Investigation Summary
At 1:20 p.m. on December 6, 2007, Employee #1 was replacing a fan belt on the exhaust fan on the roof of the Braze Room. Employee #1 turned off the exhaust fan, removed the guard, replaced the broken fan belt, and then turned the fan on to make sure the new fan belt was installed properly. Employee #1 turned the fan back off in order to replace the guard. As the fan was drifting to a stop, Employee #1 reached for the guard which was on the ground and his left hand made accidental contact with the moving fan belt which had not come to a complete stop. As he pulled his hand out, the tip of his third finger was amputated. The Employer at that time drove Employee #1 to the hospital, Bayside Medical Center, but never reported the accident to Cal OSHA. The accident resulted in permanent disfigurement of the injured finger, as well as loss of the nail (which did subsequently grow back) and the need for a skin graft. On May 4, 2011, Cal OSHA Inspectors Z9738 and G0335 were at this establishment investigating a different complaint when they saw Employee #1 and learned of the accident. A separate accident investigation was then opened. Once permission was received to inspect, a site investigation was initiated including a walkthrough, an interview with the employer and requesting relevant documents. This report summarized the facts and findings of that investigation. The exhaust fan involved in the accident on June 2, 2011 was inspected. At the time of the inspection, a large piece of the guard had broken off. Cal/OSHA had determined that the accident was caused by failure to follow lock-out/tag-out procedures. The following citation was issued to the employer: 3314(g) Failure to lock out/tag out machinery before servicing. The following general citation was issued to this employer: 4070(a) Failure to guard moving parts win 7 feet of the ground.
