Employee struck by falling timber

While on the ground, Employee #1 was bent over putting a key in a hand-held electric drill. A 7 ft 6 in. piece of 3 in. by 3 in. timber fell from the 26th floor of the adjacent structure and struck the employee in the back of the neck. Employee #1 suffered a broken neck. The timber had been kicked over the guardrail on the 26th floor of the structure and had not been caught by the safety net.
