A total of 16 participants attended the course.
      • A 10-hour OSHA General Industry course was offered to the General Workers’ Union (UGT) employees on March 24 and 26, 2015. A total of 22 participants attended the course.
      • A 10-hour OSHA Construction Industry course was offered to employees of the Insular Union of Industrial and Electrical Construction Workers’, Inc. (UITICE) on April 11 and 18, 2015. A total of 18 participants attended the course.
      • A 30-hour OSHA Construction Industry course was offered to University of Puerto Rico employees (Molecular Sciences and Planning and Structural Development Office), on May 5, 7, 12, 14 and 21, 2015. A total of 17 participants attended the course.
      • A 10-hour OSHA General Industry course was offered to University of Puerto Rico, Rio Piedras Campus employees (HEEND) on June 2 and 4, 2015. A total of 14 participants attended the course.
      • A 10-hour OSHA General Industry course was offered to University of Puerto Rico, Rio Piedras Campus employees (Sindicato de Trabajadores UPR and HEEND) on September 14 and 15, 2015. A total of 24 participants attended the course.
      • A 10-hour OSHA General Industry course was offered to International Institute of Tropical Forestry and University of Puerto Rico, Medical Science Campus Environmental, Health and Safety employees on September 24 and 25, 2015. A total of 13 participants attended the course.
      • A 10-hour OSHA General Industry course was offered to University of Puerto Rico, Rio Piedras Campus employees (Sindicato de Trabajadores UPR and HEEND) on November 3 and 4, 2015. A total of 30 participants attended the course.
      • A 10-hour OSHA Construction Industry course was offered to University of Puerto Rico, Medical Science Campus employees on November 10 and 12, 2015. A total of 19 participants attended the course.
      • Prepared the new academic offerings for the Certificate in Occupational Health and Safety of DECEP courses to be offered from February to May 2016.

    Outreach and Communication

    Goal 1: To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g. print and electronic media, electronic assistance tools and OSHA’s, PR OSHA’s and the Río Piedras Campus of the University of Puerto Rico Web sites) to employers and employees in the industry.

    Goal 2: To speak, exhibit, or appear at OSHA’s, PR OSHA’s or the Río Piedras Campus of the University of Puerto Rico conferences, local meetings, or other educational events.

    Goal 3: To share information among OSHA and PR OSHA personnel and industry safety and health professional regarding the Río Piedras Campus of the University of Puerto Rico’s good practices or effective approaches through training programs, workshop, seminars, and lectures developed by the participants.

    Goal 4: To work with other Alliance participants on specific issues and projects on construction, general and maritime industries, that are addressed and developed through the Alliance Program.

    • Events
      • Prior to the Workers’ Memorial Day commemoration, a communication is prepared and sent to approximately 3,000 e-mail recipients throughout the Island to provide information on the importance and significance of this commemoration. Recipients are people from the academic community, stakeholders, and workers/employees from the general, construction, and maritime industries.
      • On April 28, 2015, a seminar on “Implementation of Puerto Rico Road Safety Strategic Plan 2014-2018” was offered to a total of 84 participants.
      • On June 25 and 26, 2015, participated in the PRMA Safety and Occupational Health Summit; over 130 participants attended this activity.
      • No products or resources have been developed to meet this Alliance goal.
      • Coordinated, planned and held the “6th Annual Safety, Occupational Health, and Environmental Conference of Puerto Rico: Integrity”. The Conference took place on October 1 and 2, 2015, at the Rio Piedras Campus of the University of Puerto Rico. A total of 476 participants attended this activity.
  4. Results

    The UPR-Río Piedras Campus continues to be instrumental in promoting awareness and prevention of hazards associated with the construction, general and maritime industries. Through OPASO, it has also been actively involved in reaching out to safety and health professionals in an effort to advance their knowledge and academic preparation in occupational safety and health issues. The integration of the Institute of Labor Relationships has been of great help to reach union and hard-to-reach workers.

    Overview

    The purposes of this alliance are to improve workplace safety and health for workers in Puerto Rico and provide members of the CIAPR and others with information, guidance and access to training resources that will help them protect employees’ health and safety, particularly in reducing and preventing exposure to hazards in the construction industry.

    1. Raising Awareness of OSHA’s Rulemaking and Enforcement Initiatives

       

      Goal 1: To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.

    3. Outreach and Communication

       

      Goal 1:To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information {e.g., print and electronic media, electronic assistance tools, and OSHA's and the CIAPR Web sites) to employers and workers in the industry.

        • Included several occupational safety and health articles in the CIAPR TecnoMundo e-newsletter. The e-newsletter is available through Internet to CIAPR members and the general public.

  4. Results

     

    CIAPR’s Continued Education Division, through this Alliance, continues to qualify training sessions offered by PRAO’s CAS as continued education. This allows the courses on safety and health topics to be taught to professional engineers (PE) and engineers-in-training (EIT), enhancing their awareness and knowledge of occupational hazards. CIAPR is also allowing EITs and PEs who attend safety and/or health seminars and courses outside the institutions to obtain CEUs, which can be credited against their licenses.

    In addition, CIAPR has continued to make the courses and seminars offered by PRAO available to professionals outside the CIAPR, expanding the Agency’s outreach efforts throughout the various industries. Over 6880 participants from the construction and general industries have attended safety and/or health topics since the initial signing of this Alliance in September 2004.

    1. To continue offering seminar/training sessions on construction and general industry safety and health related topics through Federal OSHA that would allow licensed engineers to enhance their occupational safety and health hazards awareness, at the same time they comply with the CIAPR license renewal law requirements concerning continued education contact-hours.

U.S. DEPARTMENT OF LABOR
AND
LEHIGH CONSTRUCTION GROUP, INC.


The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) and Lehigh Construction Group, Inc. (Lehigh) hereby renew their Alliance signed May 15, 2003 and renewed November 2, 2004 and again April 4, 2007. This renewal agreement fully incorporates all of the terms of the April 4, 2007 renewal agreement, which are continuing in nature.

OSHA and Lehigh continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful workplaces. OSHA and Lehigh remain committed to cooperative and proactive efforts to advance workplace safety and health especially by continuing to provide Lehigh members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers. Through the Alliance, the organizations will continue to address safety and health hazards in the construction industry to young and/or inexperienced workers. In renewing this Alliance, OSHA and Lehigh recognize that OSHA's State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party's products or services.

An implementation team made up of representatives of each organization will continue to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Buffalo Area Office and any other appropriate offices. OSHA will encourage State Plan States' and OSHA On-site Consultation Projects' participation on the team.

This agreement will remain in effect for two years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the written concurrence of both signatories.
