ALLIANCE AGREEMENT BETWEEN
THE U.S. DEPARTMENT OF LABOR

The Occupational Safety and Health Administration (OSHA), Bellevue Area Office, and Joint Base Lewis-McChord (JBLM), recognize the value of establishing a collaborative relationship to foster safer and more healthful workplaces and responses to emergencies. The OSHA Bellevue Area Office and JBLM therefore agree to continue an Alliance first entered into on June 1, 2004, with emphasis on promoting a culture of sharing best practices, technical knowledge, collective expertise and resources. Activities under this Alliance include support in preparation for and during emergencies, as well as general safety and health for employees and contractors on JBLM. Programs produced by this Alliance may be applicable to and used at other worksites. OSHA will not interpret or enforce policies or regulations of other agencies.

Raising Awareness of OSHA's Rulemaking and Enforcement Initiatives

The Participants intend to work together to achieve the following goals related to raising awareness of OSHA's rulemaking and enforcement initiatives:

  • To share information on OSHA's National/Regional/Local Emphasis Programs, Regulatory Agenda, and opportunities to participate in the rulemaking process.

  • To share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.

  • Convene or participate in forums or roundtable discussions to discuss injury and illness trends and common emergency response operational hazards in order to help forge innovative solutions to safety and health problems in the workplace.

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • Support the development of training and education programs that can be used to improve emergency response and other safety and health programs and activities.

  • Provide training and awareness opportunities for OSHA and JBLM safety and health professionals, contract enforcement personnel, and others who have responsibilities for worker safety and health.

Outreach and Communication

Participants intend to work together to achieve the following outreach and communication goals:

  • Provide JBLM leaders and employees with information and guidance in reducing and preventing employees' exposure to safety and health hazards during emergency response operations and related training activities.

  • Increase awareness and/or access to safety and health information and training resources.

  • Share up-to-date information, such as injury, hazard and workforce trends, help identify the top priorities for the development of emergency response safety and health training and outreach programs for OSHA and JBLM.

  • Cross-train OSHA and JBLM personnel in best practices pertaining to emergency response operations and other areas of mutual interest as jointly defined by OSHA and the JBLM. Cross-training may include joint inspections, outreach sessions, employee exchange programs, or other initiatives.

  • JBLM will work with OSHA to provide expertise and input, including model programs that OSHA can use as part of the development of electronic assistance tools, such as Safety and health Topics pages and "E-Tools."

  • Share information on best emergency response practices, as jointly determined by OSHA and JBLM, with other federal agencies through outreach or training programs and materials.

  • Generate and sustain interest in other federal agencies and activities to identify and capitalize on resources and opportunities that further employee safety and health.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's rulemaking and enforcement initiatives, training and education, and outreach and communication. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that party’s products or services.

Under this Alliance, the OSHA Bellevue Area Office Director and the JBLM Joint Base Safety Director will coordinate directly for support such as personnel, equipment, and other resources for an actual emergency. JBLM and OSHA believe the Alliance is an excellent tool to improve the overall safety and health of emergency responders, increase outreach and communication between OSHA and other federal agencies, develop expertise of compliance officers and JBLM personnel, and participate in the national dialogue on improving worker safety and health.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times a year to track and share information on activities and results in achieving the goals of the Alliance.

The reports and documents developed under this Alliance that are retained by OSHA are subject to the Freedom of Information Act. This agreement will remain in effect for two years from the date of signing. This agreement may be modified at any time with the concurrence of both signatories and may be terminated for any reason with 30 days written notice from either signatory.

AGREEMENT TO ESTABLISH AN ALLIANCE
BETWEEN
THE U.S. DEPARTMENT OF LABOR
OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION, REGION X
AND
JOINT BASE GARRISON, JOINT BASE LEWIS-McCHORD


The Occupational Safety and Health Administration (OSHA), Region X, and Joint Base Garrison, Joint Base Lewis-McChord (JBLM), recognize the value of establishing a collaborative relationship to foster safer and more healthful responses to emergencies. Region X OSHA and JBLM therefore agree to form an Alliance to promote a culture of prevention by sharing best practices, technical knowledge, collective expertise and resources in preparation for and during emergencies.

