Employee Injures Head and Back in Fall from Ladder

On May 20, 2011 Employee #1, a plasterer working for a plastering contractor was plastering the outer surface of a one-story fast food establishment. The job required employees to work a night shift, as the restaurant closed at 11:00 p.m. and reopened at 5:00 a.m. Employee #1 was assigned the task of making a patch at a higher elevation. Employee #1 climbed a two section ladder equipped with a rope pull. Coworker #1 held the ladder for Employee #1 as he climbed the ladder while holding a trowel and a plasterer's tape in one hand. Employee #1 reached a height of 10 feet, and then he missed a step on the ladder and fell backwards to the concrete slab. Employee #1 suffered injuries to the head and back, and he was treated for those injuries and released on the day of the accident. Four days later, Employee #1 was still unable to walk, so he was then readmitted to the hospital and stayed for four days for treatment.
