Employee killed when backhoe falls on him in a trench

On March 17, 2004, Employee #1 working with a crew was digging a 5 ft deep excavation for the installation of a new septic tank. Employee #1 was working in the west end of the excavation where he was leveling out the bottom. It was decided that more dirt needed to be removed from the southeast corner of the excavation so the rubber tire backhoe was positioned at that area. When the operator swung the seat around to operate the backhoe the machine rolled backwards into the excavation. Employee #1 was struck and crushed by the arm of the backhoe and killed.
