TRABAJO DE LOS ESTADOS UNIDOS DE AMÉRICA
Y
EL CONSULADO DE MÉXICO EN PORTLAND, OREGON


La Oficina de Área en Portland, Oregon de la Administración de Seguridad y Salud Ocupacional ("OSHA") del Departamento de Trabajo de los Estados Unidos de América y el Consulado de México en Portland, Oregon ("el Consulado") , en adelante denominados conjuntamente "los Participantes";

RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores mexicanos en los Estados Unidos, reconocidos en la Carta de Arreglo entre la Administración de Seguridad y Salud Ocupacional del Departamento de Trabajo de los Estados Unidos de América y la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos relativa a las Protecciones de Seguridad y Salud en el Lugar de Trabajo Aplicables a los Trabajadores Mexicanos en los Estados Unidos, firmada en Washington, D.C., el 6 de noviembre de 2014; y

RECONOCIENDO que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente:

Objetivo general

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos y a otros en Oregon información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de los Estados Unidos de América sobre los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Oregon sobre la seguridad y la salud en el lugar de trabajo.
  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Oregon a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act, incluyendo el uso del procedimiento de quejas de OSHA.

Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado, a los nacionales mexicanos que trabajan en Oregon y a sus empleadores.
  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del "Consulado Móvil".

Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan en Oregon para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.

Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican nationals in Oregon and others information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in Oregon regarding workplace safety and health.
  • To develop training and education programs for Mexican workers and Mexican employers in Oregon to promote understanding of workers' rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.
Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate's Web site) to Mexican nationals working in Oregon and their employers.
  • To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events.
  • To participate in "Mobile Consulate" activities and events.
Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights under the OSH Act whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican nationals working in Oregon to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers' rights and responsibilities of employers under the OSH Act.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

La Oficina de Zona de Portland de la Administración de Seguridad y Salud Ocupacionales (OSHA) del Departamento de Trabajo (DOL) de los Estados Unidos y el Consulado de México en Portland, Oregón, en adelante denominados conjuntamente "los Participantes";

econociendo el compromiso conjunto de proteger los derechos de los trabajadores mexicanos, reconocidos en la Carta de Arreglo entre la Administración de Seguridad y Salud Ocupacionales de los Estados Unidos de América y la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos, firmada en Washington, D.C., el 1 junio de 2010; y

Objetivo general

Los Participantes desean trabajar conjuntamente para alcanzar los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los ciudadanos mexicanos que trabajan en Oregón sobre los peligros a la seguridad y salud ocupacionales, y comunicar dicha información a los empleadores y trabajadores pertinentes.
  • Elaborar programas de capacitación y formación para los ciudadanos mexicanos que trabajan en Oregón con el fin de promover el conocimiento de los derechos de los trabajadores y las responsabilidades de los empleadores, entre otros la manera de recurrir al procedimiento de quejas de OSHA, y comunicar dicha información a los empleadores y trabajadores.

Extensión y Comunicación

Los Participantes desean trabajar conjuntamente para alcanzar los siguientes objetivos de extensión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de los riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio web de la OSHA desde del sitio web del Consulado de México en Portland, Oregón) a los ciudadanos mexicanos que trabajan en Oregón y a sus empleadores.
  • Pronunciar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del "Consulado Móvil".

Promoción de un diálogo nacional

Los Participantes tienen la intención de trabajar juntos para lograr los siguientes objetivos relacionados con la promoción de un diálogo nacional sobre la seguridad y la salud en el lugar de trabajo:

Un grupo de aplicación, compuesto por representantes de ambos Participantes, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Se tiene la intención de que el presente Arreglo cese a los dos años de la fecha de suscripción. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta d ías de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

    The Great Plains OSHA Education Center consortium and the OSHA Region 7 office have worked very closely to assure delivery on the key objectives. Contributions to the current evaluation and status of progress were provided by all member organizations.

OSHA and American Concrete Pipe Association (ACPA) Alliance
Close-out Report

On May 7, 2003, OSHA and AAOHN formed an Alliance to provide AAOHN members and others, including large and small businesses, with information and guidance to address workplace hazard preparedness, musculoskeletal disorders, bloodborne pathogens, personal protective equipment, and security issues such as workplace violence. OSHA and AAOHN renewed the Alliance on October 10, 2005, and on June 4, 2007.

Because the OSHA and AAOHN Alliance achieved the goals of the Alliance, the organizations agreed to conclude the Alliance as of May 7, 2009. A number of successes resulted from the agreement including:

  • Through the OSHA and AAOHN Alliance, AAOHN-developed a quick tip card, “Workplace Violence in Healthcare,” and a wallet companion card, “Violence Prevention in Healthcare,” that provides guidance for healthcare workers on prevention, response and recovery from a workplace violence incident. OSHA representatives reviewed and provided comments on the documents to AAOHN.
  • On November 8, 2007, AAOHN representative participated on a Webinar entitled, "Bloodborne Pathogens - What You Need to Know to Prevent Disease Transmission in the Workplace."
  • On May 10, 2006, Elise Handelman, Director, Office of Occupational Nursing, Directorate of Technical Support and Emergency Management, USDOL-OSHA, gave a presentation entitled, "AED/CPR and OSHA Compliance: What the new guidelines mean to you," at the 2006 AAOHN Symposium and Expo.
  • OSHA representatives staffed an Alliance Program exhibit booth at the 2006-2009 AAOHN Symposium and Expo.
  • AAOHN supported and promoted the 2007-2009 North American Occupational Health Weeks and the 2008-2009 Drug-Free Work Weeks.
  • AAOHN representatives served on the editorial boards of OSHA Safety and Health Topics pages, including Workplace Violence and Tuberculosis.

AGREEMENT RENEWING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
AND THE
AMERICAN APPAREL & FOOTWEAR ASSOCIATION

The Occupational Safety and Health Administration (OSHA) and the American Apparel & Footwear Association (AAFA) hereby renew the Alliance signed on February 14, 2003. OSHA and AAFA continue to recognize the value of a collaborative relationship to foster safer and more healthful American workplaces. Both groups are committed to sharing their collective expertise to help advance a culture of prevention while sharing best practices and technical knowledge, especially in the area of ergonomics. In renewing this Alliance, OSHA and AAFA recognize that OSHA's State Plan and Consultation Project partners are an integral part of the OSHA national effort.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services.

An implementation team made up of representatives of both organizations will continue to meet to take further action in determining working procedures, and identifying the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. Team members will include representatives of OSHA's Directorate of Cooperative and State Programs and any other appropriate offices. OSHA will encourage State Plan States' and OSHA Consultation Projects' participation on the team.

This agreement will remain in effect for two years. Either signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of both signatories.
