Employee injured when rack falls on him

At approximately 2:00 p.m. on November 20, 2002, Employee #1, an electroplater employed by E-D Coat, Incorporated, was instructed to clean and organize a new automatic line shop at an electroplating plant in Oakland, California. He tried to move a fabricated rack holder standing on the south corner of the shop to another location. The holder was a tree-like metal structure standing on two 66-ft posts, which were 18.5 ft apart and joined at the top with a cross member. On each side of both posts, 17.5-in.- arms were welded to serve as rack supports. There were six levels of arms on one side and three on the other. The whole structure was mounted on a 30-in. by 35-in. metal plate which, in turn, was mounted on four wheels. The holder was loaded with about 60 pieces of racks, each weighing about 5 lb. In an effort to move it, Employee #1 grabbed the holder on two arms and pulled it. It tipped over and fell on Employee #1 with its load of about 60 racks, pinning him on the concrete floor. As a result, Employee #1 sustained a fractured back and a fractured rib. He underwent surgery and was hospitalized for more than 24 hours.
