Employee Is Struck and Killed by Vehicle

On December 24, 2008, Employee #1 was returning to the station after conducting work related duties. In the morning, the employer sent Employee #1 to get the truck repaired for vapor tightness. After returning, Employee #1 was sent out to two stores for deliveries, at approximately 4:00 to 4:30 p.m. on that day. After the driver's deliveries were made, he returned to the station. The company procedure was to have employees park with flashing lights, across from the station. The employees would then cross the street and unlock the gate. After unlocking the gate and opening the gates, the employees would retrieve their trucks and park in a secure area. On the day of the accident, Employee #1 crossed the street to retrieve his truck, but was struck by a car and died.
