Atlanta Region - Alliance Renewal Agreement - December 20, 2006

Atlanta Region - Alliance Renewal Agreement - December 20, 2006

AN AGREEMENT RENEWING AN ALLIANCE
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
REGION IV
U.S. DEPARTMENT OF LABOR
AND
**INTERNATIONAL BROTHERHOOD OF ELECTRICAL WORKERS FIFTH AND TENTH DISTRICTS
SOUTHEASTERN LINE CONSTRUCTORS APPRENTICESHIP AND TRAINING
SOUTHEASTERN LINE CONSTRUCTORS CHAPTER, NATIONAL ELECTRICAL CONTRACTORS ASSOCIATION, INC.1

The Occupational Safety and Health Administration (OSHA), International Brotherhood of Electrical Workers (IBEW), Southeastern Line Constructors Apprenticeship and Training (SELCAT), and the Southeastern Line Constructors Chapter (SLCC)/ National Electrical Contractors Association (NECA) continue to recognize the value of maintaining a collaborative relationship to foster safer and more healthful American workplaces. To that end, OSHA and the IBEW, SELCAT and SLCC/NECA hereby renew the Alliance signed September 26, 2003, and renewed on December 20, 2006, with a continued emphasis on protecting workers’ health and safety. Specifically, in reducing and preventing exposure to electrical transmission and distribution equipment hazards. OSHA and the IBEW, SELCAT and the SLCC/NECA are committed to providing IBEW, SELCAT and the SLCC/NECA members and others with information, guidance, and access to training resources that will help them protect the health and safety of workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). In renewing this Alliance, OSHA and IBEW, SELCAT and the SLCC/NECA recognize that OSHA’s State Plan and On-site Consultation Project partners are an integral part of the OSHA national effort.

Raising Awareness of OSHA’s Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve the following goal related to raising awareness of OSHA’s rulemaking and enforcement initiatives:

  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on electrical injury and illnesses and common safety hazards in order to help forge innovative solutions in the workplace or to provide input on safety and health issues.
Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop effective training and education programs for workers in the electrical utility industry regarding hazard recognition, safety and health management systems (SHMS) and health hazards, and to communicate such information to constituent employers and workers.
  • To deliver or arrange for the delivery of courses regarding fatal accidents in the electrical utility industry, including improper Personal Protective Equipment (PPE), failure to maintain a safe distance, and failure to utilize proper equipotential grounding techniques. The Alliance participants will ensure that experienced workers, as well as inexperienced workers, including, but not limited to apprentices lineman will receive training.
Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and OSHA’s and the IBEW’s, SELCAT’s and the SLCC/NECA’s Web sites) to employers and workers in the industry.
  • To speak, exhibit, or attend the IBEW Fifth and Tenth Districts Annual Progress Meetings, Outside Apprenticeship Conference, IBEW Fifth District Construction Organizing Summit, SELCAT and SLCC/NECA Membership Meetings, local labor meetings, training sessions, or other events.
  • To share information among OSHA personnel and industry safety and health professionals regarding IBEW’s, SELCAT’s, and SLCC/NECA’s best practices or effective approaches and publicize results through outreach by IBEW, SELCAT, and SLCC/NECA and through OSHA or IBEW, SELCAT, and SLCC/NECA developed materials, training programs, workshops, seminars and lectures (or any other applicable forum).

OSHA’s Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote any of that party’s products or services.

An implementation team made up of representatives of each organization will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the OSHA Atlanta Regional Office and any other appropriate offices. OSHA will encourage State Plan States’ and OSHA On-site Consultation Projects’ participation on the team.

This agreement will remain in effect for two-years. Any signatory may terminate it for any reason at any time, provided they give 30 days written notice. This agreement may be modified at any time with the written concurrence of all signatories.

ESTABLISHING AN ALLIANCE PROGRAM AMBASSADOR RELATIONSHIP
BETWEEN
THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
AND
THE NATIONAL GRAIN AND FEED ASSOCIATION
AND
THE GRAIN ELEVATOR AND PROCESSING SOCIETY
AND
THE GRAIN HANDLING SAFETY COUNCIL

Since entering into an Alliance on September 13, 2017, with a subsequent renewal on May 1, 2020, the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA), the National Grain and Feed Association (NGFA), the Grain Elevator and Processing Society (GEAPS) and the Grain Handling Safety Council (GHSC) have worked together to improve workplace health and safety in the grain handling and storage industry by sharing information, guidance, and access to training resources that address occupational hazards, and promoting understanding of the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act.

OSHA, NGFA, GEAPS, and GHSC continue to recognize the value of maintaining a collaborative relationship to improve safety and health practices and programs in American workplaces and commit to continue their work together through an Alliance Program Ambassador relationship.

In recognition of this ongoing commitment, OSHA will continue to foster an active relationship with NGFA, GEAPS, and GHSC by:

  • Providing routine communications on enforcement, regulatory, and outreach initiatives.
  • Sharing invitations to and offering opportunities to speak at OSHA Alliance Program and other agency stakeholder meetings or events, such as outreach and training activities through the National, Regional, or Area Office, and the National Alliance Program Forum.
  • Engaging in information sharing and technical discussions, as appropriate, including completing special projects of mutual interest that align with agency priorities and as resources allow.
  • Maintaining the three organizations' status as Alliance Program Ambassadors on the agency’s public webpage.