In developing this Alliance, JBLM and OSHA recognize that emergency responses involve work under the jurisdiction of numerous federal and state agencies. OSHA also recognizes that JBLM employees work outside the state of Washington and in other jurisdictions. Programs produced by this Alliance may be applicable to and used at other worksites. OSHA will not interpret or enforce policies or regulations of other agencies.

Region X OSHA and JBLM agree to achieve the following training and education goal for emergency response operations:

  • Support the development of training and education programs that can be used to improve emergency response safety and health programs and activities.

Region X OSHA and JBLM agree to achieve the following outreach and communication goals for emergency response operations:

  • Provide JBLM leaders and employees with information and guidance in reducing and preventing employee's exposure to safety and health hazards during emergency response operations and related training activities.
  • Increase awareness and/or access to safety and health information and training resources.
  • Share up-to-date information, such as injury, hazard and workforce trends, to help identify the top priorities for the development of emergency response safety and health training and outreach programs for OSHA and JBLM Safety Office.
  • Cross-train OSHA and JBLM Safety Office personnel in best practices pertaining to emergency response operations and other areas of mutual interest as jointly defined by OSHA and the JBLM Safety Office. Cross-training may include joint inspections, outreach sessions, employee exchange programs, or other initiatives.
  • JBLM Safety Office will work with OSHA to provide expertise and input, including model programs that OSHA can use as part of the development of electronic assistance tools, such as Safety and Health Topics pages and "E-Tools."
  • Share information on best emergency response practices, as jointly determined by OSHA and JBLM, with other federal agencies through outreach or training programs and materials.

  • Convene or participate in forums or roundtable discussions to discuss injury and illness trends and common emergency response operational hazards in order to help forge innovative solutions to safety and health problems in the workplace.
  • Generate and sustain interest in other federal agencies and activities to identify and capitalize on resources and opportunities that further employee safety and health in emergency response.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services.

Under this Alliance, Region X OSHA Management and the JBLM Safety Director will coordinate directly for support such as personnel, equipment, and other resources for an actual emergency. JBLM and OSHA believe the Alliance is an excellent tool to improve the overall safety of emergency response sites, increase outreach and communication between OSHA and other federal agencies, develop expertise of compliance officers and JBLM safety staff, and participate in the national dialogue on emergency response safety and health.

An implementation team made up of representatives of both organizations will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet on a quarterly basis, or less frequently if mutually agreed upon, to track and share information on activities and results in achieving the goals of the Alliance.

The reports and documents developed under this Alliance that are retained by OSHA are subject to the Freedom of Information Act. This agreement will remain in effect for two years from the date of signing, and will automatically be renewed annually thereafter. This agreement may be modified at any time with the concurrence of both signatories and may be terminated for any reason with 30 days written notice from either signatory.

EL CONSULADO DE MÉXICO EN PORTLAND, OREGON


La Oficina de Área en Portland, Oregon de la Administración de Seguridad y Salud Ocupacional ("OSHA") del Departamento de Trabajo de los Estados Unidos de América y el Consulado de México en Portland, Oregon ("el Consulado") , en adelante denominados conjuntamente "los Participantes";

RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores mexicanos en los Estados Unidos, reconocidos en la Carta de Arreglo entre la Administración de Seguridad y Salud Ocupacional del Departamento de Trabajo de los Estados Unidos de América y la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos relativa a las Protecciones de Seguridad y Salud en el Lugar de Trabajo Aplicables a los Trabajadores Mexicanos en los Estados Unidos, firmada en Washington, D.C., el 6 de noviembre de 2014; y

RECONOCIENDO que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente:

Objetivo general

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos y a otros en Oregon información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de los Estados Unidos de América sobre los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Oregon sobre la seguridad y la salud en el lugar de trabajo.
  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Oregon a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act, incluyendo el uso del procedimiento de quejas de OSHA.

Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado, a los nacionales mexicanos que trabajan en Oregon y a sus empleadores.
  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del "Consulado Móvil".

Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan en Oregon para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.

Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

Intend to form an Alliance to achieve the following:

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican nationals in Oregon and others information, guidance, and access to education and training resources to promote workers' rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in Oregon regarding workplace safety and health.
  • To develop training and education programs for Mexican workers and Mexican employers in Oregon to promote understanding of workers' rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.
Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate's Web site) to Mexican nationals working in Oregon and their employers.
  • To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events.
  • To participate in "Mobile Consulate" activities and events.

La Oficina de Zona de Portland de la Administración de Seguridad y Salud Ocupacionales (OSHA) del Departamento de Trabajo (DOL) de los Estados Unidos y el Consulado de México en Portland, Oregón, en adelante denominados conjuntamente "los Participantes";

econociendo el compromiso conjunto de proteger los derechos de los trabajadores mexicanos, reconocidos en la Carta de Arreglo entre la Administración de Seguridad y Salud Ocupacionales de los Estados Unidos de América y la Secretaría de Relaciones Exteriores de los Estados Unidos Mexicanos, firmada en Washington, D.C., el 1 junio de 2010; y

Reconociendo que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la formación, actividades de extensión y de comunicación, y la promoción de un diálogo nacional sobre la salud y la seguridad en el trabajo;

Desean formar una Alianza para alcanzar los siguientes objetivos:

Objetivo general

Los Participantes desean establecer una relación de colaboración con el fin de ofrecer a los ciudadanos mexicanos que trabajan en Oregón información, orientación y acceso a recursos educativos y de capacitación con miras a promover los derechos de los trabajadores a la protección de su salud y seguridad en el trabajo, as í como ayudarlos a comprender los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Salud y Seguridad Ocupacionales.

Capacitación y Educación

Los Participantes desean trabajar conjuntamente para alcanzar los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los ciudadanos mexicanos que trabajan en Oregón sobre los peligros a la seguridad y salud ocupacionales, y comunicar dicha información a los empleadores y trabajadores pertinentes.
  • Elaborar programas de capacitación y formación para los ciudadanos mexicanos que trabajan en Oregón con el fin de promover el conocimiento de los derechos de los trabajadores y las responsabilidades de los empleadores, entre otros la manera de recurrir al procedimiento de quejas de OSHA, y comunicar dicha información a los empleadores y trabajadores.

Extensión y Comunicación

Los Participantes desean trabajar conjuntamente para alcanzar los siguientes objetivos de extensión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de los riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio web de la OSHA desde del sitio web del Consulado de México en Portland, Oregón) a los ciudadanos mexicanos que trabajan en Oregón y a sus empleadores.
  • Pronunciar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del "Consulado Móvil".

Promoción de un diálogo nacional

Los Participantes tienen la intención de trabajar juntos para lograr los siguientes objetivos relacionados con la promoción de un diálogo nacional sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesa redonda o reuniones de interesados principales sobre cuestiones que afectan a los ciudadanos mexicanos que trabajan en Oregón para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y conocimiento de los derechos de los trabajadores y las responsabilidades de los empleadores.

Un grupo de aplicación, compuesto por representantes de ambos Participantes, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Se tiene la intención de que el presente Arreglo cese a los dos años de la fecha de suscripción. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta d ías de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes.

  • To develop training and education programs for Mexican workers and Mexican employers in Oregon to promote understanding of workers' rights and responsibilities of employers, including the use of the OSHA complaint process, and to communicate such information to employers and workers.

Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA's Web site from the Consulate of Mexico in Portland, Oregon's Web site) to Mexican Nationals working in Oregon and their employers.
  • To speak, exhibit, or appear at the Participants' conferences, local meetings, or other events.
  • To participate in "Mobile Consulate" activities and events.

Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting the national dialogue on workplace health and safety:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers' rights whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in Oregon to help forge innovative solutions on issues concerning workplace health and safety and understanding of workers' rights and responsibilities of employers.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

This Arrangement is intended to cease two years from the date of signing. A participant should endeavor to provide 30 days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time with the concurrence of the Participants.
