Employee Is Struck by Truck and Killed

On January 4, 2007, an employee was struck and killed by the front right wheel of the second of two parked and single-file-aligned log trucks, when the second truck began to roll, or slide, from its parked position at the bottom of a logging trail. The employee and the driver of the second, Pull-out Truck had been standing near the rear of the front truck's load of logs. They were between the two trucks, preparing to attach a flag to the end of the front load of logs with a bungee cord, when the Pull-out truck began to roll toward them. The Pull-out truck with its loaded trailer had been left idling in neutral, with its air-brakes allegedly set, about 20 feet behind the end of logs on the front trailer. The Pull-out Truck Driver noticed, out of the corner of his eye, that his truck was moving toward them. He grabbed for the back of the collar of the employee, but the employee broke free and went under the logs hanging from his truck. The employee was then struck and pinned head-first under the front tire and axle on the Pull-out truck's passenger side. The employee was killed. Either the air-brake system on the Pull-Out Truck had not been properly engaged, or the combined weight of the Pull-out truck and its trailer, 27,560 pounds, plus its 53,960 pound load of logs, caused the truck, trailer and logs to slide forward. The Pull-out truck and its load had been parked on a nine-to-ten degree sloped logging trail, which led down from the log-loading-site atop a hill.
