Investigation Summary
At approximately 5:50 a.m. on November 12, 2009, Employee #1 was walking behind the forklift, operated by a coworker. The coworker changed the direction of the forklift and ran over Employee #1 with the rear wheel of a "Crown" sit-in fork lift crushing three of his toes on his right foot. Employee #1 sustained an amputation of his three toes at the hospital. Employee #1 worked as full time regular warehouse worker/fork lift operator for the employer. The employer is in the business of produce wholesale. The employer did not notify the Division of the serious injury. However, the attorney of Employee #1 notified the Division of the injury on May 6, 2010. The accident occurred in Dock Cooler #1 (36-degree Fahrenheit warehouse).
