Employee injured when he falls from height

Employee #1 and two coworkers were on a third floor deck of a condominium under construction. They were preparing to install a wall section and were retrieving it from the bottom of a pile. The employer had a fall protection plan but it was not being followed nor had a controlled access zone been marked out. Employee #1 had not received any training. He fell 21 ft to the concrete floor and was hospitalized with bruises and contusions.
