Employee injured when fingers amputated by jump saw

At 11:00 a.m. on April 19, 2001, Employee #1 of Commercial Box and Pallet suffered injuries from an accident when he was cutting stock on a PCS-18 Jump Saw. Employee #1 amputated two fingers on his right hand when the saw actuated and cycled. According to Employee #1, the saw cycled without being triggered by the foot actuating pedal. Employee #1 was making angle cuts on pieces of 4-inch by 4-inch stock, which would later be assembled into pallets and crates. The saw was equipped with a manufacturer's blade guard, but it was not functional at the time of the accident. The employer had reassigned Employee #1 to work on the saw on the day of the accident. Employee #1 had received no training and had been working on the saw for approximately half an hour before the accident occurred. While making these cuts the saw cycled while Employee #1 was positioning the 4-inch by 4-inch stock. The jump saw is designed so that the saw blade comes up from below the table and not from above. The jump saw cycled while Employee #1's fingers were in the cutting path of the saw. Once the accident occurred, two coworkers who were working close by assisted Employee #1 to the front office. One coworker assisted Employee #1 in walking and a second coworker retrieved the severed fingers and brought them to the office. Employee #1 was transported to Palomar Medical Center by a coworker who is not listed as a witness, but whose identity is known. Employee #1's fingers were not reattached and he was hospitalized, receiving medical treatment in excess of 24 hrs. Subsequently, except for physical therapy and rehabilitation, Employee #1 has received no medical treatment and has not been hospitalized for any injuries or conditions related to the accident.
