Employee's Leg Is Fractured by Falling Forklift Load

At approximately 1:00 p.m. on December 4, 2007, Employee #1 was assisting a coworker, an industrial truck operator, in relocating 3 large tires. Each tire measured 10 ft in diameter and 3 to 6 ft thick, weighing approximately 6,000 pounds. The forklift was a HYSTER 360HD, Serial Number F019E02125D. They tilted the tires individually to allow the insertion of dunnage, measuring 8-in. by 8-in., so both forks could pick it up. As the dunnage was positioned below the second tire, it fell into the interior of the tire. The operator tilted the second tire a little bit higher so Employee #1 could climb over the third tire to retrieve the fallen dunnage. As Employee #1 climbed over the third tire, the second tire which was still suspended on the forks slid off the forks and partially fell on him. Employee #1's right leg was fractured and, he was hospitalized.
