Investigation Summary
At 2:30 p.m. on October 21, 2009, Employee #1, a 33-year-old seasonal employee employed by Jose Guillermo Herrera DBA Progress Farm Labor Contracting, was part of a crew that was being supervised by "Llamas Contracting AG, Inc." The crew was harvesting pomegranates at a worksite owned by "E.A.B Ranch." Employee #1 was driving a "1950" Ford tractor, which E.A.B. ranch had rented from Deron Hagopian in Reedley, CA. He was towing a trailer containing four bins filled with pomegranates. The bins measured approximately 4 feet by 4 feet and had been estimated to weigh 1,000 pounds. Employee #1 was traveling southbound on a dirt road that ran parallel along the pomegranate orchard, with a slightly inclined grade to the paved asphalt road at Jensen Avenue in Mendota, CA. The tractor and trailer rolled over onto the dirt road and landed upside down. Employee #1 was thrown off and onto the ground. He was transported to Fresno's Community Regional Medical Center and was hospitalized for treatment of his injuries. The medical report provided by Fresno's Community Regional Medical Center revealed that employee #1 sustained fractures to his left ribs, including a clear lateral fracture to his eighth rib. He also sustained thermal burns to his left arm. Neither Employee #1 nor E.A.B. Ranch reported mechanical problems prior to the accident.
