Employee injured when struck by a forklift

Employee #1 was assigned to help clean up the job site around the end of the day. The employees routinely picked up all the ladders with a forklift and then leave them on the forks in an elevated position overnight. Employee #1 got on a conventional sit down fork lift that the company had used to set steel I-beams for a mezzanine. He began backing up with the mast and forks elevated. As Employee #1 backed up, the mast struck the adjacent mezzanine beam that was bolted into place. The forklift began to tip over and the operator jumped off and began to run. The forklift tipped all the way over on its side and the mast struck him in the head, bent him over backwards with a severe dislocation of the knee and an open wound of the leg. He died from his injuries.
