AGREEMENT RENEWING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR and the
SEALANT WATERPROOFING AND RESTORATION INSTITUTE


The Occupational Safety and Health Administration (OSHA) and Sealant Waterproofing and Restoration Institute (SWR Institute) hereby renew their Alliance signed February 20, 2003 and renewed July 21, 2005 and July 11, 2007. This renewal agreement fully incorporates all of the goals of the July 11, 2007, renewal agreement, which are continuing in nature.

OSHA and SWR Institute continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful workplaces. OSHA and SWR Institute remain committed to cooperative and proactive efforts to advance workplace safety and health especially by continuing to provide SWR Institute members and others in the sealant, waterproofing, and restoration industry, including small businesses, with information and guidance that will help them protect employees’ health and safety. Through the Alliance, the organizations will continue to address workplace issues such as confined spaces, falls, lead and silica hazards and staging requirements. In renewing this Alliance, OSHA and SWR Institute recognize that OSHA’s State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort.

OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party’s products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party’s products or services.

An implementation team made up of representatives of both organizations will continue to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. Team members will include representatives of OSHA’s Directorate of Cooperative and State Programs, Directorate of Construction, and any other appropriate offices. OSHA will encourage State Plan States’ and OSHA On-site Consultation Projects’ participation on the team.

The Occupational Safety and Health Administration (OSHA) and the Sealant Waterproofing and Restoration Institute (SWRI) agree to renew the Alliance signed February 20, 2003 and renewed July 21, 2005. OSHA and SWRI will continue to provide SWRI members and others in the sealant, waterproofing, and restoration industry, including small businesses, with information and guidance that will help them protect employees' health and safety.   • Work with OSHA to provide expertise in developing information on the recognition and prevention of workplace hazards, and to provide expertise in developing ways of communicating such information (e.g. print and electronic media, electronic assistance tools and OSHA's and the SWRI's Web sites) to employers and employees in the industry.
     
  • Speak, exhibit, or appear at OSHA's or SWRI's conferences, local meetings, or other events such as SWRI's Annual or Fall Technical Meetings.
     
  • Share information among OSHA personnel and industry safety and health professionals regarding SWRI's best practices or effective approaches and publicize results through outreach by SWRI and through OSHA- or SWRI-developed materials, training programs, workshops, seminars, and lectures (or any other applicable forum).
     
  • Promote and encourage SWRI members' or worksites' participation in OSHA's cooperative programs such as compliance assistance, the Voluntary Protection Programs, and the Consultation Program and its Safety and Health Achievement Recognition Program.

OSHA and SWRI will work together to achieve the following goal related to promoting the national dialogue on workplace safety and health:

  • Convene or participate in forums, round table discussions, or stakeholder meetings on safety and health issues to help forge innovative solutions in the workplace.

The Occupational Safety and Health Administration (OSHA) and the Sealant Waterproofing and Restoration Institute (SWRI) agree to establish an Alliance to promote safe and healthful working conditions for workers who apply and otherwise work with sealant, waterproofing, and restoration products by:

  • Providing members with information and guidance that will help them protect employees' health–particularly in the areas of reducing and preventing exposure to lead and silica–and safety–particularly in regard to confined spaces, fall protection, and staging requirements.
  • Educating employers in the control of hazards and prevention of exposure in their workplaces.

OSHA and SWRI will work together to effect the following outreach and communication goals:

  • Develop and disseminate information and guidance on relevant safety and health topics at SWRI conferences and through print and electronic media.
  • Promote and encourage SWRI members' participation in OSHA's cooperative programs such as compliance assistance, the Voluntary Protection Program, Consultation, Strategic Partnerships, and endorse mentoring among SWRI members.

OSHA and SWRI will also work together to effect the following goal relating to promoting the national dialogue on workplace safety and health:

  • In speeches and other public appearances, executives of SWRI and some of its members will attempt to raise others' awareness of and demonstrate their own commitment to workplace safety and health.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least quarterly to track and share information on activities and results in achieving the goals of the Alliance. Team members will include representatives of OSHA's Directorate of Cooperative and State Programs and any other appropriate offices. OSHA will afford the opportunity for representatives of the Occupational Safety and Health State Plan Association and the association of state Consultation Projects to participate as well. This agreement will remain in effect for two years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of both signatories.

    Training: Provide entertainment industry personnel as well as federal OSHA, State Plan, and Consultation Program personnel with training on occupational health and safety hazards in the entertainment industry;

  4. Upcoming Milestones

    In the coming year, OSHA and USITT/IATSE will continue to collaborate in conducting training and outreach to prevent injuries and fatalities among workers in the entertainment industry. USITT/IATSE will provide training to federal OSHA, state plan, and Consultation Program staff on recognition of electrical, fall, and other significant hazards. USITT/IATSE will also continue to provide OSHA-10 hour training to workers in the entertainment industry.

    USITT/IATSE will continue to collaborate with OSHA in developing new and distributing existing safety information and resources to workers in the entertainment industry, for example, at conferences and other events.

    • Alliance Product: Products (e.g., fact sheets, videos, toolbox talks) developed by Alliance participants as part of the Alliance. These are not OSHA products.
    • Dissemination: An Alliance participant sends OSHA information, Alliance products, or other safety and health information to its stakeholders. This includes information sent by email or social media (Facebook, Twitter), and information included in newsletters and other publications. It also includes hits on the Alliance participant's or OSHA's Web page.
    • Evaluation: Any efforts by the Alliance participant to evaluate the effectiveness of an Alliance activity or the Alliance as a whole.
    • Event: Participation in events such as the Construction Roundtable and NAOSH Week.
    • Exhibit: OSHA exhibits at events sponsored by the Alliance participant.
    • OSHA Product Review: Review of an OSHA product by an Alliance participant. For example, an Alliance participant may provide technical comments on an OSHA eTool or publication. The review itself is considered the Alliance activity.
    • Speech/Presentation: Speeches or presentation by OSHA staff at events sponsored by the Alliance participant.
    • Training: This includes best practice seminars or other training that Alliance participants provide for OSHA staff. It also includes training for workers/employers/others by Alliance participants.
