Investigation Summary
The employer is a Sears distribution center which sends merchandise to other Sears warehouses for the entire country. The operation includes receiving cargo containers, sorting, and shipping merchandise out to other Sears distribution centers across the county. Employee #1 was employed by Sears as a fork lift operator and he has been operating the fork lift for 15 months. On the day of the accident, Employee #1 received an order from his supervisor to load a container at Dock 328. After offloading merchandise into the container, Employee #1 reversed the clamp-type fork lift out of the container in a southerly direction to line up the empty pallet stack so he could stack it on top of the other pallets. With the steering partially turned to the right, and the vehicle stopped, Employee #1 began to raise the fork lift with the empty pallet to go forward. As he raised the mast half way up, approximately 3 feet, he felt the fork lift lean to the right. Then he pressed the accelerator to lift up the forks to 6 to 7-feet in height. The fork lift tipped over to the right side, and Employee #1 remained inside the cab as the fork lift tipped over. The cage of the fork lift crushed Employee #1's right foot. Employee #1 was hospitalized with a fractured right foot.
