Investigation Summary
At approximately 4:56 p.m. on June 1, 2009, Employee #1 was operating a 2008 Kawasaki four-wheel-drive Teryx recreation utility vehicle (RUV), Model Number 750 LE, Serial Number 8KAXX 749AAC, in a paved area near the employers facility. The employer specialized in the service, maintenance, and storage of boats, all-terrain-vehicles (ATVs), recreation-terrain-vehicles (RTVs), and RUVs. While Employee #1 was test driving the RUV in preparation for relocation to the main stores sale display, the vehicle went out of control and threw Employee #1 into a fence. Employee #1 was taken to a local hospital, where he was hospitalized and treated for two broken wrists, a fractured right ankle, and a minor head injury. During the accident investigation it was reported that Employee #1 was not wearing a helmet during the testing of the RUV, which was a common practice at the facility. In addition, the employers training program was ineffective, leaving determinations up to each individuals discretion/judgment. Therefore, the accident was attributed to a lack of effective training and failure to use appropriate personal protective gear (i.e., helmet).
