Post-Hearing Procedures for OSHA’s Proposed Standard on Occupational Exposure to Respirable Crystalline Silica; Extension of Post-Hearing Comment Period
On March 4, 2014, the Occupational Safety and Health Administration (OSHA) set hearing and post-hearing procedures for its Notice of Proposed Rulemaking (NPRM) on Occupational Exposure to Respirable Crystalline Silica published in the Federal Register on September 12, 2013 (78 FR 56274; Docket No. OSHA-2010-0034). OSHA has decided to amend these procedures to allow additional time for post-hearing submissions.
Parties who filed notices of intent to appear may submit additional information and data relevant to the proceeding through June 3, 2014 (i.e., within 60 days of the close of the hearing); final briefs, arguments, and summations must be submitted by July 18, 2014 (i.e., 105 days after the close of the hearing). This amendment provides an extra 15 days to submit additional information and data and, as a result, also extends the deadline for submitting briefs, arguments, and summations for the same 15 days.
