Employee injured when hand crushed by rollers of machine

At approximately 10:45 a.m. on November 15, 2001, Employee #1, a foreman with Poly Pak America, Inc., was working with a Hudson-Sharp polyethylene bag machine Model Number MS 1000 NG. The machine runs long lengths of printed polyethylene material through a series of rubber rollers where trim is removed from the side of the material before it is cut and sealed into bags. Employee #1 was at the rollers on the side near the rear of the machine and was working with another employee, his supervisor, who was at the control panel of the machine located at the opposite end. Just before the accident occurred, the machine experienced two simultaneous problems. At the same time that the polyethylene material became jammed at the front of the machine, a length of the trim became entangled in the lower counter rotating rollers at the other end. Such problems commonly occur and are not considered to be a malfunction of the machine. Employee #1 asked his supervisor to stop the machine so that he could remove the trim. The supervisor pushed the stop button but the machine was not mechanically or electrically locked out. In order to untangle the trim from the rollers which were spaced approximately 0.25 inches apart, Employee #1 used a box knife to cut the trim before unraveling it with his right hand. At the same time, the supervisor was attempting to clear the jam that had occurred at the front of the machine. In order to raise the sealing bar of the machine and remove the jammed material, the machine had to be reset by pressing the "enable button." The supervisor pressed this button which caused the lower rollers to turn, pulling the hand of Employee #1 into the machine to approximately the level of the palm area at the base of the thumb. Employee #1 suffered a crushing injury to his right hand avulsing the skin from the palm area. He was transported by paramedics to Los Angeles County USC Medical Center in Boyle Heights, CA where he underwent surgery.
