Two Employees Are Injured When Forklift Overturns

At approximately 1:00 p.m. on January 12, 2009 Employees #1 and #2 were painting the fascia of a building at a location 30 feet above the ground. Due to the height if the location requiring painting, Employees #1 and #2 were lifted by a Lull Highlander forklift truck, Model Number 2. As Employees #1 and #2 worked from the personnel basket being hoisted by the forklift, the forklift operator began repositioning the forklift to elevate the basket further. The forklift overturned on its right side, ejecting both Employees #1 and #2 from the basket. Both Employees #1 and #2 were taken to a nearby hospital, where they were hospitalized and treated for fractured legs. The accident investigation accounted that the forklift operator had not been trained or evaluated to operate fork lift trucks. Additionally, the forklift, although moving parallel with the building, was not on even ground; the left side wheels were on grass and the right side wheels on blacktop.
