Employee's Legs Are Fractured in Fall from Height

On August 13, 2010, Employee #1, a framer/foreman, was framing a single story building. He and a coworker were placing a structural wooden beam, 16-in. by 4-in. by 16 ft, to form one side of an extended entry way. The top-plate measured 14 ft, which is approximately one foot short for invoking the use of fall protection. The beam was rigged in reverse of its intended orientation when the crane hoisted it into position. The coworker pushed the beam to correct the orientation. As the end swung around, Employee #1 reached out with his hammer in an attempt to stop the beam. The weight and momentum of the beam was greater than Employee #1's capacity to stop the beam. He was pulled from the top plate and fell 13 ft, sustaining a fracture of both lower legs, and was hospitalized.
