On October 25, 2009, Employee #1 was assisting in performing freeway repairs that his employer was contracted to do. As Employee #1 had just completed jackhammering a small section of concrete on the section of road, approximately 12 feet inside the worksite barricades, a vehicle went through barricades and struck him.
