Employee's finger tip is amputated in machine

On September 20, 2004, Employee #1 was using a tube cut off machine manufactured by Bertolette Machines Incorporated, Model 415, and Serial Number 467. This machine takes in an aluminum tube from a spool and cuts and forms it into specified sizes. The machine can be setup for tubes of different diameters. The machine is properly guarded for normal operations. Employee #1 was making adjustment to the position of a clamp inside the machine. This clamp holds the tube in place while it is being cut. The position of this clamp is critical for quality control. This clamp should hold the tube right in the middle of the cut piece. If it is near an end of the piece, it can deform the end slightly, which in turn can create a fitting problem with the mating part for these tubes. The back and forth movement of this clamp is controlled by a set of chains and sprockets attached to a stepper motor. The grab position on the tube by this clamp can be adjusted by a wheel attached to one of the sprockets. In order to make this adjustment Employee #1 removed the guard on the chain and sprockets but did not stop the machine. The chain and sprocket mechanism turns back and forth with pauses of 3 to 4 seconds. During one of these pauses, Employee #1 placed his right index finger on the inside of the chain to check tension on it. The sprocket turned for the next step and his finger was caught and amputated. Employee #1 lost one-third of his right index fingertip, which included bone loss.
