Employee injured in fall with ladder

On the morning of November 8, 2004, Employee #1, a construction laborer, was working at a residential home undergoing renovations. He was instructed to erect an extension ladder and to put a nail in the sheathing on the rear of the house, approximately 12 ft above the ground. Employee #1 set up a 20 ft ladder and set it 1 or 2 in. from the edge of the building. Carrying a pneumatic nail gun, he had climbed to a height of approximately 7 ft when the ladder slipped off the edge of the building and twisted; Employee #1 fell to the ground and sustained injuries that required hospitalization. No coworker had been holding the ladder, and it was neither tied or otherwise secured.