NGFA, GEAPS, and GHSC will continue to foster an active relationship with OSHA by:

  • Sharing information with members and stakeholders on OSHA’s National Initiatives (Enforcement, Regulatory, and Outreach), and encouraging their participation in OSHA’s outreach initiatives and rulemaking processes.
  • Sharing information with members and stakeholders on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • Encouraging NGFA, GEAPS, GHSC and the state and regional affiliates of NGFA and GEAPS to build relationships with OSHAs Regional and Area Offices to address health and safety and issues, including grain handling safety.
  • Sharing information with OSHA personnel and industry safety and health professionals regarding NGFA, GEAPS, and GHSC good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).
  • Offering OSHA opportunities to speak, exhibit, or appear at one another’s conferences, local meetings, trainings, or other NGFA, GEAPS, and GHSC events.
  • Adhering to requirements laid out in the Alliance Program Directive regarding the prohibition on promoting or implying the agency’s endorsement of their policies, products, or services, including acknowledging that they will not receive any preferential treatment related to any statutory function of the agency.
  • Abiding by all terms and conditions for the use of the Alliance Program logo as specified in OSHA’s Guidelines for Use of the Alliance Logo.

OSHA’s cooperative programs provide organizations an opportunity to participate in a voluntary, collaborative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communication, training, and education. These programs have proven to be valuable tools for both OSHA and participants. By entering into this Ambassador relationship, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of the three organizations’ products or services.

This Ambassador relationship will remain in effect for the duration of an ongoing cooperative association and a good faith effort by all parties to meet the intent of this document and its underlying policies. Any signatory may terminate it for any reason at any time, provided they give 30 days’ written notice. Termination by one signatory will not nullify the Ambassador relationship with all signatories, with the exception of OSHA; OSHA may terminate the Ambassador relationship as a whole, or its relationship with one or more individual signatories.

AGREEMENT RENEWING AN ALLIANCE
BETWEEN
THE JACKSONVILLE AREA OFFICE
OF THE
OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION
U.S. DEPARTMENT OF LABOR
AND
MIGRANT & MINORITIES ALLIANCE

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA), Jacksonville Area Office and the Migrant & Minorities Alliance continue to recognize the value of maintaining a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and the Migrant & Minorities Alliance hereby renew the Alliance signed June 15, 2023, with a continued emphasis on protecting workers by reducing and preventing exposure to hazards in the agricultural1 and construction2 industries. Specifically, OSHA and the Migrant & Minorities Alliance are committed to providing the Migrant & Minorities Alliance members and the public with information, guidance, and access to training resources that will help them protect workers and understand the rights or workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address prevalent hazards in the agricultural and construction industries.

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the requirements for program participation laid out in the "Fundamental Requirements for OSHA Alliance Program Participants” and the "Guidelines for OSHA’s Alliance Program Participants: Alliance Products and Other Alliance Projects."

Through the Alliance, the organizations will use injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the Alliance’s impact on improving workplace safety and health. In renewing this Alliance, OSHA and the Migrant & Minorities Alliance recognize that OSHA’s State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives:

  • Share information3 on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • Develop information on the recognition and prevention of workplace hazards, and communicate such information (e.g., print, and electronic media, electronic assistance tools and OSHA and the Migrant & Minorities Alliance websites) to employers and workers in the agricultural and construction industries. Ensure information developed reflects the workforce and is available in multiple languages and formats.
  • Speak, exhibit, or appear at OSHA and Migrant & Minorities Alliance conferences, local meetings, or other Migrant & Minorities Alliance events.
  • Convene or participate in forums, roundtable discussions, or stakeholder meetings on agricultural and construction industry hazards to help forge innovative solutions in the workplace or to provide input on safety and health issues.
  • Encourage other community and labor partners in North Florida to build relationships with OSHA’s Regional and Area Offices to address health and safety issues, including agricultural and construction industry hazards.
Training and Education

The Participants intend to work together to achieve the following objectives:

  • Develop effective training and education programs for agricultural and construction regarding prevailing industry hazards, and to communicate such information to constituent employers and workers. Ensure training materials/programs are made available in appropriate languages and formats to meet the needs of their target audiences.
  • Develop effective training and education programs for the Migrant & Minorities Alliance to promote understanding of workers’ rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers. Ensure training materials/programs are made available in appropriate languages and formats to meet the needs of their target audiences.

OSHA’s Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communications, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. In entering this Alliance, OSHA and Migrant & Minorities Alliance acknowledge that this agreement is not legally binding. This agreement does not obligate or authorize the expenditure or reimbursement of appropriations or other funds, nor does it require the parties to enter into any contract or other obligations. It does not confer any rights or responsibilities under U.S. law, nor does it limit or restrict the parties from participating in similar activities or arrangements with other entities. This agreement does not limit, supersede, or otherwise affect OSHA’s normal operations or decisions in carrying out its statutory and regulatory duties and functions. OSHA’s entering an Alliance with an organization does not imply the agency’s endorsement or promotion of that organization’s products or services.

An implementation team made up of representatives of each organization will meet one to two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Jacksonville Area Office and any other appropriate offices. OSHA will encourage State Plans' and OSHA On-Site Consultation program’s participation on the team.

This agreement will be executed in full compliance with all applicable federal laws. It takes effect on the date of signing and will remain in effect for five years. Either signatory may terminate their organization’s participation in the agreement for any reason at any time, provided they give 30 days’ written notice. This agreement may be modified at any time with the written concurrence of both signatories.
