Investigation Summary
At approximately 7:20 a.m. on August 17, 2010, Employee #1 was working as an avocado picker on the Phelps Ranch in Carpinteria, CA. Employee #1 was employed by Andrade Farm Labor, a farm labor contractor that employed between one and seventy-eight employees during their season, which ran from February to November. Employees harvested avocados on privately owned ranches from Carpinteria to Goleta using aluminum extension ladders, picking poles, and clippers. Employee #1 had been working for Andrade Farm Labor for seven to eight years as an avocado picker. At the time of the accident, he was on a 36-foot extension ladder picking avocados. He was using both hands to hold a pole picker, when he overreached to get an avocado, lost his balance, and fell, breaking his right leg. He fell approximately 25 to 30 feet. No one witnessed the accident even though coworkers were harvesting in trees nearby. No cell phone service was available, and a supervisor had to flag down a motorist to call emergency medical technicians. He was taken to Santa Barbara Cottage Hospital, where he was hospitalized more than 24 hours. The Division issued a Serious accident-related citation for Section 3279, referencing the consensus standard ANSI A14.2-1990, which stated that a user shall not overreach, but shall descend and relocate the ladder instead. The Division also issued a Serious citation for 3439(b), due to the employer's not having provisions made in advance for prompt medical attention in case of serious injuries at remote locations. The employer did not have at least one employee with training for administering emergency first aid at the remote location.
