Investigation Summary
At approximately 6:45 pm on June 5, 2010, Employee #1, an irrigator of E.E. Hall, Inc., was riding an All Terrain Vehicle (ATV). He suffered a fracture to his neck due to running an ATV he was operating into an almond tree. Employee #1 was transported in a company vehicle to the Central Valley Occupational Medical Group, an industrial clinic, and then was referred to the emergency room at San Joaquin Community Hospital for further treatment. At the time of the accident, Employee #1 was performing a regularly assigned task of operating an ATV in order to check irrigation hoses for water leaks. Employee #1 had been operating an ATV throughout the day to check for leaks in the extensive network of irrigation lines running through the almond orchards. Employee #1 stated that towards the end of the day at around 5 or 6 pm, he was travelling down the orchard. A branch was protruding from the left and extended to his far right. As Employee #1 swerved around the branch, he veered to his left quickly. As he veered to the left, he slammed straight into the base of an almond tree. Employee #1 struck his head against the tree and staggered to the ground. Employee #1 called Employee #2, his roommate, for help. Employee #2 notified Employee #3, his supervisor, of the situation and formed a group of six persons to look for Employee #1. When the group arrived they saw Employee #1 crawling on the ground. Employee #1 was lifted up and held between two persons. Employee #1 was placed in the truck of a supervisor of the ranch where the employer had a contract with the ranch to provide agricultural labor services. Employee #1 was driven to an area of the ranch's shop. From there, Employee #3 transferred Employee #1 to his truck and drove him to an industrial medical clinic in Bakersfield. The clinic placed a halo on the employee then referred him to the emergency room of a local hospital. Employee #3 drove Employee #1 to the hospital where he received treatment for his injuries. Employee #1 was admitted on June 5, 2010 and discharged on June 9, 2010. The injuries were cervical fracture, head laceration, and concussion.
