Employee Fractures Leg in Fall in Hole

At 8:00 a.m. on February 18, 2010, Employee #1 was going to cover a hole (36-inch Diameter and 12 feet deep) with a piece of plywood sheet which was just dug by a driller. Employee #1 put the plywood sheet on the hole. As he moved back to pick up his tools, he fell into a hole which was about three feet away from the new hole and sustained multiple fractures on his left lower leg, which required a surgery and hospitalization for three days. The injury was reported to the Division at 1:15 p.m. on February 18, 2010 by the employer and the investigation was initiated at 1:30 p.m. on March 16, 2010. The employer is engaged in excavation/drilling business. The employer had total of 75 employees and was unionized (Labor Union, local-300 and operating engineers, local12 & pile drivers' union).
