Investigation Summary
On April 4, 2009, Employee #1 was working with five other workers to remove a large oak tree from a hillside. The workers had completed trimming the tree down such that that only a 12-ft high section of trunk remained. The branches and upper portions of the trunk had already been cut and cleared away. The accident occurred while the final cuts on the trunk were being completed. Employee #1 was standing on the uphill side, next to the chain saw operator while the four remaining workers were also on the uphill side holding the guy lines that had been tied around the remaining trunk so as to prevent it from rolling down the hill and onto the street below. As the chain saw operator finished cutting the trunk, the trunk rotated clockwise around on its base and struck Employee #1's head and shoulder. The impact broke Employee #1's neck, humerus and scapula. Employee #1 fell to the ground and the trunk fell on top of him and rolled over him, fracturing his ribs and femur. Employee #1 was killed.
