Employee killed when struck by falling piece ledge

On July 17, 2007, Employees #1 and #2, of Plummer, Inc., were working on the ground at the site of a six-story condominium building under construction. They were under a homemade sun-shield canopy of waterproofing paper attached to a JLG articulating arm basket liftarm, model #860J, from H & E Equipment Rentals. Coworkers from B & B Construction were 93 ft above them in a Genie lift, model S-125, serial #344, from High Reach Rentals. The coworkers were marking a wall with a chalk line before starting to frame it. Employees #1 and #2 were slightly to the east of the Genie lift when the coworkers in the lift struck a composite ledge, resulting in a piece breaking off. The falling piece struck a concrete eyebrow above a second-floor window and broke into three pieces. One of the pieces struck Employee #1 on the head, and Employee #2 on the shoulder and arm. Employee #1 suffered severe head injuries and was pronounced dead at the scene. Employee #2 was examined at the hospital and released.
