Employee injured in fall through scaffold opening

On October 5, 2007, Employee #1 and a coworker were assigned to load a stack of sheetrock onto the second-floor of a structure under construction. The large window opening through which the sheetrock was to be moved was obstructed by scaffolding rails, which had to be temporarily removed so the boom lift operator could maneuver the sheetrock through the opening and onto the floor of the building. The coworker later stated that, after getting a load of drywall into the building, he and Employee #1 were replacing the scaffold rails when Employee #1 stepped out of the window opening onto the scaffold, slipped, and fell 9 ft through a 13-in. gap between the scaffolding and the building. Employee #1 landed on a concrete surface, sustaining a concussion, a 3 in. long transverse scalp laceration that required 12 staples to close, abrasions on his leg, and a frontal sinus fracture, and multiple contusions. He was held for observation, but did not require surgical intervention.
