Employees Back Is Fractured in Fall from Defective Ladder

At approximately 2:00 a.m. on July 8, 2009, Employee #1, a maintenance technician, was changing a burned out light bulb using a 10 ft fiberglass ladder. The ladder did not belong to his company. The ladder was marked, broken do not use, in black marker and had red tape wrapped around the location of a fracture in the fiberglass. A coworker had climbed up the back of the ladder on the bracing to hand Employee #1 the new light bulb. As the coworker climbed down, he stepped on the brace that was near the fracture. The ladder collapsed, and Employee #1 fell 8 ft, landing on the ladder. Employee #1 suffered a concussion and a lumbar spinal injury. Employee #1 was hospitalized.
