Employee Is Killed When Caught Between Truck and Tractor

On June 30, 2008, an employee was assigned to Garcia Family Farms, who exercised control over the employee and a field crew of 40 to 50 workers. The employee was reported to have previously worked for Garcia Family Farms for twenty to thirty years. Physical evidence indicated that the employee was jump starting the tractor with a 1995 Dodge diesel pickup truck positioned in front of and facing the tractor. The employee energized the starter motor by shorting across the starter solenoid terminals with a screwdriver, while positioned in front of the axle and between the right front tire and the frame. Throttle was wide open and the transmission was in third gear. When the engine started, the tractor moved forward, climbing onto the truck. The employee attempted to escape by crawling over the trucks engine compartment. The employee succumbed to upper body compression when the tractor's right front tire rolled off the truck allowing it to fall onto the employee. The employee was killed. Physical examination revealed the tractor did not have an operational electrical system, ignition switch, or alternator, therefore was required to be jump started at the starter motor solenoid for each time of use. The tractor, pickup truck, and field were owned by the directing and controlling employer, Garcia Family Farms.
