Employee killed when struck by vehicle on highway

Employee #1 and a coworker were operating a Pavement Striping Machine to extend a painted striped area on an active interstate highway. To warn drivers the employer used a truck equipped with an arrow sign on the side of the interstate highway and an off-duty police officer in a marked police car on the entrance ramp to the highway. These vehicles were parked 450 ft from where Employee #1 and his coworkers were working. There was no flag person, warning signs, or devices being used near the actual work area. A vehicle drove around the marked police car. As he began to drive onto the highway, his vehicle struck the striping machine. The striping machine and Employee #1 were both pushed into an active lane of the highway, and were struck by another vehicle. Employee #1 was killed.
