On 12/4/87, OSHA published a final rule (52 FR 46168) on occupational exposure to formaldehyde. On 12/13/88 OSHA announced an administrative stay of paragraphs (m)(1)(i) through (m)(4)(ii) for a period of nine months because of public confusion about the hazard warning provisions of the revised standard. OSHA also announced its intention to revoke paragraphs (m)(1)(i) through (m)(4)(ii) and invite comments on replacing them with the Hazard Communication Standard (29 CFR 1910.1200) or another equally protective alternative which would be less confusing to the public.

OSHA hereby amends its existing regulation for occupational exposure to formaldehyde, 29 CFR 1910.1048, in response primarily to a remand by the U.S. Court of Appeals for the D.C. Circuit in UAW v. Pendergrass, 878 F.2d 389 (D.C. Cir. 1989). The final amendments lower the permissible exposure level for formaldehyde from 1 ppm (part per million) as an 8-hour time-weighted average (TWA) to an 8-hour time- weighted average of 0.75 ppm.

The administrative stay of 29 CFR 1910.1048 (m)(1)(i) through (m)(4) (ii) will be effective until 11/6/91. These paragraphs of the 12/4/87 final rule were previously stayed on 12/13/88, and the stay was extended on 8/29/89, 6/13/90, 12/17/90, 3/12/91, and 6/12/91. On 7/15/ 91, OSHA published a proposal to resolve several remaining issues on formaldehyde, including those raised by the stayed paragraphs (56 FR 32302). The public was given until 8/14/91 to comment on the proposal. Consequently the stay is being extended for an additional 90 days.
