Contractor killed by fall

On September 7, 2003, a self employed individual was painting the exterior of a three story building while working from a 36 foot wooden extension ladder that was placed on one stage of rolling scaffolding. Witnesses state that the ladder shifted and collapsed, causing the individual to fall and strike his head on the ground which caused his ultimate demise. It was determined that there was no employer/employee relationship; therefore OSHA had no jurisdiction in this situation.
