Employee is struck by backhoe, later dies

On June 7, 2010, Employee #1, of Bob Goodman Landscapes, was making sure the backhoe operator (owner of company) did not hit any underground pipes and was also doing some hand shoveling while excavating for a foundation on an addition to a home. The backhoe operator had picked up a large rock in the bucket and was moving it to his rock pile which was located approximately 30 feet away from the excavation. Employee #1 was standing on the opposite side of the excavation making sure he didn't hit a PVC pipe. As the backhoe operator was swinging the bucket back to the excavation, he hit Employee #1 who had moved approximately 18 feet next to the spoils pile and was bending over to pick up some smaller rocks. Employee #1 was hit in the head right above his forehead with the large bucket, which knocked him over. Due to the position of the bucket arm, the backhoe operator was unable to see out of the right window and did not know Employee #1 had changed location on the jobsite. Employee #1 was not wearing a hard hat or safety vest. The backhoe operator immediately turned off the backhoe and called 911. Carpinteria-Summerland Fire Protection District responded to the accident site, and Employee #1, who was not breathing, was taken to Cottage Hospital in Santa Barbara. Employee #1 was in a coma and died on June 15, 2010.
